1. DESCRIPTION OF SERVICES.

1.1. GENERAL SCOPE.

The contractor shall furnish all management, supervision, labor, training, material, equipment, supplies, and services necessary for the demolition and disposal of barbed wire fence and gates as identified on the attached map (Attach 2) at Melrose Air force Range (MAFR), located at Melrose, NM in accordance with all federal, state, and local regulations. Security for MAFR must be maintained at all times. Demolition shall begin no less than 30 days after contract award.

1.2. REQUIREMENT. There are 134 miles of barbed wire fence and 50 designated gates with the possibility of a few more barb wire gates to be demolished. The average number of gates in a mile of demolition is 2.68 gates. The spacing of the fence’s T-Posts is 10 to 16 feet. The Contractor shall demolish the existing fences as identified on the provided drawing (Attach 2). The Contractor is responsible for the disposal of all demolished material with the exception of gates, gate posts, and corner/line braces from MAFR.[footnoteRef:1] Gates, gate posts, and corner/line braces shall be placed at the Reclamation Yard on MAFR and will remain Air Force property. Contractor is not required to repair or replace damaged sections that are not caused by neglect. Concrete material on all gate/corner posts and braces must be removed before returning the posts/braces to the Government. Demolished concrete may be used to fill in holes. All holes created by the contractor shall be filled and leveled. Tumbleweed and vegetation removal is the responsibility of the Range Support contractor, not the demolition contractor. Any areas requiring vegetation mitigation needs to be coordinated through the COR. Period of Performance for this contract shall be 212 calendar days from contract award. [1: Bolted on gate braces may be salvaged by the Contractor. Gate braces welded to the gate post will be retained by the Government. Non spark producing cutting methods are acceptable to disassemble the braces at the weld joint to allow for re-welding.]

1.3. SCHEDULE. Prior to beginning work, the Contractor shall submit a work schedule to the Contracting Officer. The contractor is responsible for all subcontractors performing work on this PWS. The prime or subcontractor shall schedule daily time on the range with the 27 SOW Scheduling Authority no less than two weeks in advance of performing work on the range.

1.4. PROCEDURES. Contractors will comply with 27 SOAOS OPERATING INSTRUCTION 13-212 (Attachment 3). All personnel entering the range are required to sign in each day at the MAFR Ground Control Authority building on Sun Dale Valley Road. A safety brief will be given and a radio must be signed out by the contractor and all subcontractors. The contractor will maintain radio contact with Melrose Tower at all times. If Laser Eye Protection is required, it will be furnished to the contractors by MAFR Ground Control Authority.

2. SERVICE SUMMARY. Due to the Non-Complexity of the service, a service summary is not required.

3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

3.1 The government shall provide two-way radio and Laser Eye Protection as needed. At the end of each work day the contractor shall turn in all government furnished equipment to the MAFR Ground Control Authority. This equipment will be provided in sufficient time to enable the Contractor to meet his or her performance schedule.

3.2 The contractor is responsible for safe keeping all Government furnished equipment while in the contractor possession. The Government Furnished Property relevant to this PWS include two-way radios, laser eye protection, as well as the gates, gate posts, corner braces, and line braces.

3.2.1 Items of equipment missing or not in working order shall be recorded and the contracting officer (CO) notified in writing. The contractor and the Government representative shall jointly determine the working order and condition of all equipment and document their findings. In the event of a disagreement between the contractor and the Government representative on the working order and condition of the equipment, the disagreement shall be treated as a dispute under the contract clause entitled 52.233-1 “Disputes.”

3.3 The contractor should contact the MAFR wild land fire manager after award for any precautionary measures that may be applicable to the work site. All grading, dozing, use of loaders, and skid-steers must be pre-approved by the COR to protect environmental/historical/archeological areas.

4. GENERAL SAFETY INFORMATION. The Contractor is solely responsible for compliance with OSHA standards for the protection of their employees.

5. ENVIRONMENTAL CONTROLS.

5.1 Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable New Mexico Environmental Governing Standards, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect.

5.2 Notification of Environmental Spills. If the contractor spills or releases any substance contained in 40 CFR 302 into the environment, the contractor or its agent shall immediately report the incident to the COR. The liability for the spill or release of such substances rests solely with the contractor and its agent.

6. CONTRACTOR PERSONNEL

6.1. CONTRACT MANAGER. The Contractor shall provide a Contract Manager (CM) who shall be responsible for the performance of the work. The name of this person and an alternate or alternates, who shall act for the contractor when the manager is absent, shall be designated in writing to the Contracting Officer before the start of the contract. The CM or alternate shall have full authority to act for the Contractor on all matters relating to the daily operation of this contract. The CM or alternate shall be available via telephone, cellular telephone, or email to address any emergency situations. The CM or alternate shall be available during normal duty hours (7:30 a.m. to 4:30 p.m., Monday through Friday) to meet with government personnel (designated by the Contracting Officer) to discuss problem areas.

6.1.2. The Contractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.

6.1.3. All employees shall be U.S. citizens or authorized by appropriate visa to work in the U.S. All employees must read, speak, and understand English intelligibly for radio and range safety communication.

6.1.4 The innermost fence is adjacent to a hazard area. This should fall within the 8% DOL hazard area definition. All other areas are outside of the DOL definitions.

6.1.5 The address for work to be performed is 3771 Sundale Valley Road, Floyd, NM 88118 for taxation purposes.

6.2. CONFLICT OF INTEREST. The Contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest. The Contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval in accordance with the Joint Ethics Regulation, DoD 5500.7R.

7.0. SECURITY REQUIREMENTS. The Contractor’s duties may require entry into restricted areas; therefore, a background check is required. This will be initiated using the employees full SSN, full name, place of birth, date of birth, and driver’s license number.

7.1. WEAPONS, FIREARMS, AND AMMUNITION. Contractor employees are prohibited from possessing weapons, firearms, or ammunition, on themselves or within their contractor-owned vehicle or privately-owned vehicle while on Melrose Air Force Range, New Mexico.

8.0. QUALITY CONTROL. The Contractor shall develop and maintain a quality plan to ensure services are performed in accordance with this PWS, federal, state, local standards and codes.

9.0. QUALITY ASSURANCE. The government will periodically evaluate the Contractor’s performance by appointing a Contracting Officer Representative (COR) to monitor performance to ensure services are received. The COR will evaluate the Contractor’s performance through intermittent on-site inspections of the Contractor’s quality control program.

9.1. The Contracting Officer may require the Contract Manager to meet with the Contracting Officer, Contract Administrator, COR, or other Government Personnel as deemed necessary. The Contractor may request a meeting with the Contracting Officer when he or she believes such a meeting is necessary.

10.0. GOVERNMENT PROVIDED TRAINING. The contractor must obtain Range Lead training from the 27 SOAOS/RMO prior to work start IAW 27 SOAOS OPERATING INSTRUCTION 13-212 para. 2.3 (Attachment 3).

11.0. PERFORMANCE OF SERVICES DURING CRISIS DECLARED BY THE NATIONAL COMMAND AUTHORITY OR OVERSEAS COMBATANT COMMANDER. According to Department of Defense Instruction (DoDI) 3020.37, Continuation of Essential DoD Contractor Services During a Crisis, and the Air Force implementation thereof, unless otherwise directed by contracting officer, it is determined that the Fence Demolition Services requirements under this PWS are not essential to be performed during a crisis.

12.0. CONTRACTOR MANPOWER REPORTING. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the United States Air Force via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October* of each calendar year. Contractors may direct questions to the CMRA help desk.
