About this file
This is a Certification of Noninvolvement in Prohibited Activities form required by the State of New Jersey for vendors seeking to enter into or renew contracts with state agencies. Pursuant to N.J.S.A. 52:32-60.1 et seq. (L. 2022, c. 3), all vendors must complete this certification to indicate whether they are identified on the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list due to activity related to Russia and/or Belarus. Vendors must select one of three certification options: (A) certifying that they are not identified on the OFAC list due to Russia/Belarus-related activity; (B) indicating inability to certify due to being identified on the list for Russia/Belarus activity; or (C) certifying that while identified on the OFAC list, their Russia/Belarus-related activity is consistent with federal law, regulation, license, or exemption, with detailed documentation provided. The form requires completion of vendor identification information including name, Federal Employer Identification Number (FEIN), address, phone number, fax number, email address, and signature of an authorized representative with printed name and title.
The Department of the Treasury has authority to enforce compliance with this certification requirement and may impose sanctions, seek compliance, recover damages, declare the party in default, or pursue debarment or suspension of any vendor making a false certification. The definition of "Vendor" under this regulation is broad and encompasses natural persons, corporations, partnerships, limited liability entities, governmental entities, instrumentalities, and multilateral development institutions, as well as any parent, successor, subunit, subsidiary, or entity under common ownership or control with such entities. Vendors must review the OFAC Specially Designated Nationals and Blocked Persons list available at https://sanctionssearch.ofac.treas.gov/ prior to certification completion.
