About this file

This document is bid bond preparation instructions issued by the State of West Virginia, specifically for submission to the Purchasing Section of the Department of Administration. The instructions provide a standardized template and detailed guidance for bidders preparing bid bonds required for state contract opportunities. The document specifies the required format, language, and execution requirements for bid bonds, including identification of the principal (bidder), surety company, obligee (State of West Virginia), and the penal sum amount. Bidders must include a brief description of the scope of work and execute the bond with appropriate signatures and seals from authorized representatives of both the principal entity and the surety company.

The bid bond amount must equal a minimum of five percent of the total bid amount, which may be stated either as "5% of bid" or as a specific dollar amount. The surety executing the bond must be licensed in West Virginia to transact surety insurance, must affix its corporate seal, and must attach a dated power of attorney with the surety's seal affixed. The bond becomes null and void if the bid is rejected or if the bid is accepted and the principal enters into a contract in accordance with the proposal while furnishing all other required bonds and insurance. The surety's liability is expressly limited to the penal amount stated in the bond, and the surety waives notice of any extension of time granted by the state to accept the bid.
