SECTION F
DELIVERIES OR PERFORMANCE
52.211-8 TIME OF DELIVERY (JUN 1997)
(IAW FAR 11.404(a)(2))
(a) The Government requires delivery to be made according to the following schedule:
DELIVERY FOR EACH ITEM IS ANNOTATED IN THE SCHEDULE (PART I SECTION B) UNDER EACH LINE
ITEM.
The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.
ANNOTATE YOUR PROPOSED DELIVERY, IF ANY, UNDER THE GOVERNMENT’S DELIVERY SET FORTH
UNDER EACH ITEM IN THE SCHEDULE.
(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
(Applicable when the Government desires delivery by a certain time but requires delivery by a specified later time, and the delivery schedule is to be based on the date of the contract)
52.211-17 DELIVERY OF EXCESS QUANTITIES (SEP 1989)
(IAW FAR 11.703(b)) (Applicable when fixed-price supplies are furnished)
52.242-15 STOP-WORK ORDER (AUG 1989)
(IAW FAR 42.1305(b)(1)) (Applicable for supplies, services, or research and development)
52.242-15 STOP-WORK ORDER -- ALTERNATE I (APR 1984)
(IAW FAR 42.1305(b)(2)) (Applicable for Cost-reimbursement line items)
52.242-17 GOVERNMENT DELAY OF WORK (APR 1984)
(IAW FAR 42.1305(c)) (Applicable to fixed-price for supplies other than commercial or modified-commercial items)

SECTION H
SPECIAL CONTRACT REQUIREMENTS
H-01 PERFORMANCE INCENTIVE REQUIREMENTS AND PROCEDURES
The Contractor is eligible to earn a performance incentive of 5 percent (5%) of the proposed target cost for successfully completing Qualification Testing 60 days or more prior to Flight Test Readiness Review (FTRR). Contract Line Item Number (CLIN 0003) establishes the firm amount of the performance incentive.
Qualification Testing is successfully completed when the designed system meets all environmental and performance criteria identified in the System Requirements Document. The Contractor will submit related qualification test reports IAW SOW paragraph 3.1.7 to the Government for review to determine if the performance incentive requirements have been met. The Government will be the final decision authority as to whether qualification testing has been successfully completed. The Contracting Officer will notify the Contractor in writing of the final decision. If the performance incentive is earned, the Contracting Officer will authorize the Contractor to bill against CLIN 0003. If the performance incentive is not earned, the Contractor forfeits the performance. Any dispute arising under this provision is subject to the Disputes Clause, 52.233-1.
H-02 SMALL BUSINESS SUBCONTRACTING REQUIREMENTS AND INCENTIVES
(a) This clause does not apply to small businesses. The magnitude of this contract may require many business concerns to team, partner, and/or subcontract with other business concerns (large and small).
The Government has set a small business subcontracting requirement of at least 3.5% of total obligated dollars for this contract. All large business prime contractors are required to meet and maintain the small business subcontracting requirement throughout the life of the contract. The higher of the contractor proposed small business subcontracting target or the Government requirement will be considered the small business subcontract requirement.
Small Business subcontracting requirements will be expressed in terms of percent of contract value in addition to percent of subcontracted amount. Large businesses are required to subcontract 3.5% of the total contract value for the B-1B Self-Contained Attitude Indicator (SCAI) Program acquisition to small businesses. Second-tier (subcontractor two levels below prime contractor) awards may be considered in meeting or exceeding requirements. No lower tier will be considered. The small business subcontracting requirement will be reviewed annually and rated as an element of the Contractor Performance Assessment Reporting Systems (CPARS). IAW DFARS 219.705-4, any small business goal that is not a positive goal shall be justified. The contractor’s expressed targets will be incorporated into and become part of the contract. The contractor will be required to provide reports on SDB subcontractor participation in accordance with FAR clause 52.219-25.
For this contract, the Offeror has proposed a small business subcontract target of Taken from Proposal% of the total obligated dollars for this contract.
Data regarding each Contractor's subcontractor performance will be obtained in a Small Business Participation Report as follows: after contract award, prime contractors shall report its achievement in meeting subcontracting requirements through submission of documentation supporting actual total contract dollars subcontracted to small business concerns. This Small Business Participation Report shall include the information above in contractor format and be submitted six months after contract award and the report shall be updated every six months thereafter so that the Government can determine the extent of compliance by the prime contractor. Additional reporting is required in accordance with DFARS 252.219-7003, which requires the Contractor to report annually its achievement in meeting subcontracting requirements through submission of the Individual Subcontract Report (ISR) and the Summary Subcontract Report (SSR) using the web-based Electronic Subcontracting Reporting System (eSRS) http://www.esrs.gov.
(b) If it is determined that a prime contractor is not meeting the requirement specified in paragraph (a) at the time of submission of the Small Business Participation Report, the contractor shall be required to submit a "get well plan" to the Air Force within 30 calendar days thereafter. The "get well plan" shall set forth the remedial actions the contractor intends to take to meet the Small Business Subcontracting Requirement within the next 6 months. This "get well plan" must be approved by the Contracting Officer.
(c) The Contractor's performance in failing to meet, meeting, or exceeding proposed subcontracting requirement in paragraph (a) above, will be reflected in the annual contract CPARS and the Government’s determination on exercise of options..
(d) Failure to meet the subcontracting requirements of the contract may have a negative impact on the CPAR rating. It may also negatively impact the determination of the Government to exercise options on this contract and may be handled as any other contract breach. Conversely, exceeding the small business participation and subcontracting plan requirements may result in a favorable CPARS rating and have a positive impact on past performance ratings.
H-03 ADDITIONAL OVER AND ABOVE WORK PROCEDURES
(a) Negotiations on proposed over and above work should be completed prior to commencement of work, but in no case later than the time when 40 percent of the work is completed.
(b) For fixed hourly rate items, the price negotiated by the Administrative Contracting Officer shall be based on "hands on" labor hours multiplied by the contract hourly rate. The number of "hands on" labor hours required shall be negotiated by the Contractor and Administrative Contracting Officer. The fixed hourly rate includes charges for "hands on" labor, any labor cost which is not considered "hands on" for which the Contractor accounts as direct labor, burdens, general and administrative expenses, and other allowable costs and profit.
(c) At any time during contract performance, when sufficient data becomes available on a repetitive task being performed in the fixed hourly rate category, either the Contractor or the Procuring Contracting Officer may request a negotiation to establish a firm-fixed-price for that item for the remaining life of the contract. The Administrative Contracting Officer shall advise the Procuring Contracting Officer of all such agreements in order that changes can be incorporated in periodic contract modifications.
