2013 SHIP DISPOSAL SOLICITATION

DTMA-91-Q-2013-0014

April 29, 2015

QUESTIONS AND ANSWERS

Amendment 0010 to the Solicitation has been issued on FedBizOps simultaneous with these Questions and Answers. A redline version showing the substantive changes made in Amendment 0010 has also been provided to facilitate review.

Question 1: The Service Contract Act (SCA) Wage Determination 2005-2519, Revision 17 which applies to Brownsville, TX. and Wage Determination 2005-2233, Revision 18 which applies to the Louisiana facilities do not have occupation category, codes, titles, or in the SCA Directory of Occupations descriptions, which appear to correspond with occupations in ship recycling. For example, there are welders but no ship cutting or ground cutting codes, titles, or rates. What occupation codes, titles, rates, and benefits we should be using in our bid models to ensure an acquisition bid would be responsive?

Answer 1: If an offeror believes a conformance is needed under the Service Contract Act because the wage determination does not list a classification it feels is necessary to perform the work required under the contract, then the contractor should follow the process at http://www.wdol.gov/sca_confrmnce.aspx to obtain a conformance after award. See FAR 22.1019 and 52.222-41(c) and Title 29 CFR Part 4.6(b)(2)).

This process was followed under the prior solicitation and the resulting conformance was provided to offerors via Amendment 0002 to DTMA1Q09001, a copy of which is attached hereto as Exhibit 1.

Question 2: The Wage Determinations do say that Executive Order 13658 establishes an hourly minimum wage of $10.10 for 2015 that applies to all contracts subject to the Service Contract Act for which the solicitation is issued on or after January 1, 2015. However, there is no identified benefit package for occupation codes not listed. The Wage Determinations also state:

If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.10 (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract. This infers that the Wage Determinations apply only to occupation codes listed.

Answer 2: If a service contract awarded under DTMA-91-Q-2013-0013 is over $2,500, that contract is subject to the FAR 52.222-41, Service Contract Labor Standards (May 2014) and the new FAR clause 52.222-55 -- Minimum Wages Under Executive Order 13658 (Dec 2014) which mandates an hourly minimum wage of $10.10 for 2015. The Minimum Wage is applicable to any service employee engaged in performing work on, or in connection with this contract, regardless of whether that classification is listed in the wage determination. The term “service employee” is defined FAR 52.222-41. Both http://www.wdol.gov/sca_confrmnce.aspx

52.222-41 and 52.222-55 apply to any service employee, regardless of whether they work for the contractor or a subcontractor and regardless of the contractual relationship alleged to exist between the worker and the contractor or its subcontractors. The term “worker” is defined in FAR 52.222-55. Both clauses are required to be flowed-down to all subcontractors. Under FAR 52.222-55, the contractor and its subcontractors are required to pay the E.O. minimum wage rate whenever it is higher than the wage rate specified in the Wage Determination or collective bargaining agreement, if applicable.
