About this file

This is a pre-proposal conference presentation prepared by the Pennsylvania Department of Transportation (PennDOT) regarding the Diverse Business (DB) Program and Good Faith Effort Requirements for a Digital Video Network procurement. The presentation outlines PennDOT's requirements for vendor participation in state-funded transportation projects, specifically detailing the mandatory inclusion of diverse businesses in contract execution. The program applies to 100% state-funded projects within construction and professional services categories, including design, legal services, advertising, public relations, consulting, and information technology services. Vendors are required to solicit diverse business firms, provide adequate bidding information and time for response, and negotiate in good faith with certified diverse businesses before contract award.

The Diverse Business Program recognizes five categories of diverse businesses: disadvantaged businesses, minority-owned businesses, women-owned businesses, service-disabled veteran-owned businesses, and veteran-owned small businesses. All participating firms must be certified by third-party certifying organizations including the National Minority Supplier Development Council, Women's Business Enterprise National Council, U.S. Small Business Administration (8A program), the Veterans Small Business Certification program, or the Pennsylvania Unified Certification Program. The successful offeror must submit the EO-386 form and complete the EO-387 Successful Offeror's Intent to Subcontract Statement form within seven calendar days of notification. Monthly reporting via the EO-402DB form is required by the fifth day of each month, documenting all payments made to diverse business subcontractors. Good faith effort documentation and DB participation requirements are mandatory throughout the contract term, with failure to comply constituting a potential breach of contract.
