About this file

This is a Protest Bond Form template for the Virginia Lottery related to a competitive solicitation for an iLottery System, Services, and Support contract. The form establishes the mechanism by which an offeror submitting a proposal in response to a Virginia Lottery Request for Proposal can provide financial assurance in connection with filing a protest. The bond guarantees that if the protesting offeror does not prevail through the administrative hearing process and any subsequent appellate court proceedings, the offeror and its surety will satisfy all costs, expenses, attorney's fees, and charges incurred by the Virginia Lottery as the result of the protest, as determined by final order or judgment. The bond amount is expressed as a percentage of the total proposal value, with specific fields for the Principal (offeror), Surety (bonding company), RFP number, proposal description, execution dates, and notarization by an attorney-in-fact representing the surety.

The Protest Bond Form requires the Principal and Surety to be jointly and severally liable to the Virginia Lottery and Commonwealth of Virginia for the bond amount. The Surety must represent that it is legally authorized to provide bonding services in Virginia. The document is governed by Virginia law, and any litigation arising from the bond must be brought in Virginia courts. The form includes a notarization section requiring certification by a notary public that the Surety's attorney-in-fact is duly authorized to execute the bond through a valid power of attorney and that no revocation or termination of such authority has occurred. This standard protest bond mechanism protects the government by ensuring that unsuccessful protesters assume financial responsibility for costs incurred in defending the award decision.
