About this file
This is a Standard Proposal Bond Form for Non-Construction contracts issued by the Virginia Lottery in response to a Request for Proposals (RFP) for an iLottery System, Services, and Support program. The bond form establishes the framework for proposal guarantees submitted by vendors responding to the Virginia Lottery's solicitation for a best-in-class iLottery program designed to maintain the Lottery's position as the highest grossing U.S. iLottery program, continue annual growth in iLottery sales and profits, provide innovative solutions to expand gaming market share, and drive player acquisition and retention. The proposal bond guarantees that the principal (offeror) will not withdraw their proposal for a period of 365 days following proposal opening and will enter into a formal contract with the Virginia Lottery if awarded, with failure to do so resulting in liability for damages up to the proposal guarantee amount representing the difference between the submitted proposal amount and any higher cost incurred by the Obligee to contract with another vendor.
The proposal bond amount is expressed as a percentage of the total proposal value, with the specific percentage to be filled in by the offeror. The bond requires execution by both the Principal and an authorized Surety, with the Surety's attorney-in-fact executing the bond subject to notarization and affidavit confirming authorization via power of attorney. The bond is governed by Virginia law and any disputes shall be litigated in the courts of the Commonwealth of Virginia, specifically in the City of Richmond. The Principal must enter into a formal contract and provide required performance bonds within ten days of receiving notice of contract award.
