About this file
This is an Amendment One Question and Answer document related to a Forensic Laboratory Reference Standards procurement by the Kansas Bureau of Investigation Forensic Science Laboratory. The procurement seeks competitive proposals from qualified vendors to supply analytical reference standards, reference materials, and certified reference materials for forensic laboratory operations across multiple locations in Kansas. The scope encompasses controlled substances (Schedules I-V), non-controlled substances, and related compounds including methamphetamine, cocaine, fentanyl, and tetrahydrocannabinol, supplied as neat or in-solution materials in quantities ranging from milligrams to multiple grams with lot-specific Certificates of Analysis. Deliveries must occur within 30 days of order receipt to one of four KBI Forensic Science Laboratory locations: Topeka, Great Bend, Kansas City, or Pittsburg. Questions regarding the procurement were due by close of business September 30, 2026, and proposals are due October 20, 2026 at 2:00 p.m. CDT. The contract term runs from award through December 31, 2029, with no guaranteed minimum purchase volumes.
Pricing is structured as a fixed percentage discount applied to the vendor's suggested retail price, remaining constant throughout the contract term, with shipping and handling charges allowable. Payment terms are Net 30 days via electronic funds transfer unless a hardship exception is approved. ISO 17034 accreditation is required for Reference Materials and Certified Reference Materials; Analytical Reference Standards carry no accreditation requirement. Vendors must maintain required accreditations throughout the contract term and provide lot-specific Certificates of Analysis with shipments or make them available online. All bidders must submit a current Tax Clearance Certificate from the Kansas Department of Revenue, Certification Regarding Immigration Reform and Control form, Boycott of Israel form, Sexual Harassment form, and signed acceptance of State of Kansas terms and conditions. Bidders may claim applicable preferences under the Kansas Bidder Preference Program, including Disabled Veteran Owned Business, State Use Purchases, or Certified Business categories with supporting documentation. Multiple vendors may be awarded, and product samples are not required for bid evaluation.

Question
Answer
1.
Bidder experience and customer references
Sections 2.5–
2.7
I have worked with Garcia Family Medicine since
2009 and currently serve as Practice Manager. May a newly established prime contractor rely on this owner experience together with a named manufacturer or distributor partner’s comparable supply experience to satisfy the minimum five years of continuous industry participation? May the partner’s three customers serve as the required references, or must both the experience and references belong to the bidding legal entity?
Please identify supporting documentation required from each entity.
The bidder must have five (5) years of experience supplying reference standards, reference materials, and/or certified reference materials. If you have this experience, please provide references demonstrating your capabilities. Details of supporting documentation are defined in sections 2.5 and 2.7.
2.
Reseller eligibility, accreditati on and direct shipment
Sections 3.23 and 4.2–4.3
Are authorized resellers eligible to bid? For Reference
Materials and Certified Reference Materials, may the supplying manufacturer’s ISO 17034 certificate and product-specific accreditation scope satisfy section
4.2, or must the bidding entity itself hold that accreditation? May a manufacturer or qualified distributor ship directly to KBI, with the prime managing quotations, orders and invoicing? Please identify any required manufacturer authorization or partner agreement.
Authorized resellers are eligible to bid if they remain the primary contractor and point of contact for materials purchased. The manufacturer of the materials must meet the requirements of 4.2.
3.
Limited product-category or subclass offers
Sections 4.1–
4.3 and 5
Section 4.3 permits bids on any or all product categories. May a vendor offer only the non-controlled
Analytical Reference Standards subclass and mark all remaining categories and controlled-substance subclasses No Bid? Please confirm the minimum catalog breadth, how to complete unbid cost-sheet fields, and how limited offers will be evaluated. Please also confirm that section 4.2 imposes no accreditation requirement for Analytical Reference Standards, and identify any other required credentials or product documentation for that limited scope.
Vendors may bid on only one category and leave the other categories blank. Section 4.2 references Analytical Reference
Standards do not have an accreditation requirement.

4.
Controlled-substance responsibili ties
Sections 4.1 and 4.5
If a vendor offers controlled-substance products, what registrations, licenses, ordering documentation and shipping responsibilities must be held or fulfilled by the prime versus its supplying or direct-shipping partner? Please address a prime that never takes physical possession. Please also identify whether any such event-specific requirements would apply to an offer limited entirely to non-controlled Analytical
Reference Standards.
Specific requirements for licensing, manufacture, and distribution of controlled substances fall under the purview of the DEA and individual states. Please refer to state and federal controlled substance licensing statutes and regulations.
Non-controlled reference standards do not fall under DEA or state licensing requirements.
5.
Existing suppliers, purchase history and order allocation
Cover:
Replaces
Contract
NEW; section
Although the cover identifies this as a new contract, who currently supplies these products to KBI?
Please provide any predecessor contract or purchasing-arrangement identifiers and available public records of prior suppliers, prices or discounts, annual spending and quantities by product category, typical order values and anticipated demand by laboratory. Is an estimated annual budget available?
With multiple awards possible and no guaranteed purchases, how will orders be allocated among approved vendors?
This is a new contract.
Multiple purchases are made to multiple vendors. No suppliers, discounts, annual spending, quantities, categories and order values are available
It is anticipated the KBI will spend >$25,000 annually on these materials.
Choice of vendor will be determined by product, product quality, cost, analytical laboratory requirements, and accreditation requirements.
6.
Pricing updates and shipping charges
Sections 3.37, 4.4–4.5 and 5
Please reconcile section 3.37’s firm, net-delivered pricing with section 4.4’s adjustable suggested retail prices and section 4.5’s permitted shipping/handling charges. How often may retail prices or price lists change, given the cost sheet’s annual-update language, and what notice or approval is required? May quotations separately identify shipping, handling, expedited service and any applicable special-shipping charges? Please confirm whether discounts may differ by the six cost-sheet category/subclass rows and whether any minimum order amount or small-order charge may be proposed.
3.37- “… unless otherwise stated on the cost sheet.”
An updated price list may be given to the Office of Procurement and Contracts annually, but the percentage off will not change throughout the life of the contract.
Please see section five (5) cost sheet
Reference 4.4 regarding pricing.
Reference 4.5 regarding shipping.
This bid event does not address minimum orders or small-order charges.
