About this file

This is Amendment No. 14 to Agency Term Contract No. GC790 between the Florida Department of Environmental Protection (FDEP) and AHS-GEAR LLC. The original contract was effective April 9, 2014, for petroleum contamination site response action services. The amendment was signed by AHS-GEAR LLC President on July 24, 2024, and by Jessica Kramer, Secretary or Designee for FDEP on August 2, 2024.

The amendment extends the contract for an additional six-month period from August 14, 2024, through February 14, 2025, pursuant to Florida Statute section 287.057(13). During this extension, both parties shall continue performing their respective duties under the same terms and conditions as the original contract. The amendment clarifies that no new Purchase Orders or Task Assignments may be issued after the extended term expires; however, the contract shall remain in effect for up to twelve months following the extended term to allow completion of any Purchase Orders or Task Assignments issued during the renewal or extended period. The contractor attested under penalty of perjury that commodities and services have not been produced by forced labor, consistent with Florida Statute section 287.1346, and acknowledged that the Department may terminate the contract should the contractor be placed on the force labor vendor list.

NOW, THEREFORE, the parties agree as follows:

1. The Contract is extended for a 6-month period, pursuant to section 287.057(13), F.S., to begin

August 14, 2024, and remain in effect until February 14, 2025. The Department and the Contractor shall continue to perform their respective duties during this extension period pursuant to the same terms and conditions provided in the Contract.

2. Paragraph 4, Term of Contract Section C is hereby deleted in its entirety and replaced with the following:

C. No new Purchase Orders or Task Assignments shall be issued or executed after the Term of Contract.

However, the Restated Contract shall continue in effect up to twelve months after the extended term for completion of any Purchase Order or Task Assignment issued/executed during the renewal or extended term. Purchase Orders or Task Assignments, completion of which extends beyond the extended term shall continue to be subject to change, as appropriate.

3. Pursuant to 287.1346, F.S., by signing this extension of contract, Contractor attests under the penalty of perjury that to the best of his or her knowledge any commodities or services offered to the Department have not been produced, in whole or in part, by forced labor. Contractor further agrees that the Department will terminate this contract should Contractor be placed on the force labor vendor list created pursuant to section 287.1346, F.S.

4. All other terms and conditions of the Contract remain in effect. If and to the extent that any inconsistency may appear between the Contract and this Amendment, the provisions of this Amendment shall control.
