About this file

This is a Business Enterprise Program (BEP) Waiver Request and Review Form issued by the State of Illinois Commission on Equity and Inclusion (CEI) in connection with the DNR Rock Cut roofing systems replacement project. The form establishes the procedural framework for vendors seeking waivers from BEP utilization goals on state contracts. The document outlines a comprehensive ten-requirement process that prime vendors must complete to demonstrate good faith efforts in soliciting certified vendors before requesting goal waivers. Vendors must document their outreach to minority, women, and disability-owned certified businesses, including evidence of sufficient response time, communication timelines, negotiation attempts, cost comparisons, and prior utilization history of such vendors.

The waiver request process involves multiple review stages with specific submission requirements and responsible parties. Prime vendors must complete Section I through Section II with detailed documentation of good faith efforts. The purchasing entity then reviews and submits recommendations to CEI's BEP Compliance division at CEI.BEP.Compliance@Illinois.gov, copying Jacob Perez, CEI Deputy Director. CEI Compliance conducts independent evaluation considering the vendor's good faith efforts, historical waiver grants, and prior use of minority, women, and disability-owned businesses. Final determination authority rests with the CEI Deputy Director, whose signed approval is required for inclusion in the procurement file. Failure to complete and submit the utilization plan with adequate documentation of good faith efforts renders the bid non-responsive under 30 ILCS 575/7(3).
