About this file
This is a Bid Bond Form required by the State of West Virginia, Department of Administration, Purchasing Section. The form serves as a surety bond that bidders must submit along with their bid or proposal to enter into a contract with the state. The bond guarantees that if the bidder's proposal is accepted, the bidder will execute the contract in accordance with the terms of the bid, furnish any additional bonds or insurance required, and perform all obligations specified in the agreement. The form requires signatures from both the Principal (the bidding entity) and the Surety (the bonding company), with execution by a proper officer such as a President, Vice President, or Duly Authorized Agent.
The penal sum of the bond, which represents the maximum liability of the surety, must be specified on the form and serves as the financial guarantee backing the bid. The surety must be licensed to transact surety insurance in West Virginia and is required to affix its official seal and attach a power of attorney with its seal to the bond. The surety's obligations remain in full force regardless of any extension of the time period for bid acceptance, and the surety waives notice of such extensions. This bond form is a standard requirement for state contract opportunities in West Virginia and ensures bidder compliance with contractual obligations.
