About this file

This is a Lobbying Certification exhibit from the Texas Department of Agriculture for use with Federal contracts, grants, and cooperative agreements. The certification, dated March 7, 2024, serves as a mandatory disclosure document required under Section 1352 of Title 31, U.S. Code. The document establishes that no Federal appropriated funds have been or will be paid to influence members of Congress, congressional employees, or agency officials in connection with the awarding of Federal contracts, grants, loans, or cooperative agreements, including extensions, continuations, renewals, amendments, or modifications of such agreements.

The certification requires that any non-Federal funds used for lobbying purposes must be disclosed via Standard Form-LLL in accordance with its instructions. All sub-recipients at all tiers, including sub-contractors and sub-grantees, must incorporate this certification language into their award documents and certify and disclose accordingly. The document must be signed by an authorized signatory and countersigned by the Chief Financial Officer or designee. Failure to file the required certification subjects the responsible party to civil penalties ranging from $10,000 to $100,000 for each failure. This certification constitutes a material representation of fact upon which the government relies when entering into the transaction.
