About this file

This is Amendment No. 13 to Agency Term Contract No. GC861, a rate increase amendment executed between the Florida Department of Environmental Protection (FDEP) and AGUA LLC. The contract, originally executed on September 25, 2014, establishes an indefinite delivery vehicle for petroleum contamination site response action services in the South Region of Florida. The amendment was signed on May 13, 2024, by James D. Hirsch, President of AGUA LLC, and Jessica Kramer, Deputy Secretary of FDEP, with data entry processed on June 10, 2024.

The amendment implements a 5% rate increase across the contractor's rate schedule, effective for all new work assignments offered on or after June 10, 2024. The rate changes apply exclusively to new work assignments; all pre-existing work assignments continue under prior rates. Attachment D (V3.5), the updated Rate Schedule, contains comprehensive pricing for over 200 line items spanning site assessment, drilling and boring operations, well installation and abandonment, soil and water sampling and analysis, excavation and dewatering systems, remedial action systems, waste disposal and transportation, and engineering and professional services. All rate increases remain at or below the maximum 5% allowable threshold specified in contract provision 11.B.ii. The amendment does not modify contract line items, scope of work, or any other terms and conditions of the base contract, which remain in full effect.
