About this file
This is a Non-Disclosure Agreement (NDA) executed by the South Carolina Department of Social Services (DSS) with employees, partners, and contractors who will access confidential information in the course of operations. The agreement establishes the framework for handling sensitive data, including Personal Information, Personally Identifying Information, Private Health Information, Federal Tax Information (FTI) from the Internal Revenue Service, and Social Security Administration (SSA) information. Recipients of this agreement acknowledge that they may be exposed to privileged and confidential client data and other non-public information during their work with DSS. The agreement grants DSS the contractual right to conduct onsite reviews of data facilities to verify compliance with DSS, IRS, and SSA requirements regarding safeguards for sensitive information, computer system security controls, and continuous monitoring of network infrastructures.
The NDA prohibits recipients from disclosing any confidential information in any medium—electronic, graphic, written, or oral—to any third party without express written authorization from DSS. Recipients acknowledge potential civil and criminal sanctions under Federal and South Carolina statutes for unauthorized access, use, or disclosure of DSS information, FTI, or SSA information. Criminal penalties include fines up to $5,000 and imprisonment up to five years for willful unauthorized disclosure of FTI under Internal Revenue Code Section 7213, and civil damages of not less than $1,000 per instance of unauthorized disclosure. For SSA information, violations constitute misdemeanor offenses under the Privacy Act of 1974 with fines up to $5,000. Vendors and contractors must provide current employee access lists to DSS and, upon request, to SSA or IRS representatives. Breach of the agreement terms may result in employment termination, contract termination, and legal action.
