About this file

This file is a Federal Required Certification document mandated under 44 C.F.R. Part 18, applicable to the Clean Power Pasadena Partnership contract opportunity issued by the City of Pasadena's Department of Water and Power (PWP). The certification pertains to a Request for Proposals for distributed generation renewable energy facilities of 200kW or larger located within PWP's service territory and directly interconnected to PWP's electric distribution grid. The RFP supports Pasadena's commitment under Resolution No. 9977 to source 100% of the city's electricity from carbon-free resources by the end of 2030. Proposed Projects must comply with California Renewable Energy Resources Program requirements (PUC 25740 et seq.) and California Renewables Portfolio Standard Program requirements (PUC 399.11 et seq.). PWP is primarily seeking Projects with commercial operation or delivery start dates on or before December 31, 2028, with a minimum delivery term of 10 years, though alternative delivery terms and later start dates will be considered.

The certification document requires contractors to certify that no Federal appropriated funds have been or will be paid to influence Federal agency officers, Members of Congress, or congressional employees in connection with the awarding of this Federal contract or related transactions. Any non-Federal funds used for lobbying activities must be disclosed on Standard Form-LLL. Contractors must include this certification language in all subaward documents and require subrecipients to certify and disclose accordingly. Failure to file the required certification subjects contractors to civil penalties ranging from $10,000 to $100,000 for each failure. The certification serves as a material representation of fact and is a prerequisite for entering into the transaction under 31 U.S.C. Section 1352, with provisions of 31 U.S.C. Chapter 38 regarding Administrative Remedies for False Claims and Statements applying to all certifications and disclosures.
