About this file

This is an Execution of Offer document for the Texas Department of Transportation (TxDOT) related to Solicitation No. 601330000046762 for a Radar Vehicle Detection System. The document serves as the binding certification and signature page that must accompany all responses to this solicitation. Respondents are required to certify that all submitted statements and information are current, complete, and accurate, and must confirm compliance with anti-trust laws, procurement regulations, and conflict-of-interest requirements. The document includes provisions addressing Executive Order 13224 compliance, federal debarment and suspension verification through the System for Award Management (SAM.gov), and restrictions on participation by individuals convicted or penalized in connection with federal disaster relief contracts following Hurricane Rita, Hurricane Katrina, or other disasters after September 24, 2005.

The Execution of Offer requires respondents to declare their company information, provide authorization for invoicing and payment if different from the responding entity, and designate a point of contact. Respondents may claim preferences under Rule 34TAC 20.306, including tie-breaking considerations for Texas-based supplies, agricultural products, USA-manufactured equipment, items from economically depressed areas, and service-disabled veteran-owned businesses. Additional preferences are available for products from persons with disabilities, environmentally sensitive or recycled materials, energy-efficient products, and other specialized items. The document explicitly states that failure to return the completed Execution of Offer will render the response non-responsive, and it includes provisions allowing the state auditor to conduct audits or investigations of vendors and subcontractors receiving funds under the resulting contract.

Under Section 2155.006(b) of the Texas Government Code, a state agency may not accept a bid or award a contract, including a contract for which purchasing authority is delegated to a state agency, that includes proposed financial participation by a person who, during the five-year period preceding the date of the bid or award, has been: (1) convicted of violating a federal law in connection with a contract awarded by the federal government for relief, recovery, or reconstruction efforts as a result of Hurricane Rita, as defined by Section 39.459, Utilities Code, Hurricane Katrina, or any other disaster occurring after September 24, 2005; or (2) assessed a penalty in a federal civil or administrative enforcement action in connection with a contract awarded by the federal government for relief, recovery, or reconstruction efforts as a result of Hurricane Rita, as defined by Section 39.459, Utilities Code, Hurricane Katrina, or any other disaster occurring after September 24, 2005.

Pursuant to Section 2262.154 of the Texas Government Code, the state auditor may conduct an audit or investigation of the vendor or any other entity or person receiving funds from the state directly under this contract or indirectly through a subcontract under this contract. The acceptance of funds by the Respondent or any other entity or person directly under this contract or indirectly through a subcontract under this contract acts as acceptance of the authority of the state auditor, under the direction of the legislative audit committee, to conduct an audit or investigation in connection with those funds. Under the direction of the legislative audit committee, the Respondent or other entity that is the subject of an audit or investigation by the state auditor must provide the state auditor with access to any information the state auditor considers relevant to the investigation or audit.
