About this file
This document is Exhibit N of RFP No. HHS0016867 issued by the Health and Human Services Commission (HHSC) and details the Key Performance Measures (KPMs) and associated liquidated damages for an Enrollment Broker contract. The KPMs establish performance standards, measurement periods, application criteria, and liquidated damages designed to monitor the contractor's delivery of enrollment broker services as defined in the Scope of Work (Exhibit J). The contract encompasses multiple service areas including security incident notification and response, audit cooperation, payment processing accuracy, system availability maintenance, transition completion, enrollment processing timeliness, call center operations, health care provider outreach, correspondence management, and database operations. Performance standards vary by service area, with measurement periods ranging from per occurrence to monthly to daily assessments after the operational start date.
Liquidated damages are structured on a tiered basis, with amounts varying by performance level and application criteria. For example, security incident notification failures incur $2,500 per incident per calendar day, while enrollment packet delivery failures range from $2,500 per percentage point for 98-99.9% accuracy to $25,000 per percentage point for less than 95% accuracy. Call center abandonment rate penalties escalate from $500 per percentage point above 10% to $2,500 per percentage point above 15%, and system outage reporting delays incur $250 per minute beyond the 15-minute notification requirement. The document specifies that liquidated damages are additive and may be assessed without prior notice, though HHSC may consider the quality of corrective actions when determining assessment. Deliverables with due dates falling on weekends or holidays are due the following business day, and partial deviations from percentage-based standards trigger corresponding damages.

RFP No. HHS0016867 Exhibit N
Exhibit N, Key Performance Measures (KPM)
RFP No. HHS0016867
HHSC will monitor the Contractor's performance and all Contract requirements, which are subject to HHSC's performance evaluation.
For any obligation with a Key Performance Measure (KPM), the KPM will gauge the Contractor’s commitment to performance, willingness to stand behind its Services during the Contract Term, and confidence in its ability to perform.
Each KPM below identifies the KPMs used to evaluate the Contractor’s delivery of the required Services. HHSC will manage the Contractor’s Services by monitoring and measuring performance of the SOW (Exhibit J, Enrollment Broker Scope of Work). KPMs are defined with performance standards, measurement periods, application criteria, and Liquidated Damages. These performance requirements and associated Liquidated Damages are intended as reasonable estimates of damages resulting from the Contractor’s non-performance, including delays.
HHSC may assess Liquidated Damages as set forth below. Liquidated Damages will not be assessed if HHSC determines that the Contractor is not responsible for the delay or failure of the applicable KPM. In determining whether to assess Liquidated Damages, HHSC may consider the quality of the root cause corrective action and how promptly the Contractor remediates the impacts of the KPM failure.
The Contractor agrees that (1) the Liquidated Damages and any amounts assessed in connection therewith are neither a penalty nor a forfeiture, and (2) the amount of Liquidated Damages is a reasonable forecast of just compensation. HHSC is not required to provide the Contractor with notice and opportunity to resolve issues prior to HHSC’s assessment of Liquidated Damages. All Liquidated Damages specified below are additive (e.g., if call center metrics indicate that abandoned calls exceed the KPM quality standard, then Liquidated Damages may be assessed).
For purposes of these KPMs, when a Liquidated Damage refers to a percentage point, or portion thereof, the "portion thereof" means that a full percentage point deviation is not required to assess the Liquidated Damage. For example, if the standard is 99% and the results achieved are 98.6%, the Liquidated Damage that may be assessed is based on 1%. If the results achieved are 97.9%, the liquidated damage that may be assessed is based on two (2) percentage points. This concept extends to other measurements (e.g., minutes). If a Liquidated Damage is measured by Calendar Day or Business Day, the Liquidated Damage may be calculated for each intervening day from the assessment to cure regardless of when the next frequency is for the Deliverable or performance standard (e.g. a report that is due every Monday is subject to Liquidated Damages for Tuesday, Wednesday, etc. and not measured against the following Monday only).
For any KPM that has a Deliverable with a due date that falls on a weekend or holiday, such Deliverable will be submitted on the Business Day immediately following the weekend or holiday.
