This document is the Project Specifications for the Campgaw Mountain Base Lodge Roof, Window, Siding Replacement & Alterations project, a state and local contract opportunity in Mahwah, New Jersey, managed under a single prime contract. The primary work includes shingle roof replacement, window and siding replacement, wood frame construction, masonry work, and electrical, mechanical, and interior finish work. The contractor must commence administrative requirements and submit for building permits within ten calendar days of Notice to Proceed. Construction activities must begin on Tuesday, September 8, 2026, with substantial completion required within eighty-four calendar days from that date and final completion within fourteen calendar days of substantial completion. Work is restricted to normal business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday, unless otherwise authorized. The building will be vacated to accommodate the work, though the site will remain active with the owner, requiring the contractor to coordinate operations and provide protection of subject areas. A preconstruction conference must be scheduled within fifteen days after Notice to Proceed, and progress meetings are required once every two weeks thereafter.

The contract includes a contingency allowance of $50,000 for use at the owner's instruction, with remaining funds credited to the owner at project closeout. The contractor must provide a two-year maintenance bond commencing upon final completion and purchase extended manufacturer warranties for all installed equipment to coincide with the maintenance bond period. A $50,000 contingency allowance is established for owner-directed work. All submittals must be provided electronically in Adobe PDF format, with shop drawings, product data, and samples requiring architect approval before proceeding. The contractor is responsible for all site safety compliance, including OSHA regulations, and must submit an OSHA Safety Certification with evidence of a full-time representative completing a 30-hour OSHA certified program or equivalent. Material Safety Data Sheets must be submitted for all materials prior to delivery to the site. The contractor assumes full responsibility for protection and safekeeping of project materials and equipment, with utility interruptions requiring seventy-two hours advance notice to the owner.

SECTION 01 0105

DEFINITIONS AND STANDARDS

PART 1 - GENERAL

RELATED DOCUMENTS

Drawings and general provisions of Contract, including General and Supplementary Conditions and other Division 1 Specification Sections, apply to this Section.

DEFINITIONS

General: Basic Contract definitions are included in the General Conditions.

Indicated refers to graphic representations, notes or schedules on the Drawings, or other Paragraphs or Schedules in Specifications, and similar requirements in Contract Documents. Where terms such as "shown," "noted," "scheduled," and "specified" are used, it is to help locate the reference; no limitation on location is intended except as specifically noted.

Directed: Terms such as "directed", "requested", "authorized", "selected", "approved", "required", and "permitted" mean "directed by the Architect", "requested by the "Architect", and similar phrases. However, no implied meaning shall be interpreted to extend the Architect's responsibility into the Contractor's area of construction supervision.

Approve: The term "approved," where used in conjunction with the Architect's action on the Contractor's submittals, applications, and requests, is limited to the duties and responsibilities of the Architect as stated in General and Supplementary Conditions. Such approval shall not release the Contractor from responsibility to fulfill Contract requirements unless otherwise provided in the Contract Documents.

Regulation: The term "Regulations" includes laws, ordinances, statutes, and lawful orders issued by authorities having jurisdiction, as well as rules, conventions, and agreements within the construction industry that control performance of the Work, whether lawfully imposed by authorities having jurisdiction or not.

Furnish: The term "furnish" is used to mean "supply and deliver to the Project site, ready for unloading, unpacking, assembly, installation, and similar operations."

Install: The term "install" is used to describe operations at project site including the actual "unloading, unpacking, assembly, erection, placing, anchoring, applying, working to dimension, finishing, curing, protecting, cleaning, and similar operations."

Provide: The term "provide" means "to furnish and install, complete and ready for the intended use."

Installer: An "Installer" is the Contractor or an entity engaged by the Contractor, either as an employee, subcontractor, or sub-subcontractor for performance of a particular construction activity, including installation, erection, application, and similar operations. Installers are required to be experienced in the operations they are engaged to perform.

The term "experienced," when used with the term "Installer" means having a minimum of 5 previous Projects similar in size and scope to this Project, being familiar with the precautions required, and having complied with requirements of the authority having jurisdiction.

DEFINITIONS AND STANDARDS 01 0105 - 2

Project Site is the space available to the Contractor for performance of construction activities, either exclusively or in conjunction with others performing other construction activities as part of the Project. The extent of the Project Site is shown on the Drawings and may or may not be identical with the description of the land upon which the Project is to be built.

Testing Laboratories: A "testing laboratory" is an independent entity engaged to perform specific inspections or tests, either at the Project Site or elsewhere, and to report on and, if required, to interpret results of those inspections or tests.

SPECIFICATION FORMAT AND CONTENT EXPLANATION

Specification Format: These Specifications are organized into Divisions and Sections based on the Construction Specifications Institute's 50-Division format and MASTERFORMAT numbering system.

Specification Content: This Specification uses certain conventions in the use of language and the intended meaning of certain terms, words, and phrases when used in particular situations or circumstances. These conventions are explained as follows:

Abbreviated Language: Language used in the Specifications and other Contract Documents is the abbreviated type. Implied words and meanings will be appropriately interpreted. Singular words will be interpreted as plural and plural words interpreted as singular where applicable and where the full context of the Contract Documents so indicates.

Imperative and streamlined language is used generally in the Specifications. Requirements expressed in the imperative mood are to be performed by the Contractor. At certain locations in the text, for clarity, subjective language is used to describe responsibilities that must be fulfilled indirectly by the Contractor, or by others when so noted.

The words "shall be" shall be included by inference wherever a colon (:) is used within a sentence or phrase.

Assignment of Specialists: The Specification requires that certain specific construction activities shall be performed by specialists who are recognized experts in the operations to be performed. The specialists must be engaged for those activities, and assignments are requirements over which the Contractor has no choice or option. Nevertheless, the ultimate responsibility for fulfilling Contract requirements remains with the

This requirement shall not be interpreted to conflict with enforcement of building codes and similar regulations governing the Work. It is also not intended to interfere with local trade union jurisdictional settlements and similar conventions.

Trades: Use of titles such as "carpentry" is not intended to imply that certain construction activities must be performed by accredited or unionized individuals of a corresponding generic name, such as "carpenter." It also does not imply that requirements specified apply exclusively to tradespersons of the corresponding generic name.

DRAWING SYMBOLS

Graphic symbols: Where not otherwise noted, symbols are defined by "Architectural Graphic Standards," published by John Wiley & Sons, Inc., eighth edition.

INDUSTRY STANDARDS

Applicability of Standards: Except where the Contract Documents include more stringent requirements, applicable construction industry standards have the same force and effect as if bound or copied directly into

DEFINITIONS AND STANDARDS 01 0105 - 3

the Contract Documents. Such standards are made a part of the Contract Documents by reference.

Individual Sections indicate which codes and standards the Contractor must keep available at the Project Site for reference.

Publication Dates: Where the date of issue of a referenced standard is not specified, comply with the standard in effect as of date of Contract Documents.

Updated Standards: At the request of the Architect, Contractor,or authority having jurisdiction, submit a Change Order proposal where an applicable code or standard has been revised and reissued after the date of the Contract Documents and before performance of Work affected. The Architect will decide whether to issue a Change Order to proceed with the updated standard.

Conflicting Requirements: Where compliance with two or more standards is specified, and they establish different or conflicting requirements for minimum quantities or quality levels, the most stringent requirement will be enforced, unless the Contract Documents indicate otherwise. Refer to architect, where requirements that are different, but apparently equal, and uncertainties as to which quality level is more stringent, for a decision before proceeding.

Minimum Quantity or Quality Levels: In every instance the quantity or quality level shown or specified shall be the minimum to be provided or performed. The actual installation may comply exactly, within specified tolerances, with the minimum quantity or quality specified, or it may exceed that minimum within reasonable limits. In complying with these requirements, indicated numeric values are minimum or maximum values, as noted, or appropriate for the context of the requirements. Refer instances of uncertainty to the Architect for a decision before proceeding.

Copies of Standards: Each entity engaged in construction on the Project is required to be familiar with industry standards applicable to that entity's construction activity. Copies of applicable standards are not bound with the Contract Documents.

Where copies of standards are needed for performance of a required construction activity, the Contractor shall obtain copies directly from the publication source.

Although copies of standards needed for enforcement of requirements also may be included as part of required submittals, the Architect reserves the right to require the Contractor to submit additional copies as necessary for enforcement of requirements.

Abbreviations and Names: Trade association names and titles of general standards are frequently abbreviated. Where such acronyms or abbreviations are used in the Specifications or other Contract Documents, they mean the recognized name of the trade association, standards generating organization, authority having jurisdiction, or other entity applicable to the context of the text provision. Refer to the "Encyclopedia of Associations," published by Gale Research Co., available in most libraries.

Abbreviations and Names: Trade association names and titles of general standards are frequently abbreviated. The following acronyms or abbreviations as referenced in Contract Documents are defined to mean the associated names. Names and addresses are subject to change and are believed to be, but are not assured to be, accurate and up to date as of date of Contract Documents.

END OF SECTION 01 0105

SUPPLEMENTAL GENERAL REQUIREMENTS AND PROCEDURES 01 1250-1

SECTION 01 1250

SUPPLEMENTAL GENERAL REQUIREMENTS AND PROCEDURES

DOCUMENT PRECEDENCE, SPECIFICATIONS AND DRAWINGS

1. The Specifications determine the kinds and methods of installation of the various materials.

The Drawings establish the quantities, dimensions and details of materials. The schedules on the Drawings give the location, type and extent of materials.

2. Indicated dimensions given on the Drawings take precedence over indicated scale for each drawing and detail. Large scale drawings govern small scale drawings, except as to anything omitted unless such omission is expressly noted on the larger scale drawing.

3. Drawings are not to be scaled with any measuring device. By submitting a bid to the Owner and/or entering into contract with the Owner, the Contractor acknowledges that drawing distortions may occur in the drawing reproduction (copying) process which may result in inaccurate measurements if drawings are scaled. Written and typed dimensions shall govern. If any dimensions are unclear, clarify the condition(s) with the architect prior to proceeding. Contractor must verify all dimensions at site and be responsible for accuracy and correctness of same.

4. In the event of any conflict among or within the Drawings, Specifications, or Schedules, the provisions specifying a better quality or greater quantity of work or materials shall take precedence and shall be the provision used in estimating bids and performing the contract, unless otherwise directed in writing by the Architect. The Architect shall determine which of the conflicting items represents the work of better quality or greater quantity.

5. During the course of the Work, should any ambiguities or discrepancies be found in the

Drawings, Specifications, or Schedules to which the Contractor has failed to call attention before submitting his bid, then the Architect will interpret the intent of the Drawings, Specifications or Schedules and the Contractor hereby agrees to abide by the Architect's interpretation and to carry out the work in accordance with the decision of the Architect.

CONTRACTOR

1. The contractor shall forward to the Architect written request for supplementary drawings and data needed by him to carry out the work. Such request shall be timed so as to enable the architect to act properly, well in advance of need at the site.

2. Any request by the Contractor which is made after the completion of bidding, to substitute any labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, transportation, or other facilities or services which is contrary to the provisions of the

Drawings, Specifications, or Schedules, shall be reviewed and approved or rejected by the

Architect.

3. The Contractor shall be solely responsible for any delay caused by the request, and for the costs and expenses of the Architect's review of the request. The Architect shall be entitled to reject the request for any reason, including the Architect's or the Owner's subjective determination of the relative quality, compatibility or desirability of the substitution.

4. The Owner, as an instrumentality of the State, is exempt from the New Jersey Sales and

Use Tax.

SUPPLEMENTAL GENERAL REQUIREMENTS AND PROCEDURES 01 1250-2

5. The Contractor shall, within 24 hours after rejection of Work, remove all materials and equipment so rejected and immediately replace said Work, at his cost, to the satisfaction of the Architect. Should the Work of the Owner or other contractors be damaged by such removal or replacement, the Contractor shall reimburse the Owner and other contractors and subcontractors for all costs incurred by them for correcting said damage.

6. Subject to prior written approval of the Owner, the Contractor may use spaces within the premises for shops and storage of material and equipment. Every space so used shall be repaired, patched, cleaned and restored to original condition by the Contractor immediately after the Contractor has completed his use of the space.

7. The Contractor or a Subcontractor or Sub-subcontractor requiring change in existing

Work shall have such changes performed by the trades skilled in performing the particular

Work and such changes shall be at the expense of the Contractor, Subcontractor or Sub-subcontractor requiring the change. Written authorization to perform unanticipated changes to the existing Work shall be received from the Architect prior to proceeding with the Work and shall include installation of such reinforcement of the Work as the Architect may direct.

8. The Contractor shall remove rubbish and debris from the building at the end of each working day and place in a metal container. The Contractor shall remove rubbish and cartons resulting from the installation of fixtures and equipment.

SUBCONTRACTOR(S)

1. Each subcontractor, including without limitation, subcontractors for the manufacture or supply of equipment, shall execute a Conditional Assignment, in form as follows, which shall be appended as a rider to every subcontract or sub-subcontract and shall be submitted with the subcontract or sub-subcontract to the Owner, as a condition for payment to the

Contractor for the Work performed pursuant thereto:

2. The Contractor's monthly application for payment shall be the same schedule form reflecting the same items from above. Unit Costs shall be realistic for their part of the Work.

1. Payments on account of materials or equipment not incorporated in the Work but delivered and suitably stored at the site, or at some other location agreed upon in writing, will be made by the Owner subject to the following conditions:

a. Such materials or equipment shall have been fabricated or assembled specifically for the Project and delivered to storage no earlier than needed for the orderly progress of the Work as demonstrated by the Progress Schedule.

b. Title to such materials or equipment shall pass to the Owner pursuant to the

Contractor's bill of sale which shall contain guarantee of replacement thereof in the event of damage thereto or disappearance thereof due to any cause.

c. The Contractor shall also affirm that he will pay for such materials or equipment immediately upon receipt of payment therefore from the Owner.

d. Raw materials or other materials or equipment readily duplicated or usable on other projects will be paid only after the materials are incorporated in the construction.

e. The Owner reserves the right to deny a request, without explanation, for payment for stored materials or equipment.

f. The failure of the Owner to respond to a request by a Contractor for payment for stored materials shall be deemed as a denial of that request.

g. Payments which are made for stored materials or equipment shall include only the net cost of the materials or equipment plus cost of delivery, if applicable to the point of storage.

h. Affidavits, in form acceptable to the Owner’s Representative, shall be furnished with

SUPPLEMENTAL GENERAL REQUIREMENTS AND PROCEDURES 01 1250-3

each application for payment in which payment is being requested for stored materials. Separate affidavits shall be furnished for each location where items are being stored.

i. With each affidavit the Contractor shall submit sufficient documentation to demonstrate that the stored materials have been received by the Contractor. The

Owner’s Representative shall be the sole judge as to the adequacy of this documentation and shall, at his option, be permitted access to all areas where these materials are to be stored to perform any inspections he deems necessary.

KNOWLEDGE OF CONTRACT REQUIREMENTS

1. The Contractor and his Subcontractors, Sub-subcontractors and materialmen shall consult in detail the General Conditions, Supplementary Conditions, all divisions and sections of the

Specifications, all Drawings and all Addenda for instruction and requirements pertaining to the Work, at his and their cost, and shall provide all labor, materials, equipment and services necessary to furnish, install and complete the Work in strict conformance with all provisions thereof.

2. The Contractor will be held to have examined the site of the Work prior to submitting his proposal and informed himself, his Subcontractors, Sub-subcontractors and materialmen of all existing conditions affecting the execution of the Work.

3. The Contractor will be held to have examined the Contract Documents and Modifications thereto, as they may affect subdivision of the work and informed himself, his Subcontractors, Sub-subcontractors and materialmen of all conditions thereof affecting the execution of the

Work.

4. The Contractor will be held to be thoroughly familiar with all conditions affecting labor in the neighborhood of the Project including, but not limited to, unions, incentive pay, procurement, living and commuting conditions and to have informed his Subcontractors and Sub-subcontractors thereof.

SITE CONDITIONS

1. If the contractor encounters differing site conditions during the progress of the work of the contract, the contractor shall promptly notify the Owner and Architect in writing of the specific differing site conditions encountered before the site is further disturbed and before any additional work is performed in the impacted area.

2. Upon receipt of differing site conditions notice in accordance with subparagraph 1 above, under site conditions, or upon the Owner otherwise learning of differing site conditions, the owner shall promptly undertake an investigation to determine whether differing site conditions are present.

3. If the owner determines differing site conditions may result in additional costs or delays, the owner or owner’s representative shall provide prompt written notice to the contractor containing directions on how to proceed.

4. Execution of the contract by the contractor shall constitute representation that the contractor and all of his/her subcontractors have visited the site and has become generally familiar with the local conditions under which the work is to be performed.

5. As used in this subsection, “differing site conditions” mean physical conditions at the contract work site that are subsurface or otherwise concealed and which differ materially

SUPPLEMENTAL GENERAL REQUIREMENTS AND PROCEDURES 01 1250-4

from those indicated in the contract documents or are of such unusual nature that the conditions differ materially from those ordinarily encountered and generally recognized as inherent in the work of the character provide for in the contract.

SUSPENSION OF WORK PROVISIONS

1. The owner shall provide written notice to the contractor in advance of any suspension of working lasting more than 10 calendar days of the performance for all or any portion of the work of the contract.

2. If the performance of all or any portion of the work of the contract is suspended by the owner for more than 10 calendar days due to no fault of the contractor or as a consequence of an occurrence beyond the Owner’s control, the contractor shall be entitled to compensation for any resultant delay to the project completion or additional contractor expenses, and to an extension of time, provided that, to the extent feasible, the contractor, within 10 calendar days following the conclusion of the suspension, notifies the Owner, in writing, of the nature and extend of the suspension of work. The notice shall include available supporting information, which information may thereafter be supplemented by the contractor as needed and as may be reasonably requested by the owner. Whenever a work suspension exceeds

60 days, upon seven days written notice, the contractor shall have the option to terminate the contract for cause and to be fairly and equitably compensated therefore.

3. Upon receipt of the contractor’s suspension of work notice in accordance with subparagraph

(2) of this subsection, the Owner shall promptly evaluate the contractor’s notice and promptly advise the contractor of its determination on how to proceed in writing.

(a). If the Owner determines that the contractor is entitled to additional compensation and/or time, the Owner shall make a fair and equitable adjustment to the contract price and contract completion time.

(b). If the Owner determines that the contractor is not entitled to additional compensation and/or time, the owner shall proceed with the performance of the contract work, and shall be entitled to purse suspension of work claim against the

Owner for additional compensation and/or time attributable to the suspension.

CHANGE IN CHARACTER OF WORK PROVISIONS
