About this file

This is a Certificate of Compliance exhibit required by the Los Angeles County Metropolitan Transportation Authority (LACMTA) for bidders and proposers to demonstrate compliance with 49 CFR Part 655 regulations governing the prevention of alcohol misuse and prohibited drug use in transit operations. The document requires bidders to certify whether the work performed under the contract will involve Safety Sensitive Functions as defined in federal transit regulations. If Safety Sensitive Functions are not required, bidders may proceed directly to signature authorization. If Safety Sensitive Functions are required, bidders must establish or commit to establishing both an anti-drug use and alcohol misuse program and a drug and alcohol testing program that meet 49 CFR Part 655 requirements prior to contract award.

Bidders selecting the Safety Sensitive Functions requirement must submit their Anti-drug Use and Alcohol Misuse Program and Drug and Alcohol Testing Program to LACMTA for review and approval before contract award. The certificate requires certification by an authorized representative with signature, title, and date. Bidders have the option to indicate either that they have already established compliant programs or that they will establish such programs prior to contract award, ensuring federal compliance standards are met for all safety-sensitive transit operations.
