About this file
This document is a Service Level Agreement (SLA) attachment for a Member Management System Operations and Enhancements contract with the South Carolina Department of Health and Human Services (SCDHHS). The SLA establishes 21 distinct performance standards across multiple operational domains including system deliverables, financial reporting, security controls, training, system availability, and disaster recovery services. Key service requirements include delivery of operational and turnover phase deliverables within CDML-specified timeframes, maintenance of 99.9% system uptime (excluding approved maintenance windows), achievement of defined Actual Operational Start Date (AOSD) with 100% production infrastructure functionality, 42-day backup data persistence with quarterly restoration testing, and seven-year data retention capability consistent with CMS requirements. The contractor must maintain 24/7 on-call emergency contact availability with 30-minute callback response requirements, conduct quarterly independent assessments of security and privacy controls, provide weekly, monthly, quarterly, and annual financial reports, and ensure UAT, staging, and training environments maintain 95% availability during agreed-upon hours (7 am to 7 pm EST, Monday through Friday, with after-hours support as needed).
Liquidated damages provisions apply across all performance standards, with penalties ranging from $100 to $15,000 per occurrence or per day depending on the severity and type of service failure. Critical failures such as missing the AOSD incur $15,000 per day penalties, while data loss incidents result in $10,000 per occurrence charges and security breach notification failures result in $10,000 per calendar day penalties plus any federal government-imposed penalties. Key personnel vacancies accrue $300 per day credits beginning immediately upon vacancy occurrence. The contractor must submit timely corrective action plans within 15 business days of deficiency identification and provide monthly performance standard adherence reports. Lower environment migration delays incur $5,000 per day penalties, batch job completion failures incur $1,000 per failure, and invoicing delays beyond three months from expenditure incur 0.1% of Total Contract Value per business day. The SLA also mandates contractor participation in disaster recovery testing and monthly disaster recovery services reporting to ensure compliance with documented RTO and RPO objectives.
