ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATIONOF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract

Rating will be neither positive or negative.

Offers will be evaluated by performing a comparative evaluation in accordance with FAR 13.106- 2(b)(3) to determine which response represents the “best” as a whole. Comparative Evaluations is the act of comparing two or more offers or proposal in response to the RFQ.

Proposals will be evaluated by performing a direct comparison of one offer with another in a uniform manner to determine which offer provides the government the best overall value.

The government reserves the right to consider a response that offers more than the minimum and select that response if it provides a benefit to the government. The government has the discretion to accept other than the lowest priced offeror that provides additional benefits. The government also has the discretion to make an award based on whether the lowest priced of the quotations/offers having the highest past performance rating possible represents the best benefit to the government

The following factors shall be used to evaluate offers:

Factor 1: Price

Prices will be evaluated for fairness and reasonableness through a price analysis that compares the offered prices against each other and the independent government estimate. Award shall not be made to an Offeror’s proposal for goods or services that is found to be unbalanced and/or unreasonably low or high.

Factor 2: Past Performance

Past Performance Questionnaire forms provided in the solicitation shall be completed and submitted as specified in the Instructions to Offerors. They will be evaluated to assess the degree of confidence the Government has in an Offeror's ability to supply products and services that meet users' needs based on a demonstrated record of recent and relevant work similar to the work described in the Performance Work Statement. Recency, as it pertains to past performance information, is a measure of the time that has elapsed since past performance reference occurred. Recency for this acquisition is defined as relevant work performed within the last four (4) years. Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service effort, complexity, dollar value, contract type, and other comparable attributes. Attributes for relevant work can be located in section 1.2.2.14 of the Performance Work Statement, and Attachment 5 Tabulation of Park Areas and Units. Offerors must provide a description of how contract references are relevant to this acquisition. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.

The offeror must submit no more than five (5) PPQ forms.

The Government reserves the right to evaluate past performance based on such information as the contracting officer’s knowledge and previous experience with the item or service being purchased, customer surveys, or other reasonable basis, without the existence of a formal database

Factor 3 – Technical Approach and Understanding of the Work

This factor considers whether the Offeror demonstrates an understanding of the complexity and magnitude of requirements set forth in the Statement of Work. At a minimum, the quote shall include a brief narrative (conceptual work plan) that clearly demonstrates an understanding of the requirements of the solicitation. The narrative shall address how the Offeror will perform, develop, and implement the work plan. It shall not exceed two pages.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. 1.2.1 The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials (except those specified to be provided by the Government), supervision, and other items and non-personal services necessary to perform facility cleaning services as specified at two (2) recreational park areas, embankment, berms, uncontrolled spillway, and access roads on Somerville Lake, Texas.

Services include but not limited to cleaning grounds, restrooms, picnic/camping units, group pavilions/shelters, gate house complex area, fishing piers, courtesy docks, dump stations, and water system facility. Cleaning maps showing areas to be cleaned are located in Attachment 3.

1.2.2 Facility Cleaning Requirements:

1.2.2.1 Regulations and Permits: All current County, State, and Federal rules and regulations governing sanitary standards of drinking water, protection of public water sources and solid waste disposal shall be met and maintained throughout the performance of the work specified under this contract. All trash collected on Government property shall be placed in Bulk Refuse Receptacles (BRR) in the park. If BRR are full in the park, the Contractor shall dispose of trash in nearest BRR in adjacent parks.

1.2.2.2 Traffic Regulations and Safety: The work to be performed under this contract shall be within the boundaries of land administered by USACE. The Contractor and Contractor’s employees are subject to all Title 36 regulations while completing work under this contract. No special provisions or entitlements shall be granted to the Contractor or Contractor’s employees.

The attention of the Contractor and Contractor’s employees shall be directed to the need for extreme caution and care while driving and operating equipment in these locations. The Contractor and Contractor’s employees shall comply with all state and local traffic laws. The Contractor shall comply with all pertinent provisions of the Corps of Engineers Manual, EM 385-1-1, Safety and Health Requirement Manual. An observed violation of safety requirements shall be grounds for the Government to stop work. Work shall not continue until the violation is corrected.

1.2.2.3 Accident Reporting: The Contractor shall maintain an accurate record of and shall report to the KO in the manner and time limitations and on the forms prescribed by the KO, all accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment incidental to work performed under this contract. Medical expenses for Contractor’s employees are the responsibility of the Contractor.

1.2.2.4 Condition of Equipment: All equipment used to perform work under this contract must be in good operating and mechanical condition and comply with Safety Manual (EM 385-1-1). A regular schedule of preventive maintenance must be followed on all equipment. All maintenance shall be conducted off Government property. The Contractor shall ensure leaking and unsafe equipment is repaired immediately and shall be responsible for containment and clean-up of leaks.

The Contractor shall remove and dispose of contaminated soils resulting from leaks or spills in accordance with Federal, State, County and Municipal laws, codes and regulations.

1.2.2.5 Safety Inspections: Prior to work commencement, all equipment shall have an initial inspection by the Government to ensure compliance with Section 18 of Safety Manual (EM-385- 1-1). The Contractor shall notify the Government at least two (2) days prior to bringing equipment on-site so that the time and place of these inspections may be scheduled. The Contractor shall inspect all equipment mobilized at the Lake prior to performance of all work. The Government may inspect equipment at any time it is operated on Government Property. Any equipment found deficient shall be taken out of service immediately until faulty conditions have been corrected and passed by the Government. No such removal will reduce the Contractor's obligation to perform all work required within the time scheduled under this contract. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents.

1.2.2.6 Vehicles: All vehicles, including Contractor and any subcontractors, utilized under this contract shall present a neat and clean appearance, be serviceable and shall comply with insurance and safety standards as required by the State of Texas. Vehicles shall be identified with company name or logo conspicuously displayed on door panels. Professionally prepared hand-lettering, magnetic signs or pressure sensitive decals shall be used.

1.2.2.7 Maps: Maps are provided in Attachment 3-Cleaning Maps and indicate the approximate areas where services shall be performed. Due to the large scale of service areas, actual boundaries on-site may not be discernible from the maps and delineation on-site by the Government will govern.

1.2.2.8 Typical Unit Drawings: Contract specification requirements will override all typical drawings. Typical Unit Drawings are not to scale, nor are they intended to depict all units at all locations. Each unit varies considerably in structure, design and size. Therefore, Typical Unit Drawings are included for general information purposes only in Attachment 4-Typical Unit Drawings.

1.2.2.9 Reports: The Contractor shall prepare and submit Daily Activity Reports (DAR) and Quality Control Reports (QCR) as specified. The Contractor shall develop and provide their own reports. A DAR shall be completed each day work is performed and shall be submitted to the Government as directed no later than the following day. A QCR shall be submitted to the Government at the end of each work week as directed. A Quality Control Inspector (QCI) shall ensure all reports are complete, legible and comprehensible.

1.2.2.10 Tabulation of Park Areas and Units: Attachment 5-Tabulation of Park Areas and Units provides acreage estimates and unit quantities within each park. The tabulation is provided for the convenience of the Contractor in determining the work required and preparing bid for the work.

Lake personnel will show the Contractor the service limits and requirements during an on-site inspection of the areas where required services shall be performed. If the number of units listed on the tabulation sheets and maps differs from the actual number of units on the ground, then the tabulation sheets and maps will be used for contract purposes. This tabulation depicts current conditions only and does not reflect any future work such as remodeling, re-design upgrades, new construction, demolition or moving units within areas which may occur within required services areas during performance of contract. The Government reserves the right to perform any future work at its discretion and to modify any, and all, Schedules within contract for any resulting impact upon the Contractor and Contractor’s required services.

1.2.2.11 Cleaning Frequency Schedules: The required frequency of service is provided in Attachment 6-Cleaning Frequency for unit cleaning services required. An Extra Service shall be required on Memorial Day and 4th of July. If Holiday Extra Service falls on the regular service day, then the Extra Service will be performed the following day.

1.2.2.12 Work Schedule: The Government will provide the Contractor with a preferred work schedule sequence for parks and/or areas at the lake for services to be performed by Contractor.

The Contractor must provide sufficient personnel and equipment to accomplish services at the lake. The Contractor shall submit a work schedule for each service for the lake to include approximate times for beginning work and ending work for each required service listed by parks or areas. Work schedules must be submitted within ten (10) days after the preferred work sequence has been issued to the Contractor, but no later than ten (10) calendar days after the beginning of initial services and prior to frequency changes. This work schedule is extremely important as it controls the time at which the quality assurance inspections are performed, ensuring that inspections are conducted only after the required service has been completed. Any variation or unforeseen change, such as being ahead or behind the approved work schedule, must be reported immediately by telephone or in person. Any proposed change to an approved work schedule must be submitted in writing and approved by the Government in advance of actual work schedule changes.

1.2.2.13 Additional Service Work Requirements:

1.2.2.13.1 Restrictions: Raw lake water shall not be used for cleaning.

1.2.2.13.2 Occupied Units: If a unit is occupied by the public at the time of the scheduled servicing, the Contractor shall ask permission to service the unit. If the public objects to the full or partial performance of the service, the Contractor shall immediately record the unit (by park, unit type and number) on the DAR as a non-serviced unit. If the unit becomes unoccupied while the Contractor is still in the park, the Contractor may service the unit as required and remove the unit from the DAR. The DAR must be kept current during work performance so that a unit which has not been serviced, which was later rejected by the Government’s QAR, can be verified as non-performed because unit was occupied by the public. A unit that is confirmed as being occupied may then be counted as non-performance, rather than as a reject.

1.2.2.13.3 All Quality Control Inspectors (QCI) and subcontractors, if used, shall possess at a minimum a copy of that portion of the contract/contract specifications which governs the work being performed. Failure to comply will result in cessation of work and removal of employees until such time that this requirement can be met.

1.2.2.13.4 Payment: Payment for completed and accepted work will be made on a monthly basis. Invoices shall include the contract number, the Contractor’s name, address, and contract information as registered in SAM. Prices shall be derived from the contract bid schedule for the appropriate Base and Option year Pricing. The Contractor shall only invoice after the end of each month and before the fifth business day of the new month.

1.2.2.13.5 Reporting of Exposure Hours: The Contractor shall submit the total number of hours worked each month at the time the invoice for payment is submitted.

1.2.2.14 Cleaning Services

1.2.2.14.1 General Grounds Cleanup: Performed as scheduled in the Cleaning Frequency (Reference Attachment 6). Facilities and units including, but not limited to, restrooms and courtesy docks are excluded from General Grounds Cleanup as these are cleaned according to Detailed Cleanup on their corresponding Cleaning Frequency (Reference Attachment 6). General Grounds Cleanup should leave the serviced area with an overall neat and clean appearance by removing large non-hazardous refuse, litter and fish remains from the parks or areas, the limits of which are designated as the cleaning boundaries on the Cleaning Maps (Reference Attachment 3). If hazardous materials are discovered during work performance, materials shall be left in-place and reported on DAR. On dam embankment roads and in park areas with long entrance roads leading into the park proper, cleaning boundaries shall be one hundred (100) feet each side of road centerline, or to three (3) feet beyond the road right-of-way fences or non-mowed areas, whichever is closest. Hiking trailhead cleaning boundaries shall be twenty (20) feet each side of the trail center line to a distance of seventy-five (75) feet from the start of the trailhead into the hiking trail. Litter collected shall be disposed of within bulk refuse receptacles and large non-hazardous refuse shall be removed from Government property.

Note: This contract does not include removal of flood or storm generated debris, as determined by COR. During low lake level periods, water’s edge will be limited as specified in table below.

Restroom types and quantities will be identified in the Tabulation of Areas and Units provided in Attachment 5. A typical unit consists of men’s and women's restroom/shower, walkways and Detailed Grounds Cleanup. These units are listed in the Tabulation of Areas and Units in Attachment 5 as one unit even though they may be separate structures for men and women.
