About this file
This is a Domestic Workforce Utilization Certification form (BOP-1301) issued by the Commonwealth of Pennsylvania for the Safety Service Patrol contract in York County. The certification requires bidders to commit to performing direct labor exclusively within the United States or within countries that are parties to the World Trade Organization Government Procurement Agreement, or to specify the percentage of direct labor that will be performed in eligible locations. Bidders must identify any direct labor that will be performed outside the United States and outside WTO Government Procurement Agreement countries, along with the specific countries where such work will occur. The certification is mandatory for bidder eligibility and consideration under this criterion, and completion and signature are contractual obligations upon execution. Misstatements in the certification are treated as fraudulent concealment punishable under Section 4904 of the Pennsylvania Crimes Code.
The Safety Service Patrol contract requires bidders to provide two Safety Patrol Vehicles with backup vehicles and qualified operators for expeditious removal of disabled and accident vehicles and small non-hazardous debris from specified roadways in York County, including Interstate 83 and US Route 30. The contract specifies patrol hours of 6:00 AM to 9:00 PM and 2:00 PM to 6:30 PM Monday through Friday, with weekend and special event coverage as needed. Bidders must have a minimum of six years of towing business experience, commit to performing 100 percent of towing services domestically, and provide trained operators with Pennsylvania Class C Driver's licenses and clean driving records. Compensation is structured as an hourly rate per vehicle during actual patrol operations, with a minimum rate of $23.00 per hour, and the contractor is responsible for all vehicle acquisition, maintenance, fuel, equipment, uniforms, and cellular service. The contract includes renewal options for up to three additional one-year terms with annual rate increases of up to 3.00 percent, contingent on 90 days' written notice. The procurement is restricted to certified small businesses under the Small Business Procurement Initiative, is subject to Disadvantaged Business Enterprise requirements, and requires bid security of 15 percent of total contract cost and performance security of 15 percent due within ten days of contract execution. Contractors must maintain comprehensive general liability insurance with minimum coverage of $250,000 per person and $1,000,000 per occurrence, and must comply with Pennsylvania's enhanced minimum wage provision of $15.00 per hour with annual cost-of-living adjustments.

Revised 02/23/2018
DOMESTIC WORKFORCE UTILIZATION CERTIFICATION
To the extent permitted by the laws and treaties of the United States, each proposal will be scored for its commitment to use the domestic workforce in the fulfillment of the contract. Maximum consideration will be given to those offerors who will perform the contracted direct labor exclusively within the geographical boundaries of the United States or within the geographical boundaries of a country that is a party to the World Trade Organization Government Procurement Agreement. Those who propose to perform a portion of the direct labor outside of the United States and not within the geographical boundaries of a party to the World Trade Organization Government Procurement Agreement will receive a correspondingly smaller score for this criterion. In order to be eligible for any consideration for this criterion, offerors must complete and sign the following certification. This certification will be included as a contractual obligation when the contract is executed.
