About this file
This is Amendment No. 7 to the DEP Restated Agency Term Contract No. GC861, an indefinite delivery vehicle contract between the Florida Department of Environmental Protection (FDEP) and AGUA LLC. The contract was originally executed on September 25, 2014, to provide petroleum contamination site response action services in Florida's South Region. This amendment, effective June 19, 2020, modifies only the contracted rates for specified pay items and does not add, delete, or otherwise modify any line items contained in the original contract.
The amendment implements a 5% rate increase across 114 pay items included in the contract's Rate Schedule (Attachment D), with all increases not exceeding the maximum 5% allowed under contract provision 11.B.ii. The rate changes apply exclusively to new work assignments offered on or after the Rate Change Date of June 19, 2020, while all pre-existing work assignments continue to apply the prior Rate Schedule. The revised rates span multiple service categories including office activities, field operations, drilling and boring, well installation and abandonment, sample collection and laboratory analysis, soil source removal, debris removal and disposal, resurfacing, remedial action construction, and professional engineering and geology services. Specific examples of updated rates include file reviews increasing from $100.00 to $105.00 per review, site reconnaissance visits from $300.00 to $315.00 per visit, and LDA rig mobilization over 100 miles increasing from $6,300.00 to $6,615.00 per round trip. All other contract terms and conditions remain in effect, with the amendment taking precedence in case of any inconsistencies with the base contract.
