Standard Note 9

Standard Note 9 - It is the policy of FDOT to encourage the participation of small businesses and disadvantaged business enterprises ("DBE") in all facets of the business activities of FDOT, consistent with applicable laws and regulations. FDOT has established an aspiration goal of 10.54% DBE usage and an additional 3% non-DBE Small Business usage for the subject Project. Firms proposing for this Project shall aspire to have 10.54% or more of the total contract costs performed by DBEs, and an additional three percent (3%) or more of the total contract costs performed by non-DBE small businesses. Although not a contract requirement, FDOT believes that the aforementioned aspiration goal can realistically be achieved based on current availability of DBEs and small businesses. FDOT further believes that the 13.54% overall goal can be achieved through race neutral means, using standard competitive procurement processes. Pursuant to the provisions of Section 339.0805, Florida Statutes, and Rule 14.78.005, Florida Administrative Code, FDOT has adopted rules to provide certified DBEs opportunities to participate in the business activities of FDOT as vendors, contractors, subcontractors, and consultants. FDOT has adopted the DBE definition set forth in Code 49 of Federal Regulations Section 26.5. The Department's DBE directory may be found at the following website: Equal Opportunity Office Business Directory. Jacobs, led by Joseph “Joe” Martin, PE, has assembled a team of dedicated, available, and highly qualified professionals to deliver the SR 5/US 1 at SR 838/Sunrise Blvd. (Gateway) project. With a thorough knowledge of District 4’s (D4) goals and objectives, we developed a strategic approach that leverages our experience, innovative solutions, and unwavering dedication to quality.

Approach/Understanding of Critical Issues The Gateway reconstruction project increases intersection capacity, accommodates multimodal travel demand, enhances pedestrian crossing safety by reducing crossing lengths, and provides enhanced pedestrian and bicycle features. The preferred alternative maintains the 3 EB left turn lanes (while lengthening the queue), adds a SB to EB turn lane (providing a triple turning movement), and adds a WB to NB turn lane (providing a dual turning movement). Beyond the reconstruction limits, the roadway will be milled and resurfaced, west to NE 17th Way, east to Middle River Dr., and north to NE 13th St. The predominant typical section consists of a 6-lane, Divided Urban Principal Arterial with raised medians, 10' to 11' travel lanes, shared outside lane, curb and gutter, and a minimum 5' sidewalk on both sides, and shared use paths in the reconstruction area. The posted speed for the Sunrise Blvd. corridor is 35 MPH with a context classification of C4-Urban General. The SB approach of SR 5 to the Gateway intersection has a 45 MPH posted speed. As the target speed within the Gateway improvement is 35 MPH, a transition speed reduction to 40 MPH should be considered on SB SR 5. Through the reconstruction limits, the proposed roadway alignment is shifted to the north to avoid impacts to the existing Gateway Theater. We’ll reconfigure the curve radii and superelevation to accommodate the additional lanes in the shift. Based on lessons learned from urban projects, superelevation through plateau intersections requires detailed grading and holding the back of walk elevations to minimize encroachments and reduce harmonization limits. We identified several substandard pedestrian ramps in the resurfacing areas during our field review (some will be replaced with the ongoing 3R project on SR 5), as well as substandard bridge railing leading end

PROCUREMENT

treatment in the EB direction with no protection of the water main, substandard slope end, and no water hazard shielding. As there is an existing driveway just west of the bridge, a variation may be justified for the end treatment to remain. Additional variations needed include sidewalk (5’ to remain), border width, lateral offset, and median width. To ensure mobility, we’ll coordinate with Broward County Transit (BCT) to accommodate transit routes on the corridor to confirm requested upgrades to their features are documented with MMOA and LFAs. Temporary Traffic Control Plan (TTCP):

Our Level II TTCP will promote safety, minimize disruptions, and be developed in close coordination with D4, the City of Ft Lauderdale, the community, stakeholders, and first responders. Our lane closure analysis and our TTCP scheme will limit lane closures to non-peak hours. We’ll work closely with the community to maintain pedestrian and bicycle continuity within our TTCP phases while ensuring transit routes are operational during construction. We’ll phase sidewalk closures to maintain accessibility to transit stops at all times using a combination of pedestrian detours and pedestrian LCDs.

Drainage & Permitting: The project will be exempt from permitting per F.A.C. 62-330.051 since this improvement is a safety and operational enhancement. Based on our field review during and after rain events, we documented one isolated ponding location that falls within the intersection reconstruction that will be resolved during design. Signing & Pavement Marking (S&PM): Our design will comply with the latest editions of the FDM, Standard Plans, MUTCD, and FHWA, and incorporate sharrows for bikes and high emphasis crosswalks for pedestrians. We’ll design overhead guide signs to reflect new lane assignments to provide guidance without creating visual clutter. We’ll apply lessons learned and use skip guidelines through the intersection, and directional arrows, with color route shields approaching the intersection to ensure drivers have proper guidance and enhanced safety. On the eastern resurfacing limits, we’ll coordinate the existing stamped asphalt early with the City to confirm proper LFA and MMOAs are executed if they will be replaced. Misc. Structures: We’ll evaluate and design new signal mast arms and existing overhead sign trusses per AASHTO LRFD LTS and the associated SDM with a design wind speed of 170 MPH. If the existing sign structures were designed for a 50% increase in panel area, and the proposed signage does not exceed the 50%, the trusses may remain. Signals: Two traffic signal mast arms will remain at NE 17th Way and NE 20th Ave.;

however, flexible backplates will be added where missing (NW 20th Ave.). The use of flexible backplates eliminates the need to evaluate the structure, providing cost savings to D4. We’ll evaluate all pedestrian facilities and upgrade substandard/non-ADA-compliant features such as push buttons and pedestrian signals at NW 20th Ave. The Gateway intersection signal reconstruction will accommodate travel demand and enhance safety. Our design uses MUTCD standards ensuring ADA compliance, especially in restricted R/W locations such as the SE corner of NW 20th Ave. As a value add, we’ll explore and coordinate the use of existing conduit with Broward County Traffic Engineering Division (BCTED). We’ll closely coordinate signal work, including verification of timings such as red and yellow intervals, with Charlie Zhu and Jean Laraque of

BCTED. We’ll also coordinate vehicle detection with BCTED to ensure proper detection is proposed, and confirm that existing cabinets have spare lead-in conduit to accommodate the pedestrian signal upgrades at all signalized intersections, applying lessons learned from SW 184th/Miramar (FM 441579-1). During our field review, we identified traffic monitoring site (860446) and will coordinate the replacement of loops impacted due to milling operations. Lighting: Existing lighting along the corridor mainly consists of HPS luminaires mounted predominantly on conventional FDOT light poles and concrete FPL utility poles. In conjunction with HPS-to-LED retrofits, we’ll incorporate intersection retrofits at the signalized intersections of NE 17th Way and NE 20th Ave. to meet current standards (FDM Table 231.2.1). Lighting will meet the new construction lighting criteria at the reconstructed Gateway intersection. We’ll compile and submit a Lighting Design Analysis Report, that will include manufacturer luminaire specification sheets, voltage drop calculations, and Photometric Plans. This will be coordinated with D4 Traffic Design (Omid Fallahinejad; Tonya Estwick) as well as the City of Fort Lauderdale Facilities Manager, Corey Callier. During the scoping phase, we’ll identify any necessary PPC and LFAs that may require funding coordination.

The existing lighting MOA between the City and D4 will be updated to match new luminaire placement. Modifications or new luminaires on FPL poles will require an MOA between the City and FPL. ITS:

There are several D4 and Broward County ITS devices within the project limits, including a CCTV camera pole with a BlueTooth Vehicle Detector and fiber optic communication infrastructure. BCT also has Opticom® preemption sensors on the mast arms at three signalized intersections. We’ll conduct detailed field investigations to assess the impacts of the improvements on the existing ITS infrastructure. We’ll coordinate with the D4 RTMC and BCTED to verify continued operation of existing ITS devices during construction and document with a Maintenance of Communication plan. Utilities: There are 14 UAO’s identified by design ticket within the corridor. We’ll effectively communicate with UAO’s, request SUE, and avoid adjustments. Utility work schedules will document UAO commitments for required adjustments with utility certification being completed prior to the biddability submittal.

Surveying/SUE/Mapping: Manuel G. Vera & Associates, Inc.

(MGV) will apply the work from their FM 441955-1 (PD&E Phase) project and enhance it by incorporating LiDAR with conventional surveying. They’ll provide SUE with Quality Level B designations for mapping and Quality Level A locates for conflict resolution as necessary. We’ll validate the previously identified R/W acquisition and provide R/W needs prior to the Initial Engineering submittal.

Based on our lessons learned on Atlantic Ave. (FM 229658-4), it is crucial to identify R/W needs and costs early for project success.

We’ll verify the identified R/W to be taken under the preliminary Maintenance Map meets criteria as parcels that fall under building overhangs will not be eligible. Geotechincal: We will use the information gathered during the PD&E Phase. The past work will be supplemented with D4 Geotechnical Office coordination and a slightly increased number of borings in the widening areas to reduce the risk of unsuitable material. Public Information (PI): Our Level

3 CAP will provide requisite project information to ensure transparency and bolster trust. Quest Corporation of America, Inc.

(QCA) will build on their knowledge gained from the PD&E Phase, addressing issues such as bicycle/pedestrian safety, signal pole damage and placement impacting walkways, driveway and median closures, and impacts to City landscaping. We’ll perform grassroots coordination with stakeholders, including hybrid public meetings, ensuring all parties are aware of the project scope and construction schedule. Landscaping: We’ll perform an inventory of the existing landscape along the project corridor. Roadway plans will incorporate coordinated tree disposition plans and landscape protection as needed. Design will include irrigation and sod only.

Proposed Key Personnel/Roles As PM, Joe Martin, PE will apply his 36 years of design and construction management experience to lead our team. As the single point-of-contact, Joe has four main goals: 1) proactively monitor project status and resolve issues; 2) deliver a high-quality product; 3) ensure on-time milestone delivery; and 4) maintain the project within design and construction budgets. Joe will develop a Project Work Plan (PWP) that will be available within 10 days of NTP. It will illustrate the project’s efficient, organized, and timely completion per the schedule, budget, and contract requirements and will detail the scope, define the work product, establish lines of communication, resource allocation, task sequencing, budget, schedule, and quality control procedures. The PWP is a “living document” updated regularly to make sure project issues are documented, monitored, and resolved promptly to eliminate impacts to the project delivery. Joe will run all team meetings and communicate with project discipline leads to confirm expectations are met. Monthly progress meetings will be held with Kris McKirdy, PE, to ensure proper coordination of the project scope, schedule, and budget. Our approach includes risk assessment, proactively addressing issues, and minimizing the involvement of D4’s PM.

Schedule discovery will be performed at NTP to verify all activities are in conformance with the scope and sequenced properly. Any schedule change recommendations will be coordinated through the PM with D4 scheduling staff. Our PSEE project schedule will be monitored and updated weekly to eliminate the potential for negative float on any activity. Our design budget will be monitored monthly using the Earned Value Method to make sure our invoices reflect our progress. We’ll monitor the construction budget using LRE updates through initial engineering and detailed engineer estimates based on quantities uploaded to Designer Interface starting at the constructability submittal. LREs and cost estimates will be updated at progress submittals, work program update cycles, or when the scope changes. Our project-specific QA/QC plan is an integral process that begins with contract execution, continues through design, and ends when construction is completed. We are responsible for the quality of all documents prepared by our team.

Our plan will follow FDOT procedures, use checklists, require constructability reviews, and incorporate lessons learned from our past design/construction experience.

Your Trusted Partner Jacobs has built a strong relationship with D4 based on transparency, accountability, and mutual respect, providing an environment of trust and cooperation. Joe is a skilled PM with expertise in D4 requirements, and our committed team has the requisite management, design, and construction experience to serve you in a proactive, collaborative, and innovative manner.

4. Contract Restrictions & Proposed Method of Compensation:

A standard consultant contract will be executed with the selected consultant for this project. The standard contract terms are provided as Attachment B. The following additional information is furnished to the consultant firm for consideration:

4.1 Professional Liability Insurance Requirement: $1,000,000.00. For purposes of contracting, only Professional Liability Insurance from a company or companies authorized to do business in the State of Florida is acceptable. The selected prime consultant shall submit proof of Professional Liability Insurance coverage in the minimum threshold amount designated above, prior to contracting. The policy/ies and coverage described herein may be subject to a deductible. Pay all deductibles as required by the policy. The Department shall be notified in writing within ten days of any cancellation, notice of cancellation, lapse, renewal, or proposed change to any policy or coverage described herein. The Department’s approval or failure to disapprove any policy/ies, coverage, or ACORD Certificates shall not relieve or excuse any obligation to procure and maintain the insurance required herein, nor serve as a waiver of any rights or defenses the Department may have. No policy/ies or coverage described herein may contain or be subject to a Retention or a Self-Insured Retention. A commitment letter from a financial institution is also not acceptable for purposes of contracting.

4.2 Computer Usage: The selected Consultant firm may desire to use the

Department's mainframe computer (not CADD) for project related tasks.

Requested computer services will be considered during the contract negotiations.

4.3 Subconsultant Services: Services assigned to subconsultants must be approved in advance by the Department. Subconsultants performing the standard types of work covered by Rule Chapter 14-75, F.A.C., must be technically prequalified with the Department or have an application for prequalification under review at the time that they are proposed.

Subconsultants with fees less than $500,000, and/or performing specialty services

(non-standard types of work), a self-certified overhead statement may be accepted. These overhead statements must be sent to Central Office for review and approval.

Private attorney services may not be utilized on Department contracts without advance approval from the Attorney General’s Office. The advance approval may only be requested by Agency General Counsel (FDOT), and not the consultant firm. Since approval cannot be assumed, consultant firms shall refrain from proposing legal firms as part of the professional services consultant team in their procurement response and proposal documents. As referenced in Section 287.059(3), F.S.:

“An agency requesting approval for the use of private attorney services shall first offer to contract with the Department of Legal Affairs for such attorney services at a cost pursuant to mutual agreement. The Attorney General shall decide on a case-by-case basis to accept or decline to provide such attorney services as staffing, expertise, or other legal or economic considerations warrant. If the Attorney General declines to provide the requested attorney services, the Attorney General’s written approval shall include a statement that the private attorney services requested cannot be provided by the office of the Attorney General or that such private attorney services are cost-effective in the opinion of the Attorney General. The Attorney General shall not consider political affiliation in making such decision. The office of the Attorney General shall respond to the request of an agency for prior written approval within 10 working days after receiving such request. The Attorney General may request additional information necessary for evaluation of a request. The Attorney General shall respond to the request within 10 working days after receipt of the requested information.”

When universities or colleges are needed to perform services, the Department’s Project Manager shall procure such services by means of either a University http://www.fdot.gov/procurement/pdf/Rule%2014-75.pdf

Master Agreement task work order, a governmental agency contract, or a competitive solicitation for contractual services, as appropriate (reference Section 287.057(21), F.S.). Universities proposed as subconsultants will not be added to the professional services contract.

4.4 DBE/Small Business Participation:

The Department encourages DBE and small business firms to compete for professional services projects, and also encourages all other firms to use DBE and small business consultants as subconsultants. However, use of DBE and small business subconsultants is not mandatory and no preference points will be given during the selection process for DBE and/or small business participation.

Consultants shall complete Form No. 375-030-83 to indicate commitments anticipated for the project.

Federal law requires states to maintain a database of all firms that are participating or attempting to participate in DOT-assisted contracts. To assist the Department in this endeavor, consultants should have already submitted their Bid Opportunity List through the Department’s Equal Opportunity Compliance System found at the following link (https://fdotwp1.dot.state.fl.us/EqualOpportunityCompliance/Account.aspx/LogIn?

ReturnUrl=%2fEqualOpportunityCompliance). If you have not yet completed your bid opportunity list through this online application, please do so at this time. Prime Consultants can obtain access to the new EOC system by filling out the Contractors and Consultants New Users Access Form. Please complete the form and submit it to EOOHelp@dot.state.fl.us.

Consultants please be reminded that if you are selected on this project, you need to enter your DBE commitments in the Equal Opportunity website after contract execution. Also, if you are awarded supplemental agreements as part of this project, the DBE commitments will also need to be reported.

4.5 Method of Compensation:

The Department anticipates a lump sum with limiting amounts will be established for this contract. A Total Maximum Limiting Amount shall be established based upon final negotiations and shall compensate the consultant for costs associated with the project.
