FAR 52.212-2 Evaluation- Commercial Products and Commercial Services (DEVIATION Jan 2026)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

The Government intends to award a single firm fixed price purchase order (PO) from this solicitation utilizing simplified acquisitions procedures in accordance with RFO Part 12. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotes.

Basis for Award, Trade-off/Best Value:

The Government intends to award one or more Basic Ordering Agreements (BOAs) resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value to the Government, price and non-price factors considered. All evaluation factors other than cost or price, when combined, non-price factors are more important than cost/price. Offers will be evaluated based on the submission’s demonstration to fulfill future requirements. An Offeror is not required to meet all the requirements provided in the Mock Task Order to be considered for a Basic Ordering Agreement. The offer must demonstrate the ability of the Offeror’s to meet the machining requirements they are capable of producing. Offers will be assessed on their technical capabilities, established pricing methodologies, and willing to accept the terms and conditions proposed for future delivery orders.

Evaluation Factors The evaluation factors listed below will be used to evaluate offers. An award offer will be made to offerors proposing the combination which is most advantageous to the Government based upon an integrated assessment of the evaluation factors described below. The determination to award a Basic Ordering Agreement will be based on the Offeror’s initial submission. The Offeror’s initial response should contain a full response with the vendor’s most competitive offer in terms of both price and non-price factors. The government intends to issue one or more BOAs without holding clarifications.

Factor 1 – Technical Capability Subfactor 1: Production Capability – Ability to plan, control, and integrate the Offeror’s facility, manpower, and equipment to successfully complete some but not all of the requirements for future delivery orders.

Subfactor 2: Quality Assurance & Safety Systems – Demonstration that the Offeror has adequate quality control systems, inspection processes, and safety protocols required to successfully complete some, but not all of the requirements anticipated for future delivery orders.

Subfactor 3: Facility Suitability Review – Review of the Offeror’s equipment, floor space, and supply organization to ensure the facility is suitable to deliver some but not all of the requirements for future delivery orders.

Factor 2 – Experience Factor 3 – Price

Factor 1, Technical Capability Technical capability is defined as the vendor’s demonstration of the understanding of the capability to provide the required item(s) identified in the Statement of Work. This includes the authority to provide the required item(s), capability and method to successfully meet all contract requirements, including delivery schedule, warranty, and all other requirements. The submitted documents must clearly and unambiguously confirm delivery of the proposed line items or propose an alternate delivery schedule for the mock order. The documentation shall clearly describe, in sufficient detail, the Offeror’s ability to meet some of the requirements. Merely repeating the requirements without demonstrating the ability to meet them will result in the Government determining the technical offer is not technically acceptable and the offer will not be given further consideration. The submission may include a narrative, charts, graphs, tables, drawings, products/service literature, hyperlinks, and other forms of documentation as determined by the offeror. Any Quote that requires the Government to exercise judgement with respect to technical capability will render the Quote nonresponsive and ineligible for award offer.

Subfactor 1: Production Capability – Ability to plan, control, and integrate the Offeror’s facility, manpower, and equipment to successfully complete the delivery order Subfactor 2: Quality Assurance & Safety Systems – Demonstration that the Offeror has adequate quality control systems, inspection processes, and safety protocols required to successfully complete the delivery order.

Subfactor 3: Facility Suitability Review – Review of the Offeror’s equipment, floor space, and supply organization to ensure the facility is suitable to deliver the requirements anticipated under the BOA

Factor 2, Experience The contractor shall submit (3) projects, completed within the last five (5) years, that best demonstrate the company’s experience performing relevant projects in terms of size, scope, complexity, and duration. Each project shall be submitted using the “Relevant Experience Project Data Sheet” located in the SAM.GOV website under this solicitation. For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevance to the project requirements of this solicitation. The attachment titled “Relevant Experience Project Data Sheet” is mandatory and shall be used to submit project information. Individual blocks on this form may be expanded.

Factor 3, Past Performance The Government will evaluate the Offeror's past performance information and, if appropriate, its proposed subcontractors past performance to determine its relevance to the current requirement and the extent to which it (a) demonstrates that the offeror has successfully completed relevant contracts in the past three (3) years. In assessing the offeror's past performance information, NIST will evaluate, as appropriate, (b) successful performance of contract requirements, quality and timeliness of delivery of goods and services, (c) communications between contracting parties, (d) proactive management and customer satisfaction.

Factor 4, Price (Mock Delivery Order Deliverables) The price offer will be evaluated to ensure it is fair and reasonable, pursuant to RFO 12.204(a). Price will be evaluated for consistency with the technical offer, current marketplace price average, and Independent Government Cost Estimate. A price offer that is found to be either unreasonably high or low in relation to the performance requirements may be indicative of an inherent lack of understanding of the requirements and may result in the overall quotation being considered unacceptable. The Government will analyze quotations to determine whether unbalanced pricing exists for any line item. The Government will evaluate the offered price for completeness and reasonableness. An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government. A firm fixed price offer must be provided for each line item for the Mock Delivery Order in the solicitation.
