Inspection Requirements for NPDES Compliance

EPA Construction General Permit Part 4 inspection requirements for NPDES compliance:

Inspection Frequency: You must conduct inspections in accordance with one of the two schedules listed below.

You must specify in your SWPPP which schedule you will be following.

1. At least once every 7 calendar days, OR

2. At least once every 14 calendar days and within 24 hours of the end of a storm event of 0.5 inches or greater. (If this option is chosen, a rain gauge is required to be on-site: The SWPPP should also include a daily rainfall log.)

Case-by-Case Reductions in Inspection Frequency: You may reduce your inspection frequency to at least once every month if: · · l . The entire site is temporarily stabilized,

2. Runoff is unlikely due to winter _conditions (e.g., site is covered with snow, ice, or the ground is frozen), or

3. Construction is occurring during seasonal arid periods in arid areas and semi-arid areas.

Inspection Waiver for Frozen Conditions: A waiver of the inspection requirements is av~ilable until one month before thawing conditions are expected to result in a discharge if all of the following requirements are met:

· 1. The project is located in an area where frozen conditions are anticipated to continue for extended periods of time (i.e., more than one month);

2. Land disturbance activities have been suspended; and

3. The beginning and ending dates of the waiver period are documented in the SWPPP.

Qualified Personnel: Inspections must be .conducted by qualified personnel (provided by the operator or cooperatively by multiple operators). ''Qualified personnel" means a person knowledgeable in the principles and practice of erosion and sediment controls who possesses the skills to assess conditions at the construction site that could impact stormwater quality and to assess the effectiveness of any sediment and erosion control measures · selected to control the quality of stormwater discharges from the construction activity. ·

Scope of Inspections: Inspections must include all areas of the site disturbed by construction activity and areas used for storage of m~terials that are exposed to precipitation. Inspectors must look for evidence of, or the potential for, pollutants entering the stormwater conveyance system. Sedimentation and erosion control measures must be observed to ensure proper operation. Discharge .locations must be inspected to .aseertain whether erosion control measures are effective in preventing significant impacts to waters of the United States, where accessible. Where discharge locations are inaccessible, nearby downstream locations must be inspected to the extent that such inspections .are practicable. Locations where vehicles enter or exit the site must be inspected for evidence of off-site sediment tracking.

All reports required by this permit, including the SWPPP, S.WPPP amendments, and inspection reports must be signed by a person described in Appendix G, Subsection 11.A (below) or by a duly authorized representative of that person.

1. For a corporation: By a responsible corporate officer. For the purpose of this Part, a responsible corporate officer means: (i) a president, secretary, treasurer, or vice-president of the corporation in charge .of a principal business function, or any other person who performs similar policy- or decision-making functions for the corporation, or (ii) the manager of one or more manufacturing, production, or operating facilities, provided, the manager is authorized to make management decisions which govern the operation of the regulated facility including having the explicit or implicit duty of making major capital investment recommendations, and initiating and directing other comprehensive measures to assure long term environmental compliance with enVironmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.

2. For a partnership or sole proprietorship: By a general partner or the proprietor, respectiv(fly; or

· 3. For a municipality, state, federal, or other public agency: By either a principal executivtr officer or ranking elected official. For purposes of this Part, a principal executive officer of a federal agency includes (i) the chief executive officer of the agency, or (ii) a senior executive officer having responsibility for the overall operations of a principal geographic unit of the agency (e.g., Regional Administrator of EPA). ·

A person is a duly authorized representative only if:

The authorization is made in writing by a person described in Appendix G, Subsection 11.A;

The authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity such as the position of plant manager, operator of a well or a well field, superintendent, positfon of equivalent responsibility, or an individual or position having overall responsibility for environmental matters for the company. (A duly authorized representative may thus be either a named individual or any individual occupying a named position); and ·

The signed and dated written authorization is included in the SWPPP. A copy must be submitted to EPA, if requested. · ft1[)DtALBIGBWAY .ADMOOS1:JlA110N WUTJQtM~BAL L.ANDS
