Westlaw provides access to an extensive and exclusive collection of appellate briefs and petitions libraries at both the federal and state levels. As of August 2018, Westlaw contains more than 3.5 million separate, fully searchable briefs, and the number of briefs is growing monthly. Many of the briefs libraries, such as U.S.
Supreme Court Petitions for Certiorari, are added to Westlaw shortly after being filed with the court.
Briefs are fully integrated into Westlaw, with features such as full text searching, linking, Profiler, KeyCite, and more. Each brief includes a summary of the facts of the case, issues and arguments, the pertinent laws and case law, and an argument of how the law applies to the facts.
Briefs are linked to related documents, which helps users retrieve additional helpful information, such as the following:
Additional briefs submitted in the case.
The court’s opinion.
The full text of cited cases and statutes.
Profiler information that provides background on participating attorneys and judges.
The immediate availability of briefs and petitions on Westlaw saves researchers time and the inconvenience of a trip to the courthouse or a call to the court clerk. Briefs are easily retrieved by issue, party name, or attorney, and cited authority connects directly to the source.
PLEADINGS, MOTIONS, AND MEMORANDA
Pleadings, Motions, and Memoranda on Westlaw provide access to actual court filings from select state trial courts, U.S. district courts and federal bankruptcy courts from across the United States. These documents help researchers to:
Find new ideas and approaches.
Develop winning pleading and motion strategies and arguments.
Save time drafting.
Gain a competitive edge by identifying actions the opposition might take.
Better understand appellate opinions by reviewing underlying facts.
From one source, researchers get easy access to court-filed pleadings, motions, memoranda, and other trial filings. TRIAL COURT ORDERS
Westlaw provides access to trial court orders from national and select state trial courts. A trial court order provides researchers with insight in to judicial preferences, proclivities, and patterns. Users can read pertinent court orders and identify what worked in similar cases, what law was cited, and how the judge reacted—how judges ruled in similar motions, as well as their reasoning behind the decision. Access to these orders allows researchers to make better informed evaluations about whether to accept a case, how to handle it, and what to tell the client to expect if litigation does go forward.
National Court Orders—Includes judges’ rulings and the reasoning behind their decision for national court orders. Obtaining court orders saves the researcher valuable time by delivering the legal foundation for the decision; the cases, statutes, and regulations cited; and other documents filed—including pleadings, motions, and briefs. Examples include criminal orders and judgments of conviction.
State Trial Court Orders—Includes the full text of judges' orders in select state courts, which gives insight into judicial preferences, proclivities, and patterns. Read pertinent court orders and know what worked in similar cases, what law was cited, and how the judge reacted in similar cases.
