(f) Offerors cannot use LCAAP as a place of performance and/or obtain components or cartridges from LCAAP. However, any proposed use of

3 118

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

an Armament Retooling Manufacturing Support (ARMS) tenant at LCAAP requires the appropriate ARMS approvals to have been granted by the

Government, consistent with the purposes of ARMS and this RFP.

(g) As outlined in Sections L and M of this RFP, a best value subjective tradeoff approach will be used to evaluate proposals submitted in response to this RFP. The Government reserves the right to make award to other than the lowest priced Offeror for non-price factors.

The Government anticipates receiving adequate price competition under this RFP; therefore, certified cost or pricing data is not required to be submitted with proposals. However, in the event the Procuring Contracting Officer (PCO) determines that adequate competition does not exist, the Government reserves the right to require that certified cost or pricing data be submitted.

(h) The Government intends to award without discussions; therefore, each proposal should contain the Offeror's best terms for award of a contract under this RFP. The PCO may contact Offerors for clarifications, as described in FAR 15.306(a) and Section L, FAR 52.215-1, Instructions to Offerors - Competitive, without opening discussions. However, the Government reserves the right to conduct discussions and to permit Offerors to revise their proposals if determined necessary by the PCO.

(i) Offerors shall propose pricing using the Price Matrix (Section J, RFP Attachment 0005) as outlined in Section L of this RFP. Prices entered anywhere other than this price matrix will not be considered.

(j) The unit prices in the Price Matrix (Section J, RFP Attachment 0005) will be the prices used for the Base Quantity Award and any exercise of option for increased quantity. The unit prices for the Base Quantity Award will be taken from the specially designated boxes for DODICs AB57 (quantity of 10,000,000 each) and AB86 (quantity of 12,000,000 each). The unit prices for subsequent awards will be taken from the corresponding Option Year Pricing Period in which the option for increased quantity is exercised. Reference Section

I, Clause 52.217-6, Option for Increased Quantity, for information regarding multiple options exercised within the same Option Year

Pricing Period. The Government is not required to exercise any of the evaluated options for increased quantity.

(k) Offerors are to submit prices on a Free On Board (FOB) Origin basis. The Government is only responsible for the costs associated with the shipment of the deliverable end item. The contractor is responsible for all other shipping.

(l) Deliveries will be in accordance with the schedules set forth in Section F Narrative F0002, Required Delivery Schedule.

(m) To obtain the Technical Data Packages (TDPs) for this RFP, Offerors must request explicit access through the "Attachments/Links" tab in the beta.sam.gov website under W52P1J-20-R-0046. Request access to the document titled "TDP Request W52P1J-20-R-0046". When prompted for "Reason for Request", Offerors shall enter the following: "I am requesting access to the .zip file for the TDPs under RFP

W52P1J-20-R-0046. My CAGE Code is XXXXX". Successful completion of this will prompt a Government point of contact to send the TDP to the requesting data custodian via the DoD SAFE website.

Offerors must have an approved DD Form 2345, Military Critical Technical Data Agreement, on file with the Joint Certification Program

(JCP) in order to be granted access to the TDP. Restricted technical data will not be available to an Offeror who has not been certified. NOTE: The TDP requestor must be the data custodian in the JCP database or the TDP request will be denied. To verify who your data custodian is, please log into https://www.dla.mil/HQ/LogisticsOperations/Services/JCP/www.dlis.dla.mil/jcp/ and use the CAGE Code search function.

Detailed instructions of the TDP process and use of the beta.sam.gov website can be found in Section J, RFP Attachment 0014, "Contractor

Vendor Guide-Contract Opportunities-beta.sam.gov".

(n) Program Reviews and teleconferences are a requirement of this contract. See Section C Narrative C0003, Program Reviews and

Teleconferences, for details.

(o) All contractual provisions specified are obligatory for the prime contractor. The prime contractor is responsible for enforcing contractual provisions upon any subcontractors/suppliers/vendors.

(p) These items are considered to be sensitive ammunition/explosives that require a Pre-Award Survey, which at a minimum shall address safety and security considerations, to be completed at the applicable place(s) of performance.

(q) Note for Other Than Small Businesses ONLY. Separate from Small Business Participation, Other Than Small Business Offerors shall also submit a Small Business Subcontracting Plan as required by FAR 19.7 (FAR Clause 52.219-9, Small Business Subcontracting Plan). The

Small Business Subcontracting Plan will be reviewed when the apparent awardee is determined. In accordance with Army Federal

Acquisition Regulation Supplement Appendix DD, the Small Business Subcontracting Plan must correlate with the percentages of small business utilization identified in the Offeror's Small Business Participation Plan in order to be eligible for award. For Offerors utilizing a Commercial Subcontracting Plan, the Offeror shall also provide an explanation showing how the percentages of small business utilization identified in the Offeror's Small Business Participation Plan correlate to the goals in its Commercial Subcontracting Plan in order to be eligible for award.

The Government has established the following goals for this procurement based on total contract value (including options):

Small Business (SB) - 13%

RFP. Please ensure page 1, block 12 is completed with 210 days.

(s) Offerors must have an active registration in the System for Award Management (SAM) in order to be considered for award. Offerors are required to be registered in SAM at the time of proposal submission. The website for SAM registration is www.sam.gov .

(t) Pursuant to FAR 9.103, a contract will only be awarded to a contractor that the PCO determines to be responsible. Offerors must be able to demonstrate that they meet the standards of responsibility set forth in FAR 9.104.

(u) The successful Offeror's proposal in response to this RFP may be incorporated in whole or part as a material term of the resultant contract and failure to fully implement it may result in termination. No revisions or changes to the Offeror's proposal may be made after award without prior approval from the PCO. The contract requirements take precedence over the incorporated proposal should a conflict exist.

(v) In the event a configuration change should materialize in the future, it will be negotiated in accordance with the Changes clause

(FAR 52.243-1, Changes-Fixed Price).

(w) Receipt of an Offeror's proposal in response to this RFP is an affirmation that the Offeror has had access to and received adequate information to prepare a proposal.

(x) The cognizant ACC-RI PCO is the only individual authorized to issue awards, modifications, and changes under the resultant contract.

(y) This RFP should not be discussed with any Government employee except the PCO, Ms. Jennifer Paul, or her representative, Mr. Mark

Stevens. Ms. Jennifer Paul can be contacted at (309)782-6737 or by email at jennifer.n.paul.civ@mail.mil. OPERATIONS SECURITY (OPSEC) REQUIREMENTS________________________________________

(a) As defined in Army Regulation (AR) 5300-1, Operations Security (OPSEC), sensitive information is information requiring special protection from disclosure that could cause compromise or threat to our national security, an Army organization, activity, family member, Department of the Army civilian, or Department of Defense contractor. Critical Information is defined as information important to the successful achievement of United States (U.S.) objectives and missions, or which may be of use to an adversary of the U.S. It consists of specific facts about friendly capabilities, activities, limitations (includes vulnerabilities), and intentions needed by adversaries for them to plan and act effectively so as to degrade friendly mission accomplishment. All critical information is sensitive, but not all sensitive information is critical.

(b) The contractor shall not release sensitive information to the general public without prior written approval from the Procuring

Contracting Officer (PCO).
