SPECIAL
REQUIREMENTS
and
L.2.14.b not numbered
(4) Restrictions: The prime contractor is precluded from participating as a contractor, subcontractor or consultant on future non-A&AS contracts where the J9 Directorate is the requiring and/or funding activity.
With the trusted agent approach, the prime contractor is precluded from participating as a contractor, subcontractor or consultant on future non- A&AS contracts where the J9 Directorate is the requiring and/or funding activity
Is this restriction applicable only to future non-A&AS contracts where the J9 is the requiring activity or does it also apply to current non- A&AS contracts where the J9 is the requiring activity? Will the prime contractor(s) for the current and future J9 A&AS contracts be precluded from participating on current non-A&AS J9 contracts?
Section L.2.14.d, bullets 4 and 5 have been amended to read:
Processes and procedures for identifying OCIs (this includes processes for notification and review of potential bids by any business unit within the proposed team to identify potential OCI issues)
Processes and procedures for identification and mitigation of OCIs or perceived OCIs for current contracts in which J9 is the requiring and/or funding activity (i.e., contracts awarded prior to the RFP response date)

– 500 FTEs.
In my opinion, you will receive several compliant and compelling proposals.
3 Section H.1 and 252.209-9000
The OCI clauses in the draft RFP allow subcontractors to compete for and conduct non- A&AS work in divisions of DTRA J9 where their personnel are not performing A&AS functions.
Given DTRA’s desire to its A&AS contractor team to function as trusted agents and the uncertain range and breadth of future non-A&AS efforts is there a possibility that a perceived OCI at the sub-contractor level could exist now or in the future? What mitigation efforts would DTRA consider acceptable in such cases?
Yes, there is the possibility of an OCI or perceived OCI at the sub-contractor level if that sub-contractor is a performer on a non-A&AS contract for which J9 is the requiring and/or funding activity. The offeror is required to include an OCI mitigation plan that includes processes and procedures in accordance with Section L.2.14.d that must be included in Volume 1 of the proposal.
4 Att. L-2; L.1.2.d N/A DRFP L.1.2.d states that "Present and Past Performance Questionnaires (Attachment L-
2) shall be e-mailed in PDF to the team e-mail address shown in Paragraph L.1.1.1, J9_AAS_Mailbox@dtra.mil."
Att L-2 PPQ has different email address
Question: Att L-2 states that respondents should "submit the completed questionnaire to anne.behne@dtra.mil." However, DRFP L.1.2.d states that completed forms "shall be e-mailed in PDF to the team e-mail address shown in Paragraph L.1.1.1, J9_AAS_Mailbox@dtra.mil." Will the government please clarify which address is to be used and update the RFP accordingly?
Att. L-2; L.1.2.d amended to be consistent with L.1.1.1.
Note that DTRA’s email system has migrated from @dtra.mil to @mail.mil, and L.1.1.1 is amended to dtra.belvoir.J9.mbx.j9-aas-inbox@mail.mil mailto:dtra.belvoir.J9.mbx.j9-aas-inbox@mail.mil
5 Att.
Question: If the individual completing Attachment L-2 on behalf of an offeror has questions, should they be directed via email to J9_AAS_Mailbox@dtra.mil, per DRFP L.1.1.1, or anne.behne@dtra.mil, per Att. L-2 #6?
See response to above question. Questions should be directed to dtra.belvoir.J9.mbx.j9-aas-inbox@mail.mil
6 Section H.1 OCI 29 Subcontractors on the DTRA J9 A&AS contract are prohibited from performing Source Selection Support for J9 CWMD IDIQ (Performer) Task Order Proprietary Proposals per the J9 CWMD IDIQ RFP template. As a result, this limits full A&AS team support to DTRA J9's efforts. Recommend the OCI limitation be extended to the subcontract level to ensure complete avoidance of A&AS from non-A&AS.
Question: Ref Clauses OCI H.1. It is our understanding that only prime contract A&AS employees are permitted to perform J9 CWMD IDIQ (non-A&AS) source selection support for task order proprietary proposals per the J9 CWMD IDIQ Task Order RFP template, which is the result of authorizing A&AS subcontractors to participate on
Section H.1.(4) Restrictions:
has been amended to read:
H.1 RE: 252.209-9000
ORGANIZATIONAL
CONFLICTS OF INTEREST (FEB
2011) The following is added to paragraph b. Scope, of 252.209-9000:
(4) Restrictions: The prime contractor is precluded from participating as a contractor, subcontractor or consultant on future non-A&AS contracts where the J9 Directorate is the requiring and/or funding activity. This restriction will terminate one year after final payment on the contract. Restrictions upon use of Government information and the requirement to protect proprietary information are the CWMD IDIQ. To enable full support of both A&AS prime and A&AS subcontractors in the J9 CWMD IDIQ source selection process, wouldn't full OCI avoidance vice mitigation be appropriate for A&AS subcontractors?
permanent. Subcontractors providing A&AS support to a J9 Department / staff office, e.g. J9BA, J9CB, J9CX, J9IS, J9NT, J9ST, J9FO etc., will be ineligible to compete for work in the same directorate / staff office, but may be allowed to compete for performer work in departments where it provides no A&AS support, provided that it does not create an OCI.
Subcontractors on the DTRA J9 A&AS contract who are currently or who may become members of a CWMD IDIQ team are prohibited from providing any form of evaluation or source selection support for CWMD IDIQ Task Orders regardless of the J9 Department from which the requirement originates.
Should the J9 A&AS Prime Contractor wish to utilize subcontractors who are not restricted by the aforementioned IDIQ teaming prohibition the A&AS Prime contractor shall notify and receive the approval of the DTRA KO prior to utilizing any subcontractors in support of CWMD IDIQ evaluation and source selection support.
Prior notification and approval is necessary so that the DTRA RFP to the IDIQ contractors can provide the appropriate notifications. For the purpose of this requirement, Systems Engineering and Integration (SE&I) services performed in support of the J9 Directorate are considered to be non- A&AS services. The DTRA SE&I support service is defined as the contractor’s capability to integrate diverse and emerging technologies to meet customer needs with a verified product via a systems engineering process.
