JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. Do not use marketing language in this document. Language such as “This company has made its mark,” “This company is recognized as industry’s best,” and “This company is the leader in…” is unacceptable.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE AUTHORITY AND TYPE OF
JUSTIFICATION.
The Department of Homeland Security, U.S. Coast Guard, Surface Forces Logistics Center (SFLC) Icebreaker, Buoy & Construction Tender Product Line, (IBCT-PL) proposes to enter into a contract on a basis of other than open competition for the subject work item/s.
BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
The requirement in Work Item D-009 Statement Of Work “Buoy Crane, Inspect and Service requires the Contractor to provide the services of a “Qualified” technical representative, who is familiar with the Appleton crane model SB230-42 equipment system, to accomplish the following onsite: Assist with proper repair methods, and ensure compliance with manufacturer’s procedures & standards during disassembly, inspection, repair, modification, cal bration and reassembly of the equipment / systems
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR
SERVICES CAN BE USED.
This requirement does not limit solicitation to only one source. The Statement Of Work requires that the Technical Representative providing oversight be familiar with the Appleton crane model SB230-42 to accomplish the scope of work through experience or technical training. There are currently multiple venders in open market that can fulfill the requirements of this work item. During development of Work Item D-009, it was determined to be necessary and cost effective to select representatives who are able to direct and ensure proper installation, alignment, and calibration of the equipment.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).
In an effort to promote full and open competition and solicit as many potential vendors as possible, a sources sought notice was posted on 12 November 2021 on https://SAM.gov Contractor Opportunities Website. Interested vendors were invited to submit information discussing their capabilities with eight (8) calendar days of the posting date. The solicitation will include the Work Item in the specification and this Justification & Approval (redacted).
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
Services is required to ensure compliance for work being performed on the project Work Items. The absence of a Qualified Appleton Crane Tech Rep representative on-site could cause significant damage to equipment if reassembly out of calibration. The manufacturing drawing and specifications are proprietary information, and the Tech Rep will provide proprietary information, software, and tools pertinent to the equipment/system. The manufacturing drawing and specifications are proprietary to EOM and have not been purchased by the Coast Guard
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN
COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.
The “Technical Representative” as required in this instance is only to provide expert technical oversight of the prime contractor’s technicians and be available as a subject matter expert on the equipment being worked on. There are currently no limitations on open market as to “who” can be a subject matter expert and long as they are trained and / or have adequate experience with the equipment.
