About this file
This document is a Bid Bond Preparation Instructions guide issued by the West Virginia State Agency's Purchasing Section within the Department of Administration for a construction paving project. The instructions provide standardized formatting and requirements for bidders submitting bid bonds as part of their proposal submissions. The document establishes the framework for principal-surety relationships and outlines the conditional obligations required when submitting bids on state contracts. No specific response dates, due dates, site visits, bidders' meetings, award dates, or contract terms are detailed within these instructions, as they serve as a template for bond preparation rather than project-specific documentation.
The bid bond must equal a minimum of five percent of the total bid amount and can be stated either as a percentage or a specific dollar figure. The surety executing the bond must be licensed in West Virginia to transact surety insurance and is required to affix its corporate seal and submit a dated power of attorney with seal affixed. The surety's liability is expressly limited to the penal amount stated in the bond, and the surety waives notice of any extension of time granted for bid acceptance. The document specifies that the bond becomes null and void if the bid is rejected or if the bid is accepted and the principal enters into a contract, furnishes required bonds and insurance, and performs all obligations created by bid acceptance. Signature authority is limited to the principal's president, vice president, or duly authorized agent.
