SECTION 020800 – ASBESTOS ABATEMENT

PART 1 - GENERAL

1.1 BIDDING REQUIREMENTS

A. Pre-Bid Walkthrough and Bid Submittal Deadline

1. All bidders are required to attend the Pre-Bid Walkthrough.

2. The bid shall include the total costs to remove and dispose of all asbestos-containing materials (ACM), and other identified hazardous and/or non-hazardous materials described in this document. Demolition plans of the project work site are provided.

Previous ACM reports are attached to this document.

1.2 SITE INVESTIGATION

B. By submitting a bid, the Contractor acknowledges that he has investigated and satisfied himself as to: a) the conditions affecting the work, including, but not limited to, physical conditions of the site which may bear upon site access, handling and storage of tools and materials, access to water, electricity or other utilities, or other conditions affecting performance of required activities; b) the character and quantity of all surfaces and substrate materials or obstacles to be encountered in so far as this information is reasonably ascertainable from an inspection of the site, exploratory work done by the USAFA or designated consultants, and information presented in this specification document; c) the environmental condition, including the presence, location, and condition of ACM at the site; and d) the schedule of the project. Any failure by the Contractor to acquaint himself with available information will not relieve him from the responsibility for estimating properly the difficulty or cost of successfully performing the work.

C. The Contractor shall not rely on the material quantities indicated in this document as the total basis for the bid price. All quantities indicated herein are approximate and intended to alert the Contractor to the general scope of the project. No increase in contract cost will be considered due to the Contractor's failure to physically verify all quantities of the ACM specified by this document for removal.

D. The Contractor shall include in their bid price the total fee to abate and dispose of the ACM listed in Paragraph 1.13 E. pursuant to the removal and disposal methods described herein.

E. The USAFA is not responsible for any conclusions or interpretations made by the Contractor on the basis of the information made available by the USAFA.

F. No bids will be accepted from any Contractor who has not inspected the job site either in person or through a qualified designated representative.

G. Project will be awarded to the successful bidder.

H. Abatement will be coordinated with the USAFA Representative.

1.3 PATENTS

I. By submitting a bid on this project, the Contractor acknowledges and accepts full responsibility for compliance with patent or licensing requirements on any equipment, procedures or systems utilized on this project.

1.4 DISCREPANCIES

A. Should a Bidder find discrepancies in the plans and/or specifications or should he be in doubt as to the meaning or intent of any part thereof, he must, no later than two days prior to the bid submittal, request clarification from the USAFA or their representative. Discrepancies with regard to conflicts between the Contract Documents and applicable Federal, State or local regulations or requirements shall be included herein. Failure to request such clarification is a waiver to any claim by the Bidder for expense made necessary by reason of later interpretation of the Contract Documents by the USAFA or their representative.

B. Explanations desired by a prospective Bidder regarding the specifications or other bid documents shall be requested from the USAFA's Representative no later than two days prior to the bid submittal.

C. Oral explanations or instruction will not be binding. Only written addenda are binding. Any addenda resulting will be faxed to all listed holders of the Bid document no later than one hour prior to the bid submittal deadline. The Bidder shall acknowledge the receipt of all addenda.

1.5 MODIFICATION AND WITHDRAWAL OF BIDS

A. Withdrawal or modifications to bids are effective only if written notice thereof is filed prior to time and bid opening deadline. A notice of withdrawal or modifications to a bid must be signed by the Contractor or their designated representative. This provision is not applicable to change order items.

B. No withdrawal or modifications shall be accepted after the time specified for opening of bids, except for change order modifications if requested by the USAFA or the USAFA's Representative.

1.6 BONDING REQUIREMENTS

A. Bid bonds are required by the USAFA.

B. Contractor is required to furnish and maintain a Payment/Performance Bond.

1.7 LICENSES AND INSURANCE REQUIREMENTS

A. By initiating work on this project the Contractor acknowledges and accepts full responsibility for advising their current insurance carrier(s) of the fact that he is engaging in asbestos abatement work. Contractor shall provide one copy of project specifications to their insurance carrier upon award of contract. The verification of this submittal shall be included in project close-out documents.

B. All bidders shall show proof of and maintain One Million Dollars ($1,000,000.00) Asbestos Specific (True) Occurrence Insurance with cut through endorsements that will protect the Contractor and USAFA from claims that may arise out of or result from the Contractors activities under this contract, whether those activities are performed by himself or by anyone for whom acts any of them may be liable. The policy shall specifically name the USAFA as an additional insured under the policy. Insurance Pools will not be acceptable for this requirement.

1. Insurance must specifically include and state coverage for claims resulting from asbestos abatement work.

C. All Bidders must show proof that its workers are properly trained, certified, and licensed to perform the work. Such proof will be submitted to the USAFA’s Representative for review at least one day prior to start of work.

1.8 QUALIFICATIONS

A. All Bidders shall show proof of a valid State of Colorado Asbestos Abatement Contractors License.

B. All Bidders must show proof that its workers are properly trained, certified, and licensed to perform the asbestos abatement work in Colorado.

C. Bidders shall demonstrate as part of the bid package, prior experience on asbestos abatement projects of similar nature and scope through the submission of letters of reference from at least three previous owners including the name, address, and telephone number of contact person (someone specifically familiar with the Contractor's work) for at least three (3) previous years of service. Include descriptions of the projects, their location, and state if the projects were completed within schedule and budget. If not, provide an explanation.

D. Bidders shall submit a statement with the bid package, signed by an officer of the company, containing the following information:

1. A record of any citations issued by Federal, State or local regulatory agencies relating to asbestos abatement activity. Include projects, dates, and resolutions.

2. A list of penalties incurred through non-compliance with asbestos abatement project specifications including liquidated damages, overruns in scheduled time limitations and resolutions.

3. Situations in which an asbestos related contract has been terminated, including projects, dates and reasons for termination.

4. A listing of any asbestos-related legal proceedings/claims in which the Contractor (or employees scheduled to participate in this project) has participated or is currently involved. Include descriptions of role, issuer and resolution to date.

1.9 REJECTION OF BIDS

A. A bid may be rejected if it is found incomplete or in non-compliance with any provisions of these specifications, or for any other reason, in USAFA's sole discretion. The contract may be terminated if any information supplied by Bidder pursuant to Paragraph 1.7 and 1.8 is found to be incorrect.

1.10 DEFINITIONS

A. General: Definitions contained in this Article are not necessarily complete, but are general to the extent that they are not defined more explicitly elsewhere in the Contract Documents.

B. Regulations: The term "regulations" includes laws, statutes, ordinances, rules, regulations, requirements, guidance documents and similar guidelines and lawful orders issued by authorities having jurisdiction, as well as rules, conventions and agreements within the construction industry that control performance of the work, whether they are lawfully imposed by authorities having jurisdiction or not.

C. Furnish: The term "furnish" is used to mean "supply and deliver to the project site, ready for unloading, unpacking, assembly, installation, and similar operations."

D. Install: The term "install" is used to describe operations at project site including the actual "unloading, unpacking, assembly, erection, placing, anchoring, applying, working to dimension, finishing, curing, protecting, cleaning and similar operations."

E. Provide: The term "provide" means "to furnish and install, complete and ready for the intended use."

F. Project Site: The space available to the Contractor for performance of the work, either exclusively or in conjunction with others performing other construction as part of the project.

The extent of the project site will be identified at the pre-bid walkthrough.

G. Testing Laboratory: A "testing laboratory" is an entity certified by the appropriate Federal, State and/or local agencies engaged to perform specific analysis of asbestos bulk or air samples, either at the project site, or elsewhere.

H. Contractor: The Contractor provides permits, notifications, labor, materials and equipment necessary to complete the scope of work described in the Contract documents.

I. USAFA's Representative: The USAFA's Representative who will represent the USAFA during abatement and until final completion of the work. The USAFA's instructions to the Contractor will be forwarded through the USAFA's Representative.

J. General Superintendent: This is the Contractor's Representative at the work site. This person shall be the Competent Person required by OSHA and EPA regulations and licensed as a supervisor in Colorado.

K. Competent Person: One who is capable of identifying existing asbestos hazards in the workplace and selecting the appropriate control strategies and corrective measures to eliminate asbestos exposure.

1.11 DEFINITIONS RELATIVE TO ASBESTOS ABATEMENT

A. Accredited or Accreditation: (when referring to a person or laboratory): A person or laboratory accredited in accordance with section 206 of Title II of the Toxic Substance Control Act (TSCA) and other Federal, State and local laws applicable to the work.

B. Abatement: An act which is intended to reduce, eliminate or encapsulate asbestos-containing materials.

C. Adequately Wet: To sufficiently mix or penetrate with liquid to prevent the release of particulates. If visible emissions are observed coming from asbestos-containing material, then that material has not been adequately wetted. However, the absence of visible emissions is not sufficient evidence of being adequately wet.

D. Air Monitoring: The process of measuring the fiber content of a specific volume of air.

E. Amended Water: Water to which a surfactant (wetting agent) has been added to increase the ability of the liquid to penetrate ACM.

F. Asbestos: The asbestiform minerals are chrysotile, amosite crocidolite, anthophyllite, actinolite and tremolite. For purposes of determining respiratory and worker protection, the asbestiform minerals and any of these materials that have been chemically treated and/or altered shall be considered as asbestos.

G. Asbestos-Containing Material (ACM): Any material containing more than one percent of asbestos as determined by polarized light microscopy methods.

H. Asbestos-Containing Building Material (ACBM): Surfacing ACM, thermal system insulation ACM, or miscellaneous ACM that is found in or on structural members or other parts of a building.

I. ACM Waste: Mill tailings or any waste that contains commercial asbestos and is generated by a source subject to the provisions of 40 CFR 61. This term includes removed asbestos-containing material, containment sheeting, filters from air filtration machines, disposable removal equipment and clothing contaminated with asbestos, and disposal bags or other similar packaging containing asbestos.

J. ACM Debris: Pieces of ACM that can be identified by color, texture, or composition, and dust, if the dust is determined by an accredited inspector to be ACM.

K. Authorized Person: A person authorized by USAFA's Representative and General Superintendent and is required by work duties to be present in the regulated area.

L. Breathing Zone: A hemisphere forward of the shoulder with a radius of approximately 6 to 9 inches.

M. Category I Nonfriable ACM: Asbestos-containing packings, gaskets, resilient floor covering, and asphalt roofing products containing more than one percent asbestos that when dry cannot be crumbled, pulverized or reduced to powder by hand pressure.

N. Category II Nonfriable ACM: Any material, excluding Category I nonfriable ACM, containing more than one percent asbestos that when dry cannot be crumbled, pulverized, or reduced to powder by hand pressure.

O. Class I asbestos work: Activities involving the removal of TSI and surfacing ACM.

P. Class II asbestos work: Activities involving the removal of ACM which is not TSI or surfacing ACM. This includes, but is not limited to, the removal of asbestos-containing wallboard system, floor tile, sheet vinyl, roofing materials, siding shingles, and construction mastics.

Q. Class III asbestos work: Repair and maintenance operations, where ACM, including thermal system insulation and surfacing material, is likely to be disturbed.

R. Critical Barrier: One or more layers of plastic sealed over all openings into a work area or any other similarly placed physical barrier sufficient to prevent airborne asbestos in a work area from migrating to an adjacent area.

S. Decontamination Area: An enclosed area adjacent and connected to the regulated area and consisting of an equipment room, shower area, and clean room, which is used for the decontamination of workers, materials, and equipment that are contaminated with asbestos.

T. Demolition: The wrecking or taking out of any load-supporting structural member and any related razing, removing, or stripping of asbestos products.

U. Disposal Bag: A properly labeled six (6) -mil thick leak-tight plastic bag used for transporting ACM waste from the regulated area to the disposal site.

V. Encapsulant: A material that surrounds or embeds asbestos fibers in an adhesive matrix to prevent release of fibers.

1. Bridging encapsulant: An encapsulant that forms a discrete layer on the surface of an in-situ asbestos matrix.

2. Penetrating encapsulant: An encapsulant that is absorbed by the in-situ asbestos matrix without leaving a discrete surface layer.

3. Removal encapsulant: A penetrating encapsulant specifically designed to minimize fiber release during removal of asbestos-containing materials rather than for in-situ encapsulation.

W. Filter: A media component used in respirators or ventilation equipment to remove solid fibers and particles from the processed air.

X. Friable ACM: Material containing more than one percent asbestos that when dry can be crumbled, pulverized, or reduced to powder by hand pressure.

Y. Glovebag: An impervious bag (typically constructed with 6-mil polyethylene plastic) designed to be affixed around an object containing ACM (typically TSI) with inward projecting long sleeve gloves which are used for the handling of tools and performing ACM removal.

Z. HEPA Filter: A High Efficiency Particulate Air (HEPA) filter capable of trapping and retaining 99.97% of asbestos fibers greater than 0.3 microns in diameter.

AA. HEPA Filtration System: An air ventilation system utilizing HEPA filters and may or may not utilize a pressure differential relative to the work zone exterior.

BB. HEPA Filter Vacuum Collection Equipment (or Vacuum Cleaner): High efficiency particulate air filtered vacuum collection equipment with a filter system capable of collecting and retaining asbestos fibers. Filters should be of 99.97% efficiency for retaining fibers of 0.3 microns or larger.

CC. Negative Pressure Respirator: A respirator in which the air pressure inside the respiratory-inlet covering is positive during exhalation in relation to the air pressure of the outside atmosphere and negative during inhalation in relation to the air pressure of the outside atmosphere.

EE. Permissible Exposure Limit (PEL): The level at which employees must not be exposed to airborne asbestos fibers. The TWA limit is 0.1 f/cc.

FF. Protection Factor: The ratio of the ambient concentration of an airborne substance to the concentration of the substance inside the respirator at the breathing zone of the wearer. The protection factor is a measure of the degree of protection provided by a respirator to the wearer.

GG. Regulated Area: An area demarcated by the Contractor where Class I, II, and III asbestos work is conducted, and any adjoining area where debris and waste from such asbestos work accumulate; and a work area within which airborne concentrations of asbestos, exceed or there is a reasonable possibility they may exceed the permissible exposure limit.

HH. Regulated Asbestos-Containing Material (RACM): Regulated asbestos-containing material (RACM) means (a) Friable asbestos material. (b) Category I non-friable ACM that has become friable. (c) Category I non-friable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or (d) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by 40 CFR 61.

II. Removal: All operations where ACM is stripped from building components, substrates, and/or removed from the project site by demolition operations.

JJ. Respirator: A device to protect the wearer from the inhalation of harmful atmospheres.

KK. Surfacing material: ACM material that is sprayed, troweled-on or otherwise applied to surfaces (such as acoustical plaster on ceilings and fireproofing materials on structural members, or other materials on surfaces for acoustical, fireproofing and other purposes).

LL. Surfactant: A chemical wetting agent added to water to improve penetration, thus reducing the quantity of water required for a given operation or area.

MM. Thermal System Insulation (TSI) material: ACM applied to pipes, fittings, boilers, breaching, tanks, ducts or other structural components to prevent heat loss or gain.

NN. Time Weighted Average (TWA): The average concentration of a contaminant in air during a specific time period.

OO. Transite: Cement asbestos products, e.g. shingle, pipe, panel.

PP. Visible Emissions: Any emissions containing particulate asbestos material that are visually detectable without the aid of instruments. This does not include condensed uncombined water vapor.

QQ. Waste Shipment Record: The shipping document (manifest), required to be originated and signed by the waste generator and used to track and substantiate the disposition of asbestos-containing waste material.

RR. Wet Cleaning: The process of eliminating asbestos contamination from building surfaces and objects by using cloth, mops, or other cleaning utensils which have been dampened with amended water or diluted removal encapsulant and afterwards thoroughly decontaminated or disposed of as asbestos-contaminated waste.

SS. Working Day: Working day means Monday through Friday, excluding holidays.

The following acronyms or abbreviations as referenced in Contract Documents are defined to mean associated names. 1.13 SCOPE OF WORK

A. This specification covers the abatement of asbestos from Two Pipes in the Heat Plant, from Vault #1 and Vault #2, and from Excavation #2 (and any associated below grade piping) at the project work site. It is the intent of the Contract Documents to show the work necessary to complete the project. The Asbestos and Lead-Based Paint Sampling Report (HDR, April 2013) along with its appendices shall be referred to along with this Specification.

B. The Contractor shall furnish all labor, materials, permits, notifications, insurance and equipment necessary for the total removal of all areas of ACM listed below and ACM debris associated with those portions of the project site. The Contractor shall visit the site to assess the exact amounts of ACM present as well as the extent of physical difficulty involved in its complete removal (Note: the piping in the Heat Plant reaches over 15 feet high and the Vaults and Excavation are below grade). The Contractor shall consult the General Removal Procedures and the General Description of Work below for the general intent of this Contract Document.

There will be a USAFA Representative (Air Monitoring Specialist) at the job site throughout all phases of the work.

1. Removal will be performed in four separate areas: two pipes in the Heat Plant, Vault #1, Vault #2, and Excavation #2 (and any associated below grade piping). Each area will be sealed off with 6-mil polyethylene critical containment barriers and will be under negative air.

2. For the two pipes in the Heat Plant, full containment shall be constructed including separate entry/exit and waste load areas, and will include a shower within the three chambered entry/exit area.

3. For the two Vaults and Excavation and any associated below grade piping that needs to be removed or renovated, entry/exit and waste load out will be conducted from one opening in each area due to the physical constraints of the below ground Vaults and Excavation. A mini-containment consisting of two chambers shall be constructed over the top of the man-hole of Vault #1 and Vault #2, and on top of the opening of Excavation #2.

A Centralized Worker Decontamination Area shall be provided at a location as close as practically possible to the two Vaults and Excavation. The decontamination area should consist of a wash area with a shower, soap and disposable towels.

The Contractor shall utilize wet methods, and HEPA vacuums for the removal of the following ACM:

a. Two Pipes in the Heat Plant: Pipe #1 (Closest to the door and stairway) and Pipe #2 next to Pipe #1

• An asbestos sample from Pipe #1 indicates 85% chrysotile asbestos.

The results indicate it should be assumed the gray wrap on both pipes contains asbestos unless proven otherwise. It should also be assumed the TSI of both pipes contains asbestos unless proven otherwise. All pipe wrap and TSI from areas to be disturbed on Pipes #1 and #2 shall be removed. Quantities shall be verified in the field.

• Refer to the HDR April 2013 Asbestos and Lead-based Paint Sampling Report for more sampling information.

b. Vault #1

• The black cementitious material around piping at wall penetrations contains 3% chrysotile asbestos.

• The black pipe wrap contains 4% chrysotile asbestos.

• It should be assumed all of the black cementitious material around all piping at the wall penetrations and all of the black pipe wrap in the vault contains asbestos. It should also be assumed if the same material is present on piping in piping tunnels or buried under ground, or is mixed in with debris on the floor, and/or is present in other vaults, it also contains asbestos unless proven otherwise. All like material in the vault and in piping tunnels that will be disturbed or removed shall be abated unless it is proven it does not contain asbestos. All quantities shall be verified in the field.

• Though the one floor debris sample did not indicate asbestos, asbestos debris is most likely mixed up in the soil, thus the entire soil surface should be considered as asbestos containing. All loose material/soil/debris shall be removed to a depth of at least 2 inches until no more visually suspect ACM is present or to a concrete surface. All quantities shall be verified in the field.

• Refer to the HDR April 2013 Asbestos and Lead-based Paint Sampling Re-port for more sampling information.

c. Vault #2

• Miscellaneous debris on the floor of the vault contains 3% chrysotile asbestos. This sam-ple was a composite of two random soil samples and the laboratory results describes the sample as “black resinous”, which is the same description as the pipe wrap. Asbestos debris is most likely mixed up in the debris on the floor, thus the entire floor surface should be considered as asbestos containing.

• The black cementitious material around the piping at the wall penetration contains 3% chrysotile asbestos.

• The black thick tar like pipe wrap near the pipe penetration contains 3% chrysotile asbes-tos.

• The entire floor surface of the vault should be considered as asbestos containing. All loose material/soil/debris shall be removed to a depth of at least 2 inches until no more visually suspect ACM is present or to a concrete surface. All quantities shall be verified in the field.

• It should be assumed all of the black cementitious material around the piping at the wall penetration, and all of the black thick tar like pipe wrap along with any of the same mate-rial on the floor contains asbestos. It should also be assumed if the same material is pre-sent on piping in piping tunnels or buried under ground, and/or is present in other vaults, it also contains asbestos unless proven otherwise. All like material in the vault and in pip-ing tunnels that will be disturbed or removed shall be abated unless it is proven it does not contain asbestos. All quantities shall be verified in the field.

• Refer to the HDR April 2013 Asbestos and Lead-based Paint Sampling Re-port for more sampling information.

d. Excavation #2

• Sample results indicate asbestos is not present in the black asphaltic pipe wrap.

• Sample results indicate asbestos is present (4% chrysotile) in a trace amount of material

(less than 1%) of black resinous material in the TSI on piping sample. The TSI itself (white fibrous plaster, 100% of the material) did not contain asbestos.

• It should be assumed all of the black resinous material around the piping contains asbestos.

It should also be assumed if the same material is present on piping in piping tunnels or buried under ground, and/or is present in other excavations or vaults, it also contains asbestos and if disturbed should be abated unless proven otherwise. All quantities shall be verified in the field.

C. The Contractor shall dispose of all ACM, asbestos debris and asbestos-contaminated debris in an EPA approved landfill in a safe and approved manner in compliance with all applicable Federal, State and local statutes, laws, rules, regulations and requirements, and provide the USAFA with records of the same. In the event procedural questions not covered by this job specification arise, the Contractor will be guided by the overall purpose of this section.

Intentional or willful violations of these job specifications will be grounds for immediate termination of the contract and possible assessment of damages.

D. The Contractor shall remove all ACM from the areas specified above and leave those areas of the site in a condition free of ACM and ACM debris.

Renovation plan drawings are included in the project plans.

If at any time during the specified scope of work the Contractor encounters any suspect ACM which have not been characterized by the Contract Documents, then the Contractor shall provide notice to the USAFA’s Representative.

E. General Removal Procedures

1. After constructing critical barriers with 6-mil poly, construction containment, obtaining negative air, and posting work areas with caution tape and OSHA notifications and barriers, the following general abatement procedures shall be utilized on the project:

a. Soil and Debris: Removal shall be performed with a HEPA vacumn and/or by wetting and scooping and bagging the soil/debris. Soil/debris shall be removed to a depth of at least 2 inches until no more visually suspect ACM is present or to a concrete surface.

b. Pipe Wrapping: Remove material using wet methods.

c. All ACM wastes generated shall be double-bagged, appropriately labeled, transported and disposed of at a Colorado-approved landfill. A manifest must accompany the ACM waste during transport and disposal.

d. Use proper worker protective equipment. Pass final visual clearance inspection. Apply lockdown encapsulant to all exposed surfaces. Pass final air clearance test (<0.01 f/cc- PCM). Remove remaining containment barriers and dispose of as ACM waste.

2. The Contractor shall conduct asbestos removal in accordance with the U.S. Department of Labor, Occupational Safety and Health Administration (OSHA) Standard 29 CFR

1926.1101 and the State of Colorado Regulation No. 8, Control of Hazardous Air Pollutants, Colorado Air Quality Control Division, Section III.

3. The USAFA’s representative will conduct air sampling within the regulated work area and air sampling of the perimeter of the work area.

4. Use proper worker protective equipment. Pass USAFA Representative’s final visual clearance inspection. Apply lockdown encapsulant to all exposed surfaces. Pass final air clearance test (0.01 f/cc - PCM). If the samples have results greater than 0.01 f/cc then additional PCM samples will be collected. The results of the additional samples must be less than 0.01 f/cc to clear the area. Remove remaining containment barriers and dispose of as ACM waste.

1.14 DESCRIPTION OF WORK

A. The work specified herein shall be the complete, licensed removal of all specified ACM (Paragraph 1.13 E. 2.) and associated ACM debris. The work will be performed by competent, licensed persons trained, knowledgeable and qualified in the techniques of abatement, handling and disposal of asbestos-containing and asbestos-contaminated materials and the subsequent cleaning of internal contaminated areas. These competent persons must comply with all applicable Federal, State and local regulations and are capable of and willing to perform the work of this Contract Document. All such persons shall be properly licensed, certified and accredited. The Contractor will be responsible for verifying the validity of each worker’s licensing, certification, and accreditation.

B. The Contractor shall supply all labor, materials, notifications, insurance, permits, fees and equipment necessary to carry out the work in accordance with all applicable Federal, State and local regulations and these specifications.

C. The Contractor shall be aware that "special conditions" exist: The piping in the Heat Plant reaches heights of approximately 15 feet. Vaults 1 and 2 and Excavation #2 may be considered confined space and the vaults and excavation contain steam lines that when in operation may exceed 150 degrees F and cause extreme temperatures within the vaults and excavation. Any failure by the Contractor to identify any other "special conditions" will not relieve him from the responsibility for estimating properly the difficulty or cost of successfully performing the work.

D. Throughout the removal and subsequent cleaning operations, the Contractor is responsible for all personal air monitoring as required under OSHA regulations for the protection of their employees. Samples shall be taken to establish an 8-hour Time-Weighted Average (TWA) and exposure for each type of employee operation. Sampling and analysis shall be conducted in strict accordance with applicable OSHA regulations. Air samples to be analyzed by phase contrast microscopy (PCM). Analytical results of personal air samples shall be made available to the USAFA's Representative on a 24 hour maximum turnaround basis. A minimum of 25% of the workers in each type of work operation shall be monitored continuously. All air samples submitted by the Contractor for analysis shall be submitted with two filter blanks to a laboratory currently accredited in the AIHA Laboratory Accreditation Program.

E. Baseline, area and final clearance air sampling will be conducted by the USAFA's Representative. The results of this air sampling or final visual clearances will be made available to the Contractor within 24 hours of that activity. Should the Contractor desire this information earlier, he shall make a written request to the USAFA's Representative. Air monitoring samples will be analyzed by PCM, NIOSH Method 7400.

1.15 SCHEDULE OF WORK

A. Upon award of the Contract, Contractor shall immediately file all necessary notifications (if required) with the State of Colorado Department of Public Health and Environment.

B. Successful bidder on this project will be notified by the General Contractor.

C. The asbestos abatement areas will be available to contractor in accordance with the General Contractors construction schedule. Note: the abatement areas will be occupied when the Contractor is not performing abatement.

D. Contractor shall schedule abatement work on this project in such a manner so as to complete work by the scheduled completion date. Contractor shall have access to the work area 9 hours a day per each work day (7:00 am to 5:00 pm).

1.16 APPLICABLE STANDARDS AND GUIDELINES

A. General Requirements:

1. All work under this contract shall be done in strict accordance with all applicable Federal, State and local regulations, standards and codes governing asbestos abatement (including removal, transportation and disposal), and any other trade work done in conjunction with the abatement.

2. By initiating work on this project the Contractor is aware of and is knowledgeable of all current Federal, State and local regulations (including those listed below) affecting the work on this project. The act of initiating work on this project indicates that the Contractor is willing to solely accept responsibility for the adherence to all regulations and the enforcement of all personal protection and safety requirements. The Contractor further acknowledges willingness to solely accept responsibility for the defense and resolution of any claims, filed by any party, as they may relate to the work performed by the Contractor on this project.

3. Where compliance with two or more standards is specified, and they establish different or conflicting requirements for minimum quantities or quality levels, the most stringent requirement will be enforced. Refer requirements that are different, but apparently equal, and uncertainties as to which quality level is more stringent to the USAFA's Representative for a decision before proceeding.

C. Copies of Standards: Each entity engaged in construction of any part of the Project is required to be familiar with industry standards applicable to that entities' construction activity. Copies of applicable standards are not bound with the Contract Documents. Where copies of standards are needed for performance of a required construction activity, the Contractor shall obtain copies directly from the publication source. Although copies of standards needed for enforcement of requirements may be part of required submittals, the USAFA's Representative reserves the right to require the Contractor to submit additional copies as necessary for enforcement of requirements.

1.17 SUBMITTALS AND NOTICES

A. Contractor Submittals Prior to Abatement:

1. If applicable, send written notification in accordance with 40 CFR Part 61.145 of Subpart M (11/20/90 Revision) to the Federal air pollution control agency responsible for the enforcement of the National Emission Standard for Asbestos at least 10 working days prior to the commencement of any onsite project activity. Provide the USAFA's Representative with a copy of the notice prior to beginning removal of ACM.

2. If applicable, the Contractor shall also notify the local air pollution control agency (CDPHE) in regards to the asbestos abatement activity, if applicable. Provide the USAFA's Representative with a copy of the notice prior to beginning removal of ACM.

3. Submit proof satisfactory to the USAFA's Representative that required permits (if applicable) have been obtained and that disposal site location and arrangements for transportation of asbestos-containing waste materials have been made. If a separate transporter (other than the Contractor) is to be employed to transport the ACM waste to the landfill, copies of the transporter’s licenses and permits shall be submitted to USAFA's Representative.

4. Submit documentation satisfactory to the USAFA's Representative that the Contractor's employees (supervisors and abatement workers) are properly licensed in Colorado and have current refresher training.

5. Submit evidence acceptable to the USAFA's Representative that the testing laboratory responsible for PCM analysis of the Contractor's employees OSHA-mandated personal air samples is currently accredited by the AIHA Laboratory Accreditation Program.

6. Submit documentation from a physician that all employees or agents who may be exposed to airborne asbestos in excess of background level have been provided with an opportunity to be medically monitored to determine whether they are physically capable of working while wearing the respirator required without suffering adverse health effects.

In addition, document that personnel have received medical monitoring as required in OSHA 29 CFR 1910.1001 (j). The Contractor must be aware of and provide information to the examining physician about unusual conditions in the workplace environment (i.e., high temperatures, humidity, chemical contaminant) that may impact on the employee's ability to perform work activities.

7. Submit, to the USAFA's Representative, manufacturer's certification that HEPA vacuums and HEPA filtration units and any other local exhaust ventilation equipment conform to ANSI standards.

8. When rental equipment is to be used in abatement areas or to transport asbestos contaminated waste, a written notification concerning intended use of the rental equipment must be provided to the rental agency with a copy submitted to the USAFA's Representative.

9. Document NIOSH approvals for all respiratory protective devices utilized onsite. Include manufacturer certification of HEPA filtration capabilities for all cartridges and filters.

10. Submit documentation of respirator fit-testing for all Contract or employees and agents who must enter the regulated area. This fit-testing shall be in accordance with qualitative procedures as detailed in the OSHA Asbestos Standard 29 CFR 1910.1001 Appendix C, Qualitative Fit Test Protocol or be quantitative in nature.

B. Contractor Submittals During Abatement Activities:

1. Submit weekly job progress reports to USAFA’s Representative detailing the abatement activities. Include a review of completed abatement work, scheduled abatement work, delays encountered, injury reports, equipment breakdown, maintenance or replacement actions and personnel air sampling results conducted by Contractor.

2. Submit to USAFA's Representative, copies of all transport manifests, waste shipment records, trip tickets and disposal receipts for all asbestos waste materials removed from the work area during the abatement process.

C. Submittals to Contractor During Abatement:

1. Results of ambient air sampling data collected during the course of the ACM removal work will be submitted to the Contractor by the USAFA’s Representative. These sample results are for information only and may not be relied upon by Contractor for any purpose. They serve only to monitor Contractor performance during the project and shall not release the Contractor from any responsibility to sample for OSHA compliance or to otherwise perform Contractor's obligations hereunder.

2. All ambient and final clearance visual inspection and air monitoring will be performed by the USAFA's Representative. A copy of which shall be submitted to Contractor for inclusion into their permanent record.

D. Potential Asbestos Hazard

1. The disturbance or dislocation of ACM may cause asbestos fibers to be released into the ambient atmosphere, thereby creating a potential health hazard to workmen, and others present at or near this site. Apprise all abatement workers of the seriousness of the hazard and of proper work procedures which must be followed.

2. Where in the performance of the work, workers, supervisory personnel, subcontractors, consultants or others may encounter, disturb or otherwise function in the immediate vicinity of any identified asbestos-containing materials, take appropriate continuous

measures as necessary to protect all others from the potential hazard of exposure to airborne asbestos. Such measures shall include the procedures and methods described herein, and compliance with regulations of applicable Federal, State and local agencies.

E. Stop Work:

1. If the USAFA's Representative presents a written stop work order immediately and automatically stop all work. Do not recommence work until authorized in writing by USAFA's Representative.

F. Site Use:

1. During the scheduled abatement period, the Contractor shall have the use of the project site for construction operations 9 hours a day per each working day. Contractor must confine operations at the site to the times and areas permitted under the Contract.

Portions of the site beyond areas on which work is indicated are not to be disturbed except as necessary to insure the safety of those present at or near the site. Conform to site rules and regulations affecting the work while engaged in project construction.

2. Keep existing driveways and entrances serving the premises clear and available to the USAFA and its employees at all times. Do not use these areas for parking or storage of materials without prior consent from the USAFA.

3. Do not unreasonably encumber the site with materials or equipment. Confine stockpiling of materials to the areas indicated by the USAFA.

1.18 SITE SECURITY

A. The regulated area is to be restricted only to authorized, licensed, trained, and protected personnel. This may include the Contractor's employees, USAFA's Representative and employees of State and local inspectors and any other designated individuals. A list of authorized personnel shall be established prior to job start and posted in the clean room of the worker's decontamination area or at the entrance to the project site.

B. Entry into the regulated area by unauthorized individuals shall be reported immediately to the USAFA's Representative by the Contractor.

C. A log book shall be maintained by the Contractor on site. Anyone who enters a regulated area must record name, affiliation, time in, and time out for each entry.

D. Contractor shall control site security during ACM removal operations whenever possible, in order to protect work efforts and equipment.

1.19 EMERGENCY PLANNING

A. An emergency plan (Health and Safety Plan) shall be developed prior to initiation of the asbestos abatement action. A copy of the plan shall be available at the clean room of the worker decontamination area.

B. The emergency procedures in the Health and Safety Plan shall include telephone numbers for potential emergency response (police, fire department, and emergency medical needs), the location of the nearest telephone and the location to the nearest hospital. A map showing streets with directions to the hospital shall also be provided in the plan.

C. Emergency planning shall include considerations of fire, explosion, toxic atmospheres, electrical hazards, slips, trips and falls, confined spaces and heat related injury. Written procedures shall be developed and employee training in the procedures shall be provided.

D. Employees shall be informed of the Health and Safety Planning and trained in evacuation procedures in the event of workplace emergencies.

1. For non life-threatening situations (employees only slightly injured) shall decontaminate following normal procedures with assistance from fellow workers, if necessary, before exiting the work place to obtain proper medical treatment.

PART 2 - MATERIALS AND EQUIPMENT

2.1 MATERIALS

A. General:

1. Deliver all materials in the original packages, containers or bundles bearing the name of the manufacturer and the brand name (where applicable).

2. Store all materials subject to damage off the ground, away from wet or damp surfaces and under cover sufficient enough to prevent damage or contamination. Replacement materials shall be stored outside of the work area until abatement is completed.

3. Damaged, deteriorating or previously used materials shall not be used and shall be removed from the work site and disposed of properly.

4. Glovebags, if used, shall be a minimum of 6-mil thickness and be seamless at the bottom. All glovebags shall be removed from the original packing material and thoroughly inspected for defects around all seams and at the point of glove and accessory attachments. Any defective glovebags will be repaired or discarded.

5. Polyethylene sheeting for critical barriers and stationary objects shall be a minimum of 6-mil thick.

6. For floors and all other uses, sheeting of 6-mil thickness shall be used.

7. Method of attachment may include any combination of duct tape or other waterproof tape, furring strips, spray glue, staples, nails, screws or sheets of polyethylene and capable of sealing polyethylene to dissimilar finished or unfinished surfaces under both wet and dry conditions (including the use of amended water).

8. Disposal bags shall be of clear, 6-mil polyethylene, preprinted with labels per OSHA requirement 29 CFR 1910.1001 (j) (2) and 29 CFR 1926.1101 (k) (7).

9. Disposal drums shall be metal or fibercoated with interlocking ring tops.

10. Stick-on labels as per OSHA requirements (see 2101.9) for disposal drums.

11. Warning signs as required by OSHA 29 CFR 1910.1001 (j) (1) and 29 CFR 1926.1101 (k)

(6).

B. Removal Chemicals:

1. Surfactant (wetting agent) shall be a 50/50 mixture of polyoxyethylene ether polyoxyethylene ester, or equivalent, mixed in a proportion of one (1) fluid ounce of five

(5) gallons of water or as specified by manufacturer. An equivalent surfactant shall be understood to mean a material with a surface tension of 29 dynes/cm as tested in its properly mixed concentration, using ASTM method D1331-56- "Surface and Interfacial Tension of Solutions of Surface Active Agents." Where work area temperature may cause freezing of the amended water solution, the addition of ethylene glycol in amounts sufficient to prevent freezing is permitted.

2. Removal, Penetrating and Bridging Encapsulants shall be suitable to aid in removal of ACM. The encapsulant shall act as its own solvent and be capable of binding and encapsulating individual asbestos fibers.

C. Lockdown

1. Encapsulation lockdown materials shall be bridging type. Encapsulants should not be solvent-based or utilize a vehicle (the liquid in which the solid parts of the encapsulant are suspended) consisting of hydrocarbons and shall not be flammable.

2.2 EQUIPMENT
