MEMORANDUM FOR INTERESTED PARTIES

SUBJECT: Questions & Concerns submitted by an Interested Party in response to solicitation FA4803-14-Q-B038, Catholic Religious Education Coordinator
1. As a result of the solicitation for the Catholic Religious Education Coordinator – An Interested Party submitted Questions & Concerns requiring Responses.
Question: Is there an incumbent Contractor?
Answer: No, this position is currently being filled by volunteers.
Concern: Please clarify that since the combined synopsis/solicitation was issued as a Request for Quote, responses received by vendors are informational only, are not binding offers, and that SF 1449 block 28, the 30 day Period of Acceptance for Offerors, and FAR 52.212-2(c) do not apply. In multiple ways, the solicitation gives the impression that the responses will be viewed as offers.
· Example 1: SF 1449 block 28 is marked and states in part: "Contractor agrees to furnish and deliver all items set forth or otherwise identified above…"
· Example 2: The combo solicitation states: "Period of Acceptance for Offerors: The offeror agrees to hold its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is stated in an addendum to the solicitation."
· Example 3: 52.212-2(c)- Evaluation- Commercial Items states in part: "A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party."
Answer: FAR 13.004 and FAR 12.603. Clause 52.212-2 is applicable as outlined in FAR 12.603(c)(ix).
Concern: Please delete the clause at 52.243-1, Changes--Fixed Price as it conflicts with, and has different terms than the mandatory clause at 52.212-4(c).
Answer: Revised to Clause 52.243-1 Alt 1.
Concern: Please revise the Period of Performance from 22 Aug 14 - 21 Aug 15 to a period that will allow sufficient time for the Contractor to comply with DODI 1402.5, Criminal History Background Checks on Individuals in Child Care Services Positions. The Contractor's employee will not be permitted to start work until the background check is completed because this is a non-personal services contract and no supervision will be provided.
Response/Clarification: The Period of Performance adjusted.
