Continuation of block 14. DESCRIPTION OF AMENDMENT/MODIFICATION

The purpose of this amendment is to provide answers to RFP questions and attach the Proposal Adequacy Checklist.

a. All questions received after the issue of Amendment 0002 have been answered as follows:

Reference Solicitation Modification 0002, Questions and Answers

Question #5 Regarding SB goals and criteria for being deemed “acceptable”: Sections L and M require that the contractor address if small business participation possibilities exist/existed in the submitted Past Performance contracts and to what extent small businesses and sub-tiered small businesses were utilized. Section L, paragraph E(2) also states that if the submitted contracts did not include the referenced FAR clauses and did not allow for subcontracting possibilities, the offeror must address their policy for utilizing small businesses to the fullest extent possible within contract performance limits. Section L further requires submission of Volume IV, Small Business Concern Participation Factor, which identifies the small business participation proposed in this resultant contract.

However, The Government’s answer to question #5 in modification 0002 clearly states that in order for a proposal to be deemed “acceptable”, the offeror must have achieved “some of the sub-category goals”. This seems to be inconsistent with the instructions in Sections L and M.

Question 1: Will the determination of “acceptable” for small business participation apply to only the Small Business Concern Participation Volume (IV), to only the Past Performance Volume (III), or to both? Please clarify the evaluation and determination process for being deemed “acceptable” as described in Section M, para 1.A., Basis for Contract Award.

A: The offeror’s Small Business Concern Participation Volume IV will be assigned a rating of acceptable or unacceptable. Part of the past performance Volume III rating will include an evaluation of the offeror’s compliance with FAR 52.219-8 and FAR 52.219-9, if applicable, or an explanation of the offeror’s policy on the use of small business opportunities.

Question 2: If a small business will be submitting an offer as the prime, will they be deemed “unacceptable” for this requirement if they have not achieved any of the sub-tier small business goals on their past performance contracts, even if those contracts did not include FAR 52.219-8 and did not require sub-tier small business participation?

A: An offeror who is a small business may use their work to satisfy any applicable sub-tier small business goals. If limited or no subcontracting possibilities exist, the offeror may provide rationale why small businesses were not utilized and may still be deemed acceptable.

Question 3: How much sub-tier small business participation will deem the offeror “acceptable” for this requirement if the prime offeror is a small business, for both the Past Performance Volume (III) and the Small Business Concern Participation Volume (IV)?

A: There is no set level of participation required. Any amount of sub-tier participation or an explanation why there is no participation will allow the offeror to be deemed acceptable.

Question 4: Section M - Evaluation Criteria D.(1) states that the Government will not accept NSP or NC for Data Clins. CLIN 0001 is the labor CLIN for the ERR support. It is understood that the acceptance of this work will occur monthly with a receiving Report. The monthly status report goes along with this monthly deliverable for performance. It appears that this will be charged twice if the RFP remains unchanged.

A: Since data will not be evaluated as part of the total evaluated price an offeror may choose to price the data CLINs as not separately priced.

Question 5: CLIN 0004AA the Monthly Status Report - CDRL 0001 requires a QTY of 12 vs. 1 LOT based on it being due 45 days ACA and monthly thereafter.

Please clarify if this CLIN 0004AA can be changed to NSP.

A: CLIN 0004AA may be priced as Not Separately Priced.

Question 6: CLIN 0004 - Engineering Data - the PWS does not call out this deliverable. Please clarify.

A: This CLIN will not be priced as it is the parent CLIN for data and is not for a particular CDRL therefore, no deliverable is required. Specific CDRLs are called out in the subCLINs.

Question 7: CLIN 004AB - Scientific and Technical Report - CDRL 0002 requires a QTY of some amount based on it being due 15 days after completion of task. What task is it referring to?

Please clarify.

A: See PWS 4.8, Requirements for taskings.

Question 8: CLIN 0004AD - Quality Control Plan - CDRL 0004 requires a QTY of some amount based on it being due 15 days ACA. Also - as changes occur. CLIN pricing structure does not allow vendor to set up milestones for updates and future submittals of the deliverable. Please advise and clarify.

A: CLIN 0004AD may be priced as Not Separately Priced.

Question 9: CLIN 0004AE - Accident/incident Report - CDRL 0005 does not allow vendor to set up milestones and it requires a price even if there are no reports required. Please clarify if this CLIN 0004AE can be changed to NSP.

A: CLIN 0004AE may be priced as Not Separately Priced.

Question 10: CLIN 0004AF - Accident/incident Report - CDRL 0006 appears to be a RFP requirement for submittal in volume I. Please clarify is this CLIN can be changed to NSP.

A: CLIN 0004AF may be priced as Not Separately Priced.

b. The Proposal Adequacy Checklist is attached and can be found in Section J.

c. All other terms and conditions remain unchanged.
