JUSTIFICATION FOR USE OF NONCOMPETITIVE PROCEDURES

Identification Number (purchase request/solicitation number): D-14-OA-0058

1. A description of the agency's needs and estimated value.

The Drug Enforcement Administration (DEA) Aviation Division (OA) has a requirement to upgrade its government-owned aircraft fleet which has 40 plus year old avionics systems with a new modern state of the art Garmin Avionics Systems in the Western Region. This document is a brand name justification for the brand names identified in Item #6.

The estimated cost to upgrade the existing aircraft is $_________.

2. An identification of the statutory exception from the requirement to use competitive procedures and a demonstration, based on the proposed contractor’s qualifications or the nature of the procurement, of the reasons for using that exception.

FAR 6.302-5(a) (2): Full and open competition need not be provided for when—

(i) A statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source; or

(ii) The agency’s need is for a brand name commercial item for authorized resale.

3. A determination that the anticipated cost will be fair and reasonable.

This procurement will be conducted as a competitive small business set-aside. Based on the market research conducted, it is anticipated that adequate competition will occur. Price reasonableness will be based on competition pursuant to FAR 13.106-1(a) (1).

4. A description of the market survey conducted or a statement of the reasons a market survey was not conducted.

For the past several years, OA personnel have conducted market research to find a suitable modern avionics system that meets the minimum performance requirements needed to upgrade OA aircraft.

OA has conducted market research which consists of talking to industry representatives, attending trade shows such as the Helicopter Association International and the Aircraft Electronics Association. No other modern avionics system has been found anywhere in the industry that meets the minimum requirements or demonstrates consistent reliability.

5. A listing of any sources that expressed in writing an interest in the procurement.

A sources sought notice was posted on the Federal Business Opportunities (FBO) website on April 22, 2014 with a due date for responses of May 2, 2014. No responses to the sources sought challenged the brand name requirement. In all, ten (10) vendors expressed interest in the Western Region.

6. A statement of any actions the agency may take to remove or overcome a barrier to competition before a subsequent procurement for those needs.

OA presently operates ___ aircraft, ___ of which are equipped with Garmin Avionics Systems. It is the goal of OA to retrofit the remaining Bell helicopters and Cessna aircraft with Garmin Avionics Systems. For the past several years OA has been on a campaign to standardize its fleet of aircraft with modern, state of the art avionics systems which provide more reliability and expanded capability over the _______ avionics systems currently installed. With a fleet of aircraft that has been standardized with the same avionics systems, this reduces training and maintenance cost and eliminates the need to stock multiple brands and types of avionics components.

Garmin Avionics systems were the logical choice, as it is standard equipment on all new Bell helicopters and new Cessna aircraft. Garmin Avionics Systems have proven reliable and cost effective when replacement parts and components are required. OA's aviation services prime contractor holds a Garmin Fleet Service Account which allows parts, components and software to be purchased at dealer cost thereby saving OA considerable cost upgrading and maintaining its Garmin Avionics equipped aircraft fleet.

Included in the Garmin Avionics system is associated equipment that is part of the complete aircraft avionics package. OA’s goal is to standardize its fleet of aircraft with modern, state of the art avionics systems which provide more reliability and expanded capability. The following associated equipment has been utilized in OA aircraft and proven to be reliable and cost effective.

• Honeywell/ Bendix-King KN-63, Distance Measuring Equipment (DME). This DME is standard equipment utilized on all OA aircraft. This is a very reliable DME; all OA pilots are trained to use this equipment. OA has an inventory of spares and support technicians are trained to maintain these DMEs. Additionally, Honeywell/Bendix-King is the only company manufacturing general aviation DMEs.

• L3 Avionics WX-500 Storm Scope. This Storm Scope is standard equipment utilized on all OA aircraft. This is a very reliable Storm Scope; all OA pilots are trained to use this equipment. OA has an inventory of spares and support technicians are trained to maintain these Storm Scopes. The L-3 Avionics WX-500 Storm Scope is the only Storm Scope on the market that will integrate with the Garmin Avionics system.

• Anodyne Electronics Manufacturing (AEM) AMS44 Dual Channel Audio System. OA aircraft are equipped with numerous aircraft and mission communications systems. OA realized with the installation of the Garmin Avionics system that a more robust and modern audio system was required. The AMS44 was selected because it is specifically designed for special mission applications. The AMS44 has dual radio controls to independently select individual radios. The dual channel configuration provides independent radio control for pilot and co-pilot within the space of a single audio system controller plus intercom support for the flight crew and up to five passengers.

Each pilot can choose the communications set-up specific to their role in the mission. No other audio controller on the market has this capability and is as cost effective. The AEM AMS44 was selected to standardize the audio systems in OA’s aircraft fleet. With a standardized audio system, OA flight crews can easily transition from one model aircraft to another and quickly adapt, therefore saving time and increasing safety.

• L3 Avionics Trilogy ESI-2000 Electronic Standby Instrumentation. For the new Garmin Avionics system, a modern and reliable electronic standby instrumentation system is required. The L3

Avionics Trilogy ESI-2000 Electronic Standby Instrumentation has been installed in 22 OA aircraft that recently received Garmin Avionics systems upgrades. The L3 Avionics Trilogy ESI-2000 Electronic Standby Instrumentation has proven to be reliable and cost effective and an excellent choice for fleet standardization. The L3 Avionics Trilogy ESI-2000 was selected to standardize the electronic standby instrumentation in OA’s aircraft fleet. With a standardized electronic standby instrumentation, OA flight crews can easily transition from one model aircraft to another and quickly adapt, therefore saving time and increasing safety. No other electronic standby instrumentation that possesses the same functions as the L3 Avionics Trilogy ESI-2000 and is fully FAA certified is available on the market.

• Electronics International MVP-50P Glass Panel Engine Monitor System. For the new Garmin Avionics system, a modern and reliable Glass Panel Engine Monitor System was required. The Electronics International MVP-50P Glass Panel Engine Monitor System was installed in 6 OA Cessna 206 aircraft that recently received Garmin Avionics systems. The Electronics International MVP-50P Glass Panel Engine Monitor System has proven to be reliable, cost effective with the required functions for fleet standardization. The following functions and characteristics are required and are not available on other Engine Monitoring Systems on the market:

-Create and upload aircraft checklist -Create and upload flight plans -Display various aircraft functions such as baggage door open, position and landing lights on, pitot heat on, etc.

-Aircraft weight and balance calculations

• The S-TEC System 55X Two-Axis Flight Control System is the only autopilot certified for the Garmin G500 Avionics System install in Cessna 206 aircraft and therefore is required.
