ACOT Questions #3 Solicitation Reference

Combined Synopsis / Solicitation – Item 1.

Item (1) states at the end that the result of this requirement is expected to result in the award of two (2) pre-priced BPAs.

Please clarify the following with regard to the two (2) BPA’s that will be awarded?

· Is the intent of the government to award BPA’s to two different contractors?

· That possibility does exist

· Are they competitive BPA’s where the government can chose from either award for the same curriculum at their discretion?

· The Government can chose either award for the same curriculum at their discretion.

Items 2 and 9 and 10 Item 2 states that the agreements, if any, will be made with the responsible offeror(s) who submits a proposal that (1) conforms to the requirements of the synopsis/solicitation; (2) represents the best value to the government, from the selection of the technically acceptable proposal(s) with the lowest evaluated price.

Item 9 states that the award(s) will be made on the basis of the lowest price technical acceptable… and goes on to say that … prices are determined to be fair and reasonable and represent the best value to the Government.

Item 10 refers to FAR 52.212-2, Evaluation of Commercial items.

Please clarify that the offerors proposal will be evaluated first on a technically acceptable basis and that those that are technically acceptable will be evaluated on best value to the government – vice – lowest price offeror will be reviewed for technical acceptability before all other offerors proposals are reviewed for best value.

The Government intends to evaluate based on technically acceptability first.

ACOT PWS, page 7 of 10, item 3.5 Contractor Manpower Reporting (CMR)

Does the government plan to strike this requirement since the government since this is a FFP per seat BPA; also, as mentioned in 3.4 of the government is not asking for any FTE or CWE assigned to the Government… Any contractor employees performing duties associated with the delivery, installation, or maintenance of the products referenced in this PWS are the responsibility of the contractor.

No, we will still need to do a manpower assessment as the clause is required for reporting ALL contractor manpower (including subcontractor manpower) required for performance of the contract.
