Section 00100 - Bidding Schedule/Instructions to Bidders
EVALUATION FACTORS
SECTION M-001. EVALUATION FACTORS FOR AWARD
1. BASIS FOR CONTRACT AWARD
A. The Government intends to award this solicitation on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.
B. Maximum objectivity throughout the proposal process will always remain the
Contracting Officer and Evaluation Teams’ ultimate goal; however, the selection process by nature will be subjective to arrive at a best value decision.
2. PROCEDURES
A. An evaluation team will be established to review proposals and any subsequent information provided for price evaluation and technical acceptability against solicitation requirements.
B. A price evaluator will first rank, in order, all proposals from lowest to highest according to price. Since the goal is to find the lowest priced technically acceptable offer, and because all evaluation factors other than cost or pricing when combined are approximately equal, this ranking serves as the baseline for selecting a proposal.
C. Once all proposals are placed in price rank order, they will be evaluated to ensure that all items required to be submitted (IAW SOW, RFP and contract terms and conditions) with the proposals are included in the proposal package. If all items are included the evaluation continues. The lowest priced offer will then be the first and only offer evaluated for technical acceptability.
D. A price evaluator will complete an assessment of the price information by evaluating price for reasonableness using price analysis, cost realism, and affordability.
E. This evaluation will determine the acceptability of the technical narrative, and make sure that it meets all the objectives outlined in the solicitation package, specifically the statement of work.
F. The evaluation team will determine if the lowest priced offer is technically acceptable or not. If the offer proposed does meet all requirements, is constructed correctly according to the RFP and attachments, and is deemed to have a price that is fair and reasonable, the offer will be chosen for award. If the lowest priced offer does not meet all of these requirements, it will be removed from competition. The same evaluation process will then take place to determine the acceptability of the second lowest priced offer. This process will continue until an offer received has met all the specified requirements.
G. The CO shall ensure that proposals are evaluated based solely on criteria contained in the solicitation.
H. The Contracting Officer will review the evaluation and findings of the evaluators to ensure their accuracy, consistency, and supportability and make an award decision consistent with the basis for award described in paragraph 1.
3. PRICE
A. Reasonableness – Techniques and procedures described under FAR 15.404-1(b), and as supplemented, will be the primary means of assessing proposal reasonableness.
B. Unrealistically low proposed prices (initially or subsequently) may be grounds for eliminating a proposal from competition either on the basis that the offeror doesn’t understand the requirement or has made an unrealistic proposal.
C. Affordability – The affordability assessment will consider the total estimated contract price as compared to the projected budget for this program.
4. TECHNICAL
A. If an offeror’s proposal fails to meet a government requirement, this is a deficiency in the offeror’s proposal resulting in a rating of “Fail” and the offeror will no longer be considered for award. Offerors are advised, any strengths that are accepted by the
Government may be incorporated into the contract as the minimum performance requirement.
Scoring
Guidelines Definition
PASS
Meets the required performance outcomes and capabilities and has no significant weakness
FAIL
Fails to meet the required performance outcomes and capabilities
a) In addition to the below, the following technical items will be evaluated as a part of the contractors proposal to receive a “PASS” or “FAIL” rating.
1. Renovation: Does the offeror’s past project history demonstrate that they have completed at least five (5) projects of similar size and scope?
2. Trane Tracer Digital Controls: Did offeror provide historical data on the successful installation of Trane Tracer Digital controls on projects of comparable size and scope?
3. Occupied Facilities: Did offeror provide historical data on successfully completing similar construction work in an occupied facility?
4. Commissioning: Did offeror provide historical data on having successfully completed HVAC commissioning in accordance with Unified Facilities Guide Specification (UFGS) on projects of comparable size and scope?
5. Second Shift: Has the contractor acknowledged in his proposal that the work on this project will be performed after normal facility operating hours (0700-1700)?
5. SOLICITATION REQUIREMENTS, TERMS, AND CONDITIONS
Offerors are required to meet all solicitation requirements, terms and conditions, and technical requirements to be eligible for award.
INSTRUCTIONS TO OFFERORS
SECTION L-001. INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two (2) separate parts; Part I - Price Proposal, Part II - Technical Proposal.
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit cost data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
C. Specific Instructions:
1. PART I - PRICE PROPOSAL - Submit original and one (1) copy.
(a) Complete blocks 14, 15, 17, 19 and 20 of the RFP Section A, SF 1442. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K.
These sections constitute the model contract.
(b) Insert proposed unit and extended prices in Section B for each Contract Line Item. The extended amount must equal the whole dollar unit price multiplied by the number of units.
(c ) Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in.
2. PART II – TECHNICAL PROPOSAL – Submit original plus (1) copy.
(a) The Offeror shall provide sufficient detail to substantiate the validity of all stated assertions.
To facilitate evaluation, the information contained in Part II should be specific, detailed, and clearly demonstrate that the Offeror has a thorough understanding of the requirement for the accomplishment of this effort. The Technical Proposal shall be a stand-alone document containing all information necessary for the Government to perform a complete technical evaluation. If it is determined that the information provided was not sufficient, offer will not be considered for award without affording the offeror an opportunity to satisfy the requirement of the Government. Offeror should ensure that their technical proposal meets all the objectives outlined in the solicitation package, specifically the statement of work.
D. Documents submitted in response to this RFP must be fully responsive to and consistent with the following:
1. Requirements of the RFP (Contract Line Items (CLINs) & Specifications, and government standards and regulations pertaining to the Specifications.
2. Evaluation Factors for Award in Section M of this RFP.

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (APR 2010)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-
(i) The Offeror and/or any of its Principals-
(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and
(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.; and
(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent
Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $427.18 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The
Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the
Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in
SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
The Contractor represents that it ( ) is, ( ) is not a small business concern under NAICS Code 238220- assigned to contract number FA4497-15-R-0004.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting

The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to
Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
