Amendment No. 11 to DEP Agency Term Contract No. GC861

This is Amendment No. 11 to an Agency Term Contract between the Florida Department of Environmental Protection (FDEP) and AGUA LLC, a petroleum contamination site response action contractor. The original contract was executed on September 25, 2014, to provide petroleum contamination site response action services in Florida's South Region. The amendment was executed in May and June 2023 and implements rate increases to the contractor's existing rate schedule, effective June 1, 2023, for all new work assignments issued on or after the Rate Change Date.

The amendment updates Attachment D (Rate Schedule Version 3.4) with rate increases across the contract's extensive pay item schedule, which includes mobilization and demobilization services, drilling and boring operations, well installation and abandonment, soil and water sampling and analysis, remediation system packages, and professional services. The rate increases range from approximately 7.35% to 8.00% across the pay items, with the majority of increases set at 8.00%. All pre-Rate Change Date work assignments and previously offered work assignments continue to apply the prior rate schedule. The contract includes a provision prohibiting new Purchase Orders or Task Assignments after the renewal term expiration, though previously issued work may continue up to twelve months beyond the renewal term. The amendment also adds a requirement for photo documentation of drums to verify they meet the industry standard of being 75% full. No specific contract value or renewal terms are stated in the amendment document.
