SECTION 01 11 02

SPECIAL CONDITIONS

1. PERFORMANCE PERIOD: The performance period estimated by the Government for the completion of the entire work ready for use, including from the preconstruction activities through the finish works, is 330 calendar days, including an average inclement weather days. Said performance period includes 120 calendar days for the materials submittal/delivery at the work site.

The Contractor shall not be able to commence the work until all the material has been received. The required field investigation to detect underground services, including unforeseen utilities, may slow work progress.

1.1. It shall be the sole responsibility of the Contractor to ensure all required submittals are submitted to Construction Management for approval in a timely manner, which shall not incur any delay in completion of the project. For materials or equipment requiring a long term of procurement and delivery, said term shall be included in the period of performance. Delay in delivery/procurement will not justify an extension of the period of performance.

2. GOVERNMENT-FURNISHED MATERIAL (GFM): No GFM is used.

3. EQUIPMENT, CONTROLS, AND MATERIAL OF THE UNITED STATES OF

AMERICA: The following listed equipment, controls, and materials shall be manufactured in the United States of America or in another country where the supplier is under license of the United States of America manufacturer and the product meets the same applicable specifications and/or standards. No substitutions will be allowed.

Hose bib and hose connection vacuum breaker.

Package air conditioner unit.

Volume Control Damper, actuator and transformer for fresh air intake.

Electrical conduits, boxes and accessories.

Sensor for fire alarm system.

3.1. Excess: the Contractor shall furnish to the Contracting Officer, just prior to completion of this contract, a consolidated inventory of all excess supplies, materials, and equipment imported duty free for use under this contract. The Contractor shall either pay required duties on the excesses or re-export the excesses.

4. CERTIFICATES: The submitted certificates shall be original or a notarized copy.

The Contractor shall submit the certificates within 30 calendar days after the Notice to Proceed (NTP) date.

4.1. Classification Certificate of the Contractor: Contractor must hold an updated Certificate of Classification issued by the Spanish “Registro Oficial de Licitadores y Empresas Clasificadas del Estado” of the "Ministerio de Hacienda y Administraciones Públicas" covering the following groups, subgroups, and categories. The certificate holder must execute the activities related to the certificate.

5. SPECIAL GENERAL REQUIREMENTS: The following special conditions apply:

a. The demolition and disassembly of equipment will be carried out once the new ones are available on site.

b. Any domestic hot water service shutoff must occur within three months, from June, July and August, the locker rooms of the pool will be in service, unless otherwise indicated.

c. The chillers must have a heat pump to provide hot water to the air handling units (AHU). The boiler will be the primary heating source and the heat pump (chillers) will function as the backup or alternative for heating.

d. Work phasing: The execution of work shall be carried out in phases, considering that the building may always remain partially operative and that the interruption of air conditioning and/or heating service must be minimized, whenever possible.

The contractor shall advise of possible services shutoff and areas out of service with a minimum period of 7 days.

The contractor shall submit a proposed detailed phasing plan for this building, taking into consideration what is mentioned below. The proposed phasing plan shall comply the following maximum time (natural days) in which the different rooms are out of service:

During the phase 9 works, domestic hot water production service and air conditioning services will be shutoff for the whole building, except as indicated in the following point

e. Cooling/heating shut off schedule: HVAC interruptions are unavoidable; however, the existing direct expansion equipment will be in service during the works.

The Contractor shall submit a detailed plan of the cooling/heating shut off schedule required for the execution of this project. Said schedule shall be submitted for approval prior to the commencement of work. Schedule shall include the number and duration of suspension of service/building use events considering that these shall be kept to a minimum.

a. Roof slab openings: The work to perforate holes on the roof slab shall be executed in phases as shown on the contract drawings. The work area shall de delimited with plastics or other means to guarantee cleanliness in the area to remain in operation. It shall be the Contractor’s responsibility to move the furniture affected by these works, under the supervision of a Contracting Officer Representative. The Contractor shall protect all surfaces which may become damaged due to the execution of work.

b. Electrical power outages: There are several works under this contract that will require performing partial power outages in the facility, that shall be coordinated through Contracting Office as indicated in the General Conditions section of the specifications and herein. In any case, power outages should be minimized.

c. It will not be necessary to make general power outages in the building.
