1. DEFINITIONS:
a. Task Order (TO) – A document prepared by the Government and issued to the contractor defining the general requirements and parameters of the proposed project. Included in the TO is the Statement of Work defining specific technical requirements for the project and type of solicitation.
b. Delivery Order (DO) – A document prepared by the Government and issued to the contractor. Its purpose is to place an order for labor, materials and other associated items as necessary to complete construction of a specific project.
c. Statement of Work (SOW) – A document prepared by the government and issued to the contractor as part of the task order. Included in the SOW are the specific technical requirements for the project.
d. Invitation for Bid (IFB) – A package of documents issued to a contractor requesting a firm price for construction for a project based on the Task Order. Once submitted, no revisions to the bid are permitted. Award is made to the low bidder.
e. Request for Proposal (RFP) – A package of documents issued to the contractor requesting an itemized cost proposal for construction for a project based on the Task Order. Following submittal of the proposal and at the government’s option, discussions may be held with the contractor to clarify and / or negotiate elements of the proposal.
f. Government Furnished Equipment (GFE)/Government Furnished Material (GFM) Items of equipment or material which the government will supply to the contractor for use in the construction of a project.
g. Notice to Proceed (NTP) – A written notice to the contractor to proceed with construction of a specific project.
2.
DESCRIPTION OF WORK:
a. The Mini-MACC will be utilized to execute a broad range of minor maintenance, repair and construction projects on real property at Ellsworth AFB, South Dakota (EAFB). The projects will include tasks in a variety of trades such as demolition, excavation, cast-in-place concrete, masonry, structural steel, mechanical (including HVAC), millwork, electrical, fire protection and other specialty and general contracting work.
b. An Invitation for Bid (IFB) issued under this contract will include a Task Order (TO), Statement of Work (SOW), Bid Schedule, and any drawings, sketeches, pictures, available as-builts, specifications, or design information, etc., as applicable. Bids will be submitted on the bid schedule provided by the Government. In addition, the TO may also include, but is not limited to, the following:
(1) Government prepared Statement of Work (SOW), drawings, sketches, pictures, and any available as-builts, specifications, or design information.
(2) Timeframes for preparing the bid and completing construction.
(3) Submittal requirements
(4) Government Furnished Materials (GFM) or Government Furnished Equipment (GFE).
c. Proposals received in the IFB format will be evaluated based on the proposed price.
d. The contractor may be required to work within controlled or restricted areas.
3. COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK:
The contractor shall commence work and complete the project in accordance with the time frames established in the Delivery Order (DO) and Notice to Proceed (NTP).
a. Digging Permits: The contractor will be responsible for coordinating a government supplied, Base Civil Engineer Work Clearance Request (AF Form 103) prior to performing digging of any type. The contractor shall process the digging permit by coordinating with and obtaining signatures from responsible representatives of the organizations listed on the AF Form 103 prior to obtaining final approval from the Air Force Base Civil Engineer or his approved representative. The area requested for clearance for each individual permit shall be limited to a maximum of two (2) weeks production for an individual permit. The contractor will be given assistance, by the government, in the execution of the initial Work Clearance Request. Thereafter, government assistance will be limited to an as-needed basis in the event of unusual circumstances. It will be the contractor's responsibility to coordinate the completion of the necessary AF Form 103 and arrange to have existing utilities located as indicated on the completed form, prior to the beginning of digging operations in the individual areas. This coordination is anticipated to take approximately three (3) working days to complete per request, and may require coordination with as many as twenty (20) individuals located on or near the base. A blank copy of the AF Form 103 is included in the Appendix. Any unusual delay in obtaining approval from any particular organization will be reported immediately to the Contracting Officer Representative for assistance.
b. Digging Operations: Digging near established interference or crossover points shall be done by hand, five (5) feet either side of the point along the intended route, in order to prevent disturbing the existing utility. If the existing utility is uncovered in the new excavation, it shall be protected from damage and movement while in the open excavation and during backfill. The contractor shall be responsible for the repairs and associated costs for repairs of any utility damaged by construction, whose location was made known to the contractor.
c. Working Hours: Normal working hours are to be between 6:30 a.m. and 5:00 p.m. excluding Saturdays, Sundays and Federal holidays. If the Contractor desires to work during periods other than above, additional government inspection forces may be required. The contractor must make his/her request to the Contracting Officer three days in advance of his/her intention to work during other periods to allow assignment of additional inspection forces. The Contracting Officer shall determine, at his discretion, whether such inspection forces are available and whether work will be allowed on a non-scheduled day. The contracting officer may authorize the contractor to perform work during periods other than normal duty hours/days; however, if inspectors are required to perform in excess of their normal duty hour/days solely for the benefit of the contractor, the actual cost of inspection at overtime rates will be charged to the contractor. These adjustments to the contract price may be made periodically as directed by the contracting officer.
4.
WARRANTY OF CONSTRUCTION:
a. In addition to any other warranties in this contract, the contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or workmanship performed by the contractor or any subcontractor or supplier at any tier. This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes or fraud.
b. This warranty shall continue for a period of one (1) year from the date of final acceptance of the work, unless otherwise specified in the individual TO. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of one year from the date of beneficial occupancy. In the event the contractor’s warranty of this clause has expired, the Government may bring suit, at its expense, to enforce a subcontractors’, manufacturers’, or suppliers’ warranty.
c. The contractor shall remedy, at the contractor’s expense, any failure to conform or any defect. In addition, the contractor shall remedy, at the contractor’s expense, any damage to Government-owned or controlled real or personal property when that damage is the result of:
The contractor’s failure to conform to contract requirements or
Any defect of equipment, material, workmanship, or design furnished.
d. The contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The contractor’s warranty with respect to work repaired or replaced will run for one year from the date of repair or replacement.
e. The Contracting Officer shall notify the contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage.
f. If the contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the contractor’s expense.
g. With respect to all warranties, express or implied, from subcontractors, manufacturers or suppliers for work performed and materials furnished under this contract, the contractor shall:
Obtain all warranties that would be given in normal commercial practice
Require all warranties to be executed, in writing, for the benefit of the Government if directed by the Contracting Officer, and
Enforce all warranties for the benefit of the Government if directed by the Contracting Officer. Emergency warranty calls shall not exceed a 4-hour response time, while routine warranty response time shall not exceed 3 workdays.
h. Unless a defect is caused by the negligence of the contractor, subcontractor, or supplier at any tier, the contractor shall not be liable for the repair of any defects of material furnished by the Government or the repair of any damage that results from any defect in Government-furnished material or design.
i. The warranty enumerated herein does not preclude any manufacturer warranties in excess of one year as noted in the individual specifications sections. The contractor should read each section carefully to ensure that he/she is aware of all warranties called for in each project.
5.
WARRANTY/GUARANTEE RECORDS:
a. The contractor shall prepare Optional Form(s) (OF) 274, Equipment Warranty Certificate, and affix the certificate(s) to all warranted components of the equipment installed during the project. The Construction Inspector will distribute the OF 274 to the contractor during the pre-construction conference. The contractor shall place all OF(s) 274 on the appropriate equipment prior to final acceptance of the project by the Government.
b. The contractor, if required by the SOW, shall prepare O&M Manuals. The contractor shall include in the O&M Manuals a listing of all equipment or material carrying a manufacturer’s warranty. Use the Equipment Warranty/Guarantee Record, below; for each item and attach manufacturer’s certificate as appropriate.

6. MATERIAL APPROVAL SUBMITTAL FORM (AF Form 3000):
(AF FAR SUP 5336.290): All material and articles requiring approval, as indicated in the SOW, shall be submitted by the contractor using AF Form 3000. Contractor is responsible for identifying and locating required materials for submittals to include matching any existing materials.
7.
SUBCONTRACTING SUPPORT CAPABILITY:
Contractor shall provide subcontractor management including surveillance, quality control, and scheduling. Subcontractors must be available to ensure quick response times. The contractor must ensure subcontractors are competent and capable of handling all tasks assigned to them and shall ensure that each subcontractor is not assigned more work than they can accomplish satisfactorily.
8.
GOVERNMENT FURNISHED EQUIPMENT/MATERIALS:
a. The Government reserves the right to provide Government furnished equipment/materials (GFE/GFM) that is on hand if it can be used by the contractor to complete a DO. The GFE/GFM shall be transported by the Contractor, from the Government storage area, to the work site indicated on the TO.
b. The contractor assumes the risk and responsibility for the loss or damage to GFE/GFM once the contractor receives possession of the GFE/GFM.
c. The contractor shall follow the instructions of the Contracting Officer or his/her representative regarding the disposition of all GFE/GFM not consumed in performance of a delivery order.
9.
GOVERNMENT EQUIPMENT ON THE SITE:
a. All government equipment and material on each project is the property of the Government unless specifically noted otherwise. Contractor shall relocate all property that the Government retains title to on the installation as specified in the TO or follow the instructions of the Contracting Officer or his/her representative.
b. Contractor is required to cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss and store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications. Equipment temporarily removed shall be protected and returned equal to its condition prior to starting work at no additional expense to the Government. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the contractor.
c. All reasonable quantities of water and electricity will be made available to the Contractor without charge. Connections to the utilities are the contractor’s responsibility.
10.
DISPOSAL OF WASTE:
a. Except for excess soil, all materials removed under this contract shall be disposed of off base in such a manner that meets federal, state and local environmental codes. Excess soil will be delivered, by the contractor, to a storage area within the limits of Ellsworth Air Force Base. Contractor shall submit, upon request, all trip tickets from the landfill facility to show all debris is being landfilled in accordance with all Federal requirements and in an approved location.
b. Loose debris on trucks leaving the site shall be loaded in a manner that shall prevent dropping of materials on streets and conform to local ordinances/laws. Fasten suitable cover, such as a tarpaulin, over the load before entering surrounding streets. The contractor shall be responsible for cleaning up any materials that fall from trucks and held liable for any resulting damages.
c. Access will be by the Commercial Gate during the week (Monday through Friday), and the Main Base Gate during weekends (Saturday and Sunday). The designated routes shall be used by both loaded and unloaded vehicles.
11. CONSTRUCTION SITE MAINTENANCE:
a. Contractor shall store all supplies and equipment on project site so as to preclude theft or damage. Maintain site in a neat and orderly manner. Protection and security for materials and equipment on site is the sole responsibility of the contractor. The contractor may be required to install temporary fencing to protect the site as indicated in the TO. Contractor shall keep the construction site cleaned daily of all construction trash, trash generated by employees, debris, and/or demolished building materials. Contractor or Contractor’s employees, including subcontractors, shall not park any personally owned vehicles (POVs) or company and/or delivery vehicles on grassy areas near or in the construction site without prior approval from the CO, or his/her designated representative. When allowed, parking on grassy areas will only be for short-term delivery purposes (to include heavy tools, equipment, construction materials, etc.). Use designated hard surfaces or existing parking lots near or within the project site for parking of POVs or company and/or delivery vehicles. Permission to park on grassy areas does not relieve the contractor of the responsibility to restore affected areas to original condition. Tire and track impressions (ruts) created on wet or soft soil by vehicles and/or equipment used in the Contractor’s operation shall be repaired. Contractor shall restore the affected area(s) to its original condition within a timely manner. Final payment shall not be made until all repairs have been completed to satisfaction of the Contracting Officer. Contractor shall restore the site to a condition and appearance similar or equal to existing before the damages occurred. Such restoration work will not be considered complete until approved by the CO or his/her designated representative. The Government will not accept sites that have not been raked and restored to this standard.
b. The Contractor will be authorized the use of an area adequate for his materials and equipment storage at the site. The Contractor shall set up and maintain his operation within the area in an orderly manner and upon completion of the project, shall restore the premises to its original condition free of all excess materials, debris and excavations or embankments resulting from his operations. The Contractor will also be responsible for his own equipment security.
c. The Contractor will be allowed to utilize certain locations within the project area as approved by the Contracting Officer to park equipment and store construction materials. Staging areas shall be maintained in a neat, orderly manner including erection of temporary fencing around the areas and restored after use.
d. Area not identified to be removed/worked under this contract that are disturbed or damaged during construction shall be removed and replaced at no additional cost to the Government.
12. WORK IN SPECIAL SECURITY AREAS:
Government shall provide all escorts required for contractor access to restricted/controlled areas, while working on construction projects at Ellsworth AFB.
13. DELAYS IN ENTERING AND LEAVING WORK AREA:
If the work site is located in a restricted or controlled area, the contractor may experience delays due to compliance with entrance/exit requirements of restricted/controlled areas. The contractor shall not be compensated for reasonable delays in accessing the site. Also, due to the nature of restricted areas, the contractor may be requested to leave the restricted area at any given time. The Contracting Officer may extend the contract performance time when area designations change while the contractor is working.
14.
SAFETY AND HEALTH:
a. General:
In order to provide safety controls for protection to the life and health of employees and other persons, for prevention of damage to property, materials, supplies, and equipment, and for avoidance of work interruptions in the performance of this contract, the contractor shall comply with all pertinent provisions of the Corps of Engineers Manual, EM 385-1-1, (current version), entitled “Safety and Health Requirements Manual,” as amended, and will also take or cause to be taken such additional measures as the Contracting Officer, or his/her designated representative may determine to be reasonably necessary for the purpose. The manual can be obtained from the Government Printing Office, Washington DC 20402.
The contractor will maintain an accurate record of, and will report to the Contracting Officer or his/her designated representative in the manner and on the forms prescribed by the Contracting Officer or his/her designated representative, exposure data and all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incident to work performed under this contract.
The Contracting Officer or his/her designated representative will notify the contractor of any noncompliance with the foregoing provisions and the action to be taken. The contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the site of the work, shall be deemed sufficient for the purpose. If the contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of claim for extension of time or for excess costs or damages by the contractor.
Compliance with the provisions of this clause by subcontractors will be the responsibility of the contractor.
b.

Applicable Publications: The publications listed below form a part of these general provisions. .
Code of Federal Regulations (CFR): Occupational Safety and Health Administration (OSHA) General Industry Safety and Health Standards (29 CFR 1910), Publication V2206, OSHA Construction Industry Standards (29 CFR 1926). One source of these regulations is OSHA Publication 2207, which includes a combination of both Parts 1910 and 1926 as they relate to construction safety and health. They are for sale by the Superintendent of Documents, U.S. Government Printing Office, Washington, DC 20402.
National Emission Standards for Hazardous Air Pollutants (40 CFR, Part 61).
c.
Federal Standard (Fed. Std.):
313A Material Safety Data Sheets, Preparation and the Submission to the Bio-environmental office on each installation. Safety and Health Requirements Manual, EM 385-1-1.
Use of Asbestos Containing Material or any Class 1 ozone depleting chemical compounds are prohibited, DA Circular 40-83-4.
Work covered by this section: This section is applicable to all work covered by this contract.
Definition of Hazardous Materials: Refer to hazardous and toxic materials/substances included in Subparts H and Z of 29 CFR 1910 and to others as additionally defined in Fed. Std. 313. Those most commonly encountered include asbestos, lead paint, polychlorinated biphenyls (PCBs), explosives, and radioactive material, but may include others. The most likely products to contain asbestos are sprayed-on fire proofing, insulation, boiler lagging, and pipe covering.
15. ASBESTOS REQUIREMENTS:
ANY ASBESTOS ABATEMENT REQUIRED IN CONJUNCTION WITH PROJECTS EXECUTED UNDER THIS CONTRACT WILL BE ACCOMPLISHED BY THE GOVERNMENT. THE FOLLOWING IS PROVIDED FOR INFORMATIONAL PURPOSES.
a. THE CONTRACTOR IS WARNED THAT EXPOSURE TO AIRBORNE ASBESTOS HAS BEEN ASSOCIATED WITH FOUR DISEASES: LUNG CANCER, CERTAIN GASTROINTESTINAL CANCERS, PLEURAL OR PERITONEAL MESOTHELIOMA, AND ASBESTOSIS.
b. Studies indicate there are significantly increased health dangers to persons exposed to asbestos who smoke, and further, to family members and other persons who become indirectly exposed as a result of the exposed worker bringing asbestos-laden work clothing home to be laundered.
c. The contractor is advised that friable and/or non-friable asbestos containing material may be encountered in area(s) where contract work is to be performed. Friable asbestos-containing material means any material that contains more than one percent asbestos by weight that hand pressure can crumble, pulverize or reduce to powder when dry. Non-friable asbestos-containing materials are materials in which asbestos fibers are bound by a matrix material, saturate, impregnate, or coating. Non-friable asbestos-containing materials do not normally release airborne asbestos fiber during routine handling and end use. However, excessive fiber concentrations may be produced during controlled abrading, sanding, drilling, cutting, machining, removal, demolition, or other similar activities.
d. Care must be taken to avoid releasing, or causing to be released, asbestos fiber into the atmosphere where they may be inhaled or ingested.
e. OSHA has set standards at 29 CFR 1926.58 for exposure to airborne concentrations of asbestos fibers, methods of compliance, medical surveillance, housekeeping procedures, and measures that must be taken when working with or around asbestos-containing other materials. 29 CFR 1926.58 has been identified as applicable to construction (29 CFR 1926.55 gases, vapors, fumes, dusts and mists). The Environmental Protection Agency (EPA) has established standards at 40 CFR 61.140-156 for the control of asbestos emissions to the environment and the handling and disposal of asbestos wastes.
f. Asbestos containing materials are not permitted by current criteria and shall not be used in new construction or modification projects (STL 1110-1-118, 27 May 1983). The contractor shall review plans and specifications for all new construction and modification projects to insure that asbestos-containing materials are not used. Any asbestos material installed by the contractor will be removed and disposed of by the Government at the contractor's expense.
g. Maintenance, modification or demolition activities where exposure to asbestos dust may occur from previously installed friable or non-friable asbestos containing material will only be accomplished by the Government.
16.
PRECAUTIONS AGAINST HAZARDS:
The contractor shall comply with the following when engaged in hazardous operations:
a. All welding and cutting operations shall be done in accordance with nationally recognized good practice. The current publications of the American Welding Society, 2501 NW 7th Street, Miami FL 33125, and the National Fire Protection Association, 470 Atlantic Ave, Boston MA 02110, shall be used as a minimum standard of nationally recognized safety procedures in welding and cutting.
b. The contractor shall provide the necessary methods of fire extinguishment and fire prevention. Before operations begin, clear all welding and cutting operations with the Contracting Officer or his/her designated representative. The contractor shall request and receive an AF Form 592, USAF Welding and Brazing Permit, before preparing for such operations.
c. The contractor shall discontinue all burning, welding, or cutting operations one hour prior to the end of the workday. The contractor shall provide a workman to remain at the site for thirty (30) minutes after discontinuing the above operations. This workman shall make a thorough inspection of the area for possible sources of latent combustion. Any unsafe conditions shall be reported to the Fire Department for their investigation –PHONE # 385-1113.
d. The use of open-flame heating devices will not be allowed except by special permission of the Contracting Officer or his/her designated representative. Such permission will not be granted unless the contractor has taken all venting precautions. Burning trash, brush or trees on the job site will not be allowed. Approval for the use of open fires and open-flame heating devices will in no way relieve the contractor from the responsibility of any damage resulting from such fires.
e. Flammable liquids shall be stored and handled in accordance with the Flammable Liquids Code (No. 30) of the National Fire Protection Association. Flammable liquids shall not be stored in the contractor’s storage trailers.
f. The Installation Fire Department, Technical Services Section, is available for assistance concerning fire hazard questions.
17. SMOKING IN AIR FORCE FACILITIES:
The Air Force has banned use of all tobacco products in all Air Force facilities. Contractor employees and visitors are subject to the same restrictions as are Government personnel. Smoking is permitted only in designated smoking areas.
18. TOILET FACILITIES:
a.
Contractor’s personnel shall be permitted to use existing toilet facilities, where available, on the premises subject to approval of the Contracting Officer or his/her designated representative. Facilities must be kept clean by contractor.
b.
When existing toilet facilities are unavailable the contractor shall provide and maintain sanitary temporary toilets for all work accomplished in and adjacent to project. These toilets shall be located as directed by the Contracting Officer. The temporary toilets shall be portable, enclosed and weatherproofed and kept in a sanitary condition at all times.
19.
AIRFIELD REQUIREMENTS:
a.
Contractor shall contact Base Operations for construction restrictions involving the flight line, taxiway, and runway areas and shall comply with Air Force Instruction (AFI) 13-213.
b.
Two-way radio contact on Very High Frequency (VHF) Radio capable of communication with the Air Traffic Control Tower on the ramp net is required at all times for all personnel and groups of personnel working on the flight line, taxiways, and runways.
20. IDENTIFICATION OF EMPLOYEES:
a.
Installation Entry Authority List (IEAL): These lists are kept at the gates to verify employment. The following guidelines apply :
(1) On Base: Submit original IEAL request to the Contracting Office.
(2) The IEAL must be in alphabetical order, on company letterhead, containing the complete address and phone number of the company, signed by an authorized company representative, and in the following format:

(3) DO NOT combine your IEAL with the subcontractor's IEAL. Each company/ subcontractor must have a separate IEAL.
(4) Additions/Deletions of Personnel: When personnel are to be added or deleted, the entire EAL shall be reaccomplished and submitted to the Contracting Officer.
(5) Escorts: An asterisk (*) on the IEAL by key personnel such as a foreman or supervisor will allow temporary entry of supply deliveries / pickup / repair. The escorts must accompany these personnel the duration of time on the installation. A maximum of three (3) key personnel per contractor is allowed. A phone number where the escorts can be reached must be included on the IEAL.
(6) Two (2) days are required for processing of IEALs.
b. Air Force Form 75, Visitors Pass (AF 75): The AF 75 is required for all employees and vehicles, The AF 75 has two parts, one for placement on the driver's side of the dashboard (must be visible at all times), the other part is issued to the individual and must be on his/her person at all times. Each employee must obtain this pass by presenting his drivers license at the Visitor Control Center, located outside the main gate. If any of the above identification is not on the employee’s person, he/she will be escorted from the base. It is recommended that a magnetic sign be placed on the left door of the vehicles that do not have a company logo. Periodic spot checks of driver’s licenses and AF 75's will be conducted on a random basis. It is the responsibility of each employee to turn the pass in the depository (on driver's side of the gate as you depart the base) after completion of the contract(s).
21.
FIELD MEASUREMENTS:
The Contractor shall verify all measurements at the site and shall be responsible for dimensions and proper installation of all materials.
22. MOBILE PHONE:
The contractor’s site representative (superintendent or foreman), throughout the execution of the delivery order, shall be accessible via a mobile phone. The number to the phone shall be local and provided to the Contracting Officer prior to the start of work.

SUMMARY
A. This section contains administrative and procedural requirements for environmental issues.
3.
DEFINITIONS
A. Operable units: Operable Units (OU) are defined as a discrete response action within a comprehensive environmental restoration program. OUs are areas that have been shown by conceptual models of contaminant sources, migrations, and receptors to require specific source control and/groundwater response actions. Maps showing the locations of the OUs on EAFB can be obtained from the most current Management Action Plan for EAFB which is available from the 28 CES/CEV office at 2103 Scott Drive, (605) 385-2680.

STORM WATER POLLUTION PREVENTION REQUIREMENTS
A.
Permits:
1.
If the construction activities include clearing, grading, stockpiling or excavation activities which result in the disturbance of the natural cover of the soil and the disturbed area is greater than one acre, the contractor shall comply with the current South Dakota Surface Water Discharge System Program permit. The contractor shall apply to South Dakota Department of Environment and Natural Resources (SD DENR) to be covered under this permit.
2.
If the project will involve dewatering which will reach the waters of the state the contractor shall apply to be covered under the SD DENR General Permit to Discharge Under the Surface Water Discharge System for Temporary Dewatering Activities in South Dakota.

C.
Procedures: A storm water pollution prevention plan shall be developed by the contractor and approved by the Contracting Officer when the construction activities include clearing, grading, stockpiling or excavation activities which result in the disturbance of the natural cover of the soil. This plan shall be completed and implemented prior to the time the project breaks ground and revised (if necessary) as construction proceeds. The EAFB Environmental Specification Handbook provides the procedures for developing and implementing a Storm Water Pollution Prevention Plan.
1.
Stabilization will be initiated on all disturbed areas where construction activity will not occur for a period of more than 21 calendar days. The stabilization work will begin by the 14th day after construction activity has permanently or temporarily ceased.
2.
Construction Related Excavation De-watering and Hydrostatic Tests. The contractor shall follow one of the following procedures for excavation de-watering and hydrostatic testing.
a.
The contractor can apply to be covered under the General Permit to Discharge under the National Pollutant Discharge Elimination System for Construction Activities under the current South Dakota permit (The EAFB Environmental Specifications Handbook contains this general permit). (If the permit is requested for an area in an operable unit the water quality data must be forwarded to the SD DENR along with the notice of intent) b.
The contractor can discharge the water to a level area at such a rate that it infiltrates and does not run off into a road ditch, storm drain or any drainage ditch. (This cannot be used for construction activities in operable units) c.
The water can be containerized and disposed of in the Sanitary Sewer System. (For construction activities in operable units the water must first be analyzed for the contaminates of concern for the specific operable unit and the results reviewed and disposal approved by 28 CES/CEVC at 385-2680 prior to discharge to the sanitary sewer system)
3.
Road and Parking Lot Surfacing: The contractor shall be responsible for any and all releases from the construction site during road surfacing work such as, but not limited to, asphalt placement, chip sealing and concrete work. The contractor shall pay close attention to the weather forecast to ensure the effects of rain are minimized. The contractor shall have the personnel, material, and equipment available to ensure there is no release off the site into the storm drainage areas. If a release does occur, the contractor will be responsible for the clean-up.

SPILL REPORTING

C.
Procedures: The contractor shall report any spill of oil or hazardous material in accordance with the EAFB Environmental Specifications Handbook. The contractor shall take every reasonable precaution to prevent the spillage of oil or other hazardous substances. Should a spill occur, the contractor shall be totally responsible for having the material and resources on hand for the containment and clean-up of the spilled material. The contractor shall perform all sampling to verify clean-up of the spill site and ensure proper disposal of the contaminated material, as required by the Contracting Officer or the South Dakota Department of Environment and Natural Resources (DENR). The contractor shall develop and have on site a Site Specific Spill Prevention, Control and Countermeasure Plan (SSSPCCP). (See the EAFB Environmental Specifications Handbook). The contractor shall provide a copy of the SSSPCCP to the Contracting Officer for review and approval prior to starting work.

Wastes determined to be RCRA hazardous wastes will be delivered to the Hazmart at Twining Street with a copy of the waste analysis in a Department of Transportation (DOT) approved container for proper handling and disposal.

8.

All materials removed under this contract, except that noted, shall be disposed of off base in such a manner that meets federal, state and local environmental codes. (NO SOIL CAN BE REMOVED OFF SITE WITHOUT FIRST CONTACTING 28 CES/CEVR, THE ENVIRONMENTAL RESTORATION ELEMENT, 385-2680).
9.
INDUSTRIAL WASTE MANAGEMENT PROGRAM
A.
The contractor shall fill out and submit for approval a Waste Inventory Sheet prior to discharging any waste stream down an industrial or sanitary sewer drain. An example of the Waste Inventory Sheet can be found in section 6: of Ellsworth Air Force Base Environmental Specification Handbook.
10.
CULTURAL RESOURCE PRESERVATION
A. ARCHEOLOGICAL PRESERVATION: Should the Contractor uncover human remains or other skeletons, Native American artifacts or other archaeological resources during the course of excavation, the work shall be stopped and the Base Historic Preservation Officer in the 28CES/CEV office at 2103 Scott Drive, (605) 385-2680 and the Contracting Officer shall be notified immediately.
B. HISTORIC BUILDING PRESERVATION: If construction activities include excavation or construction which affect any identified historic building or structure, the contractor shall consult with the Base Historic Preservation Officer. A list of identified historic buildings is maintained and available through the 28 CES/CEV office at 2103 Scott Drive, (605) 385-2680.
11.
NATURAL RESOURCE PRESERVATION AND PROTECTION
A.
WETLANDS: If construction activities include excavation or construction in jurisdictionally delineated wetlands, the contractor shall consult with the base Natural Resource Manager in the 28 CES/CEV office at 2103 Scott Drive, (605) 385-2680. A map of delineated wetlands is maintained and available through the 28 CES/CEV office at 2103 Scott Drive, (605) 385-2680.
B.
WILDLIFE HABITAT: Construction activities including excavation or construction which has real or potential impacts to animal burrows, nests, feeding sites or other potential wildlife habitat shall be reported to the base Natural Resource Manager.
C. LAND MANAGEMENT: Construction activities shall consider nonpoint source pollution control measures, provide for erosion control, water management, runoff disposal, landscaping and special soil problems.
12.
BACKFLOW PREVENTION REQUIREMENTS
A. The contractor shall install appropriate backflow prevention devices when connecting to the bases water system whether temporary or permanent (this includes connections to fire hydrants).
13.
ENVIRONMENTAL AWARENESS AND RESPONSIBILITY CHECKLIST
A.
If any of the environmental hazards listed on the form are encountered, the contractor shall call the telephone number shown on the form and then immediately notify the contracting officer of the situation.
B.
The Environmental Awareness and Responsibility checklist is located in Section 6 of the Ellsworth Air Force Base Environmental Specifications handbook. The Ellsworth Air Force Base Environmental Specifications Handbook can be obtained at any time from the Contracting Officer.
14.
EXCAVATION ENVIRONMENTAL RESPONSE PROCEDURES
A. Purpose – Beginning when EAFB was activated in 1942, burial or dumping was an industry accepted practice often used to dispose of materials no longer needed or wanted. Accidental spills also occurred periodically. Since the mid 1980’s, EAFB environmental programs have been identifying, investigating, and remediation as necessary, waste disposal and spill sites. Unless specifically noted otherwise in the contract documents, there are no known waste disposal or spill sites that affect the specified work. However, during any grading or excavation there is the potential to uncover previously unknown waste or spilled material.
B. Unusual Material - Unusual material as used in this section shall mean any materials other than soils, rock or bedrock encountered during excavation that is not specifically identified as part of the work in the contract document. This includes but is not limited to: stained soils; free product fuels, oils, etc; suspicious odors; bottles, cans, drums, or other containers; wooden, metal, or cardboard boxes; rags, gloves, or personal protective equipment; trash or common landfill debris; concrete, concrete block, wood, metal, or other building materials and construction debris; or any other unidentified materials.
C. Response - If the contractor encounters any unusual materials during any excavation or grading, the contractors shall:
1.
Immediately stop the excavation or grading operation.
2.
Shut down the equipment and leave it in its present location.
3.
Do not attempt to determine the contents of any bottles, containers, boxes, etc.
4.
Withdraw personnel from the equipment and the excavation a distance of at least 50 feet upwind or cross wind or as directed.
5.
Contact the escort, inspector, contracting officer or the contracting officer’s designated representative immediately, or call 911.
6.
Remain in the area until released by the CO or designated representative.
D Every contractor and subcontractor employee shall be briefed on the response procedures in this section prior to beginning work on EAFB. Training shall be documented by the employee signing and dating a training log sheet. Log sheet shall be maintained on the immediate jobsite in the contractor’s project office and shall be available for inspection by the contracting officer or designated representative. Response procedures review shall be included in the contractor’s periodic safety meetings.
15.
EXECUTION
A. Contractor shall comply with all provisions of Section 01800 as well as all applicable federal, state, and local laws. Contractor shall comply with all applicable Air Force regulations. Federal, state and local laws and Air Force regulations pertaining to each environmental program are outlined in Section 8 (EAFB Environmental Engineering Guidelines) of the EAFB Environmental Specification Handbook.
