Road and Bridge Maintenance and Construction (IDIQ) Multiple Award Task Order Contract Intermountain Region

Nevada, Utah, Southern Idaho, and Western Wyoming

This is an Indefinite Delivery Indefinite Quantity (IDIQ) Multiple Award Task Order Contract (MATOC) that will be effective for a base period, and, at the option of the government, for four

(4) additional one-year option periods. This contract is for routine, recurring, or emergency road and bridge maintenance, repair and construction projects. Work may be performed anywhere in the Intermountain Region within the states of Nevada, Utah, Southern Idaho, Western Wyoming and California Bridgeport Ranger District.

Instructions: Offerors shall submit unit prices for each item of work shown in the SCHEDULE OF ITEMS, and option year co-efficients. Offerors must provide Location Coefficients for each location within Zone 1 or within Zone 2, or if you would like to be considered for award in both zones by providing coefficients in both zones. Offeror will only be considered for task orders in those Geographic Zone(s) for which co-efficients are provided and contract awarded. The Government anticipates making a minimum of three and a maximim of ten awards.

Failure to comply with the instructions may render your proposal incomplete and ineligible for possible contract award.

B- 3 - Coefficients

The Coefficients are listed in THE SCHEDULE OF ITEMS and are proposed by the offeror. Due to the wide geographic distribution of potential task orders and the possible variability in cost based on location of the work, THE SCHEDULE is divided into two Geographic Zones. An offeror shall propose Location Coefficients for each Ranger District within one or both Geographic Zones. The proposed Coefficient for each Ranger District shall cover all work within the Administrative Area/Boundary of that District.

The coefficients are proposed as a multiple (in decimal format) increase or decrease to the line item Unit Price proposed by the offeror on the schedule. For example, a coefficient of 1.2 would result in an additional 20 percent to the listed unit price; 0.9 would result in a 10 percent decrease of the listed prices, and 1.00 would leave the unit price as your proposed unit price. The offeror shall limit the Coefficients to three decimal places. The offeror shall propose an Option Year Coefficient for each option year. The offeror’s Coefficients shall be all inclusive and shall include, but not limited to, the following costs:

STANDARD WORK (PRE-PRICED)

(a) Pricing for this contract will be based upon unit prices for Standard Items of Work as proposed by the offeror within the Schedule of Items of the original solicitation. Task Orders shall be developed using the Schedule of Items and Coefficients. The Schedule may be updated over time through contract modification to include additional standardized items of work, but the offeror’s costs for line items initially listed herein shall not be revised throughout the duration of the contract.

Task Orders will be comprised of entirely construction line items of work or service line items of work.

Individual task orders will not mix service and construction work.

(b) Standard Schedule of Items calculation: The coefficients (in decimal format) listed in The Schedule will be multiplied by the unit price listed in the schedule to obtain the adjusted price for each line item.

(a) Non-pre-priced work is categorized as follows:

(i) Road construction activity that is not specifically included in the Schedule of Items, but is within the basic intent and general scope of the contract.

(ii) The current edition, at time of task order pricing, of RS Means Heavy Construction Cost Data, or other industry standard cost estimating tools shall be used in developing proposed costs for non-standard work.

The current edition of the Rental Rate Blue Book shall be utilized for equipment cost. The government shall use prices from these industry publications as well as Forest Service construction cost data in validating the cost of non-standard work items. Location coefficients shall be applied to non pre-priced work items; option year coefficients shall not be applied unless costs are shown to have been obtained from Rental Rate Blue Book, or other industry standard published in the first year of this contract.

(b) Non-pre-priced work will be negotiated by the Contracting Officer and may be added to Task Orders when necessary at any time during the contract term.

Non-Pre-Priced Task Order Example: The cost for a specific constructed feature is not included in the schedule. For example a gravity-block retaining wall. The installed cost for the wall is $75.00 per square foot face for a 100 SF wall. The cost of this item may be calculated per unit price to be multiplied by quantity for total price of item. SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C. 1 - Scope of Work

The Contractor shall provide for all labor, material, supplies, transportation, management, supervision, equipment, and all other necessary items for complete and usable projects, performing all work in complete compliance with all plans, drawings, and specifications issued. The Contractor will be required to perform multi-discipline construction and maintenance work using common trades identified in the Davis Bacon Wage Determination and other trades common to the construction industry or the Service Contract Act Determination.

Types of projects/jobs contemplated under this contract may include, but are not limited to, road repair and construction including native surface, gravel, and paved surfaces; road decommissioning and obliteration; bridge repair and maintenance; retaining wall repair and construction; culvert installation and stream channel restoration for aquatic organism passage; and road maintenance including road reconditioning, road blading, aggregate stabilization, dust abatement, guardrail installation, signing, and brushing.

C- 2 - Location

Work shall be accomplished within the administrative areas of the locations identified in Section B which includes National Forest in the states of Nevada, Utah, Southern Idaho, Western Wyoming, and Bridgeport Ranger District in California. Specific project locations shall be identified per individual task order.

C- 3 – Washing Equipment

All equipment used on the project site shall be cleaned and inspected off National Forest land prior to its arrival on the site. The equipment must be 1) free of all mud, seeds, plants, and plant fragments; and 2) free of oil, fuel, or toxic leaks that would wash off into the water. Notify the Contracting Officer 48 hours in advance of mobilizing equipment to the project site to arrange an inspection and meet the requirements of

FSSS 171.

C- 4 – Fuel Storage

A written Hazardous Spill Plan may be required per individual Task Orders for projects which involve fuel storage and refueling actions. The plan shall contain a description of the specific hazardous materials, procedures, and spill containment that will be used, including inventory, storage, and handling. All vehicles carrying fuel will have specific equipment and materials needed to contain or clean up any incidental spills at the project site. Equipment and materials will be specific to each project site, and can include spill kits appropriately sized for specific quantities of fuel, shovels, absorbent pads, straw bales, containment structures and liners, and/or booms. Storing and refueling areas will be located in staging areas, away from streams, where a spill would not have the potential to reach live water. Containment structures may be necessary if prevention of spilled material from reaching live water cannot be assured.

Should quantities of stored fuel for a project exceed 660 gallons in a single tank; or exceed 1320 gallons for all storage combined; contractors and agency operators will be required to have a standard EPA written Spill Prevention Control and Containment (SPCC) Plan onsite, which describes measures to prevent or reduce impacts from potential spills from fuel, hydraulic fluid, etc. (40 CFR 112, Oil Pollution Act relating to SPCC Plans).

Storage of fuel and other toxicants within Riparian Conservation Areas (RCA – within 300 feet of live

Page | 19 streams) is prohibited. Refueling of equipment may be done within the RCA only at locations approved in advance by the Contracting Officer (CO).

Centrifugal pumps used for removing water from structure excavation shall sit in a secondary spill container with sufficient capacity to contain the quantity of fuel in the pump fuel tank. A Spill Prevention & Containment Plan is required and shall be submitted to the CO for approval prior to beginning construction. A spill containment kit shall be available on site that is to accommodate potential spills from the equipment used during construction.

C- 6 – Traffic Control Plan

Individual Task Orders may require that a Traffic Control Plan be submitted for approval meeting requirements of FSSS 156.

C- 7 - Government-Furnished Materials/Equipment

(a) Government Furnished Materials (GFM)/Government Furnished Equipment (GFE): In the normal course of performance of the MATOC contract, GFM/GFE will not be furnished to the Contractor however, the Government reserves the right to provide GFM and/or GFE to be used on any Task Order.

In such cases, these materials shall be receipted for by the Contractor and the Schedule of Item line item material cost shall be excluded from the price of the Task Order. Any GFM/GFE furnished to the contractor will be specifically identified in the statement of work and on the schedule of items of the individual task order. The location (as well as the type, quantity, and description) of GFM/GFE will be identified in individual Task Order.

In such cases, these materials shall be received for by the Contractor and the Schedule of Item line item material cost shall be excluded from the price of the Task Order. TThe Contractor shall follow the instructions of the Contracting Officer’s Representative (COR) regarding the disposition of all Government-furnished property not consumed in performance of the Task Order.

(b) Contractor Transporting: The Contractor, with its own resources, and at no cost to the Government, shall transport all GFM and/or GFE, if any, described on the Task Order from the Government storage area to the work site indicated in the Task Order.

Transportation Cost: It is anticipated that the majority of GFM/GFE will be provided at or adjacent to the project site. In such instances, no separate transportation costs would be incurred or cost. If transportation of GFM/GFE is other than what would normally be encountered, a separate cost may be negotiated into the pricing of the associated Task Order.

(c) Risk and Responsibility: Once accepted, the Contractor assumes the risk and responsibility for the loss or damage to any GFM/GFE.

C- 8 – Recycling and Disposal of Refuse

With the exception of materials specifically indicated or specified to be salvaged for reuse in construction, or turned over to the Government, all refuse, excess or waste materials resulting from construction operations shall become the property of the Contractor and shall be recycled and/or disposed of. All disposals shall be in accordance with federal, state, and local laws and regulations. No disposal, viewing or sale of materials and/or equipment shall be allowed on Government property.

C-9 – Safety

During the execution of this contract, the Contractor shall conform to the rules and regulations as set forth by OSHA Safety and Health Standards, 29 CFR Part 1926 - Safety and Health Regulations for

Construction. Smoking will not be permitted in any building or structure.

C-10 – Temporary Facilities

(a) STAGING AREA: The Contracting Officer Representative shall arrange the location for exterior stockpiling of materials. The Government will provide adequate staging area as close to the work site as practicable. The Contractor shall be responsible for protecting materials stockpiled against adverse weather, damage, theft, and other risks of loss. The Government assumes no responsibility for material or equipment left in the storage area.

(b) SANITARY FACILITIES: Toilet facilities will not be provided by the Government at work sites.

C-11 – Existing Utilities

The Contractor shall field verify all utility locations before digging or trenching. This shall include, but not limited to, the use of sonic, electronic or magnetic detection devices, by noting pull box and utility box locations at the surface, use of locator services, and by potholing. Contractor shall be responsible for repairing any utilities damaged during construction at no additional cost to the Government.

C-12 – Specifications

The work shall conform to specifications included in this contract and any supplemental specifications and/or scope of work issued in conjunction with each individual Task Order. All work shall be performed in compliance with the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects FP-03 and all Forest Service Supplements.

C-13 – Drawings

The work shall conform to drawings provided with a Task Order.

C- 14 - Submittals

(a) Definition: Submittals - Product literature, catalog cuts, product samples, shop drawings, as-built drawings, Quality Control Plans, and other documents submitted to the Contracting Officer for information or for review and approval when required by the Task Order.

(b) Submittals shall be presented in two copies unless indicated otherwise. The Contracting Officer will return one copy of the submittal to the Contractor, whether approved or rejected.

(c) All submittals shall be accompanied with a transmittal sheet signed by the Project Site Superintendent.

Salient characteristics of the materials proposed for use shall be clearly identified in the submittal. The Project Site Superintendent shall certify that he has reviewed the submittal and has determined that the submittal is in full compliance with the requirements of the Contract and Task Order. Illegible, incomplete, or uncertified submittals may be rejected.

(d) Submittals shall be approved by the Contracting Officer prior to any work being performed on the Task Order or materials being delivered to the job site.

(e) Review of submittals, and corrections or comments made during the review, does not relieve the Contractor from compliance with the requirements of this Contract.

(f) Allow 14 calendar days for government review of submittals. Review time shall commence upon receipt of a satisfactory submittal certified by the Project Site Superintendent containing all information required to

Page | 21 completely and thoroughly evaluate the submittal. Time shall start anew for each submittal and any required resubmissions.

C-15 – Catalog Cuts

Catalog cuts shall contain manufacturer's description, specifications and sketches of the material and equipment provided. The catalog cut shall contain sufficient information, which can be used to determine compliance with these specifications. Submit catalog cuts as required by a negotiated Task Order. Clearly indicate selected item and components being proposed.

C-16 - Samples

Product samples shall include color, pattern, style, and other information required to fully describe the items being proposed as required by the Task Order.

C-17 - Shop Drawings

Submit shop drawings when required by the Task Order. Drawings shall indicate layouts, dimensions, materials, and other information required to fully describe the items being installed.

C-18 – Test Results

Submit test results as required by the Task Order.

C-19 – Permits and Certificates

Submit copies of all permits and certificates as required by the Task Order.

C-20 – Hazardous Material Identification

Submit Material Safety Data Sheets (MSDS) for any materials defined as hazardous under the most current revision of Federal Standard 313. Two copies of each MSDS shall be submitted to the Contracting Officer no later than the delivery date of the product.

C-21 - As-Built Drawings

When As-Built Drawings are required by a Task Order, the Contractor shall maintain at the job site one set of contract drawings marked in red to show any deviations which are found to exist or have been made from the contract drawings. Upon completion of the work, the marked set of drawings shall be delivered to the Contracting Officer. Request for final payment will not be approved until the marked drawings are delivered to the Contracting Officer.

C-22 - Barricades, Warning Signs, and Other Devices

The Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic.

The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. Trenches and other hazards will be signed and flagged in such a way that the public will be aware of the hazard.

All road barricades, warning signs, lights, temporary signals, flagmen and pilot car operators and equipment, and other protective devices, except for special devices, shall conform with Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Federal Highway Administration and applicable safety codes.

The Contractor shall furnish, erect, maintain, and remove temporary traffic control signs. Sign details and installation shall conform to the (MUTCD) standards for temporary signs on a rural highway. A sign plan shall be submitted to the CO for approval prior to fabrication or installation of the signs. Specific locations shall be designated by the COR prior to installation. All signs shall be installed prior to commencing on-site work.

a. Pre-final Inspection: The Government may, at its own discretion, conduct a pre-final inspection prior to the contractor requesting a final inspection. Any discrepancies noted shall be corrected prior to final inspection.

b. Final Inspection: Upon completion of the project, , the Contractor shall submit a written request for final inspection to the Contracting Officer and the designated Contracting Officer’s Representative. This request must be received at least seven (7) days prior to the requested date for final inspection. The final inspection will be performed with the Contractor by the appropriate Government personnel.

The Contractor shall be required to (a) commence work on any Task Order in accordance with the Notice to Proceed. (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the date specified in the Task Order for completion. The Region 4 Acquisition Office of the United States Forest Service, Department of Agriculture is responsible for this solicitation, award and administration of the contract. Individual Task Orders are the issued by and are the responsibility of the Center or Unit issuing the task order. All communication for a task order shall be directed to the contact identified in the individual task order.
