Bidders must price all five categories for service to 400 children over 20 days per month for 9 months, with daily Monday through Friday deliveries required before noon and flexible scheduling for supper, dinner, and snacks. The solicitation anticipates enrollment growth with corresponding increases in meal volumes. Proposals are due August 4, 2026 at 3:00 PM, with questions due July 24, 2026 at 3:00 PM. Submissions must be made electronically through the City's OpenGov procurement portal or hand-delivered to the City Secretary's Office.
All meals must comply with Texas Department of Agriculture standards and CACFP regulations, with the awarded contract subject to TDA Food and Nutrition Division review and approval prior to commencement. A local vendor preference applies under Texas Local Government Code Section 271.9051, providing preference to City of Edinburg vendors whose bids fall within 5% of the lowest bid price. Insurance requirements vary by contract value: contracts under $5,000 may be waived, contracts $5,000-$14,999.99 require worker's compensation and general liability coverage, and contracts $15,000 or above require comprehensive coverage naming the City as additional insured. Required submittals include proposal, insurance certificate, Conflict of Interest Disclosure, General Questionnaire, Litigation Disclosure Form, HB 89 and Senate Bill 13 and 19 certifications, Non-Collusion Affidavit, and Form 1295 if awarded. CERTIFICATE OF INTERESTED PARTIES (Form 1295)
In 2015, the Texas Legislature adopted House Bill 1295, which added section 2252.908 of the
Government Code. The law states that a governmental entity or state agency may not enter into certain contracts with a business entity unless the business entity submits a disclosure of interested parties to the governmental entity or state agency at the time the business entity submits the signed contract to the governmental entity or state agency. The law applies only to a contract of a governmental entity or state agency that either (1) requires an action or vote by the governing body of the entity or agency before the contract may be signed or (2) has a value of at least $1 million. The disclosure requirement applies to a contract entered into on or after January 1, 2016. For more information go to the Texas
Ethics Commission web page at https://www.ethics.state.tx.us/filinginfo/1295/
