Per FAR Subpart 4.1102, offerors are required to be registered in System for Award Management (SAM) at the time an offer is submitted. Failure to do so will result in the offer being deemed ineligible for award.

Instructions to Offerors:

1. Offers must, at a minimum, contain the information required by the clause at Federal Acquisition Regulation (FAR) 52.212-1(b), Submission of Offers -

(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers must show –

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Price and any discount terms;

(6) “Remit to” address, if different than mailing address;

(7) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212- 3(b) for those representations and certifications that the offeror shall complete electronically);

(8) Acknowledgment of Solicitation Amendments;

(9) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(10) Include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

2. The offeror must also include in its quotation the following:

(a) Technical Quote –

1. Technical Factor - Offeror must provide a STAFFING PLAN that describes in detail its ability and approach to staffing the minimum requirements for each sport identified in Attachment 1, Statement of Work. Additionally, the offeror’s Staffing Plan must detail its contingency plan for providing substitute referees. An incomplete Staffing Plan may result in the offer being deemed ineligible for award.

(b) Price Quote –

1. Each offeror shall submit a price quote separate from the technical quote. Offeror shall quote fixed unit pricing for all Line Items in Attachment 5, Price List. The offeror must also complete and submit Attachment 6, Pricing Evaluation Spreadsheet and return it with the price quote.

Unit pricing input into Attachment 6, Pricing Evaluation Spreadsheet must match the unit pricing input into Attachment 5, Price List. Inconsistencies with unit pricing may result in the offer being deemed ineligible for award.

2. Prices must be both reasonable and balanced. Note that unrealistically low or high proposed prices may be grounds for eliminating a quotation from competition either on the basis that the offeror does not understand the requirement or has submitted an unrealistic quotation.

Additionally, unbalanced pricing poses an unacceptable risk to the Government and may be a reason to reject an offeror’s quotation. Quotations should be sufficiently detailed to demonstrate their reasonableness and balance. The burden of proof for credibility of proposed prices rests with the offeror.

52.212-2 Evaluation-Commercial Items. (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Factor - The Government will assess the offeror’s Staffing Plan to ensure it sufficiently details its ability and approach to successfully staff the minimum requirements found in Attachment 1, Statement of Work. The Government will assess the offeror’s contingency plan and its ability to provide substitute sports officials/personnel as needed.

(a) Technical quote must be rated as technically acceptable in order to be eligible for award. The following adjectival ratings will be assigned:

Adjectival Rating Description

Acceptable

Quote meets requirements and indicates an adequate or more than adequate approach and understanding of the requirements.

Unacceptable

Quote does not meet requirements of the solicitation and contains one or more deficiencies; quote is un-awardable.

2. Price:

(a) The Government will utilize the procedures at FAR 13.106-3 to determine price fair and reasonableness. Offerors whose pricing is determined to be unreasonable or unbalanced may not be considered for award. Unbalanced or unreasonable pricing exists when despite an acceptable total evaluated price, the price of one or more line items is significantly over or understated as indicated by the application of cost or price analysis techniques.

(b) Each offeror’s Total Evaluated Price will be evaluated utilizing Attachment 6, Pricing Evaluation Spreadsheet.

3. Award will be made to the offeror who is rated technically acceptable, demonstrates realistic and balanced pricing, has the lowest total evaluated price, and is deemed responsible in accordance with FAR Part 9.
