1.0 INTRODUCTION
U.S. Army Corps of Engineers retained NetCompliance Environmental Services, LLC to conduct an inspection to determine the presence, location and quantity of asbestos containing materials at 3200 SW Jefferson Way, Corvallis, OR 97331-8550 (subject property). AHERA Accredited Building Inspector, Glenn Bryant, performed the on-site inspection on Nov. 30, 2011 & Dec. 01, 15, 2011.
Suspect Asbestos Containing Building Materials (SACBM) are presumed to contain asbestos until they are proven, either by material documentation or analytical sampling, not to contain asbestos.
Buildings constructed prior to 1981 are suspect for installed Asbestos Containing Building Materials (ACBM) and require building owners to determine the presence, location and quantity of Presumed Asbestos Containing Building Materials (PACM). Buildings constructed after 1980 have been determined not to have ACBM prevalent enough to require building owners to presume that the building materials are asbestos containing. However, asbestos materials may still be present in some post 1980 buildings and building owners must exercise due diligence in regard to identifying ACBM. Due diligence may be accomplished by compiling accurate and reliable records or by material sampling and analysis.
2.0 PROPERTY INFORMATION
The property was occupied at the time of the inspection and the owner provided access. An asbestos survey report conducted by Eastwood Environmental, Inc. dated January 12, 1994 was reviewed and relied on in part for this report. In addition, a report from a February 2011 re-inspection conducted by the USACE was also reviewed during the NCES survey work.
The Laboratory Services Wing is part of a building complex and was divided up into two homogenous sample areas as follows:
Building Laboratory Services Wing
12,950 sq. ft. building with dock area and one stair tower.
Mechanical spaces are located in some attic spaces, on the roof of the East stair tower, on the second and first floors. No VAT was specified in the as-builds and the floor tile is presumed to be installed during work on the North Wing and is the same looking floor tile.

5.0 GOVERNING AGENCIES
United States Environmental Protection Agency - Region 10 (US-EPA) Reference; 40 CFR Part 61 Subpart M (NESHAP) (http://www.epa.gov/asbestos/)
Occupational Safety and Health Administration (OSHA) Reference; 29 CFR 1926.1101 Subpart Z, Appendences A to K Oregon State Department of Environmental Quality (DEQ) Reference; OAR 340 Division 248 (http://www.deq.state.or.us/aq/asbestos/) Oregon Occupational Safety and Health Administration (OR OSHA) Reference; OAR 437 Division 2
6.0 SUMMARY OF REGULATIONS
Asbestos is well recognized as a health hazard and is highly regulated. The United States Environmental Protection Agency (EPA) and the United States Occupational Safety Health Administration (OSHA) asbestos regulations are intertwined in this area.
6.1 OSHA REGULATIONS
The U.S. Occupational Safety and Health Administration (OSHA) issued revised regulations covering asbestos exposure in general industry and construction. Both standards set a maximum exposure limit and include provisions for engineering controls and respirators, protective clothing, exposure monitoring, hygiene facilities and practices, warning signs, labeling, recordkeeping, and medical exams. OSHA has worked closely with EPA so that the regulations of both agencies are compatible to the extent OSHA's mandate allows.

The following are some of the requirements of the Asbestos in Construction Standard (29 CFR
1926.1101 subpart Z) that came into effect on October 11, 1994:
1. Covered building owners (excluding residences) must communicate the presence of asbestos-containing building materials to tenants, affected employees, and to contractors who may, or will likely, disturb these materials.
2. General contractors (including the owner if several prime contractors are working concurrently) on multi-employer construction sites are now responsible for any sub-contractor who disturbs asbestos-containing materials, although the contractor who disturbs the material is held accountable for executing the requisite response action indicated by regulation.
3. Recordkeeping maintained by facility owners is to transfer with the property. If a facility is sold or otherwise changes hands, all asbestos related records (excluding personnel records) are to transfer to the new owner.
4. Training requirements are extended, in some cases, to custodial personnel where these employees may disturb the asbestos-containing material or where these employees may be working around "dust" that contains asbestos.
5. Owners who wish to rebut the presumption of asbestos in a given building material must have at least three bulk samples, as taken by an AHERA accredited inspector, of the material analyzed and the results of this analysis must indicate that no asbestos is present.
6. Where asbestos-containing materials are periodically disturbed, the employer must conduct an exposure assessment to determine whether the affected employee(s) are exposed at or above the permissible exposure limit (PEL). This exposure monitoring must be conducted at frequencies consistent with the regulation, and may be required daily, depending on the risk level of the material, the employee(s) involved, previous exposure assessment results, the work practices and the engineering controls used to manage airborne asbestos fibers.
6.2 EPA & DEQ REGULATIONS
Asbestos: Regulations relative to asbestos from the EPA and state equivalent programs have not changed since November 1993. The applicable laws and regulations include the Asbestos Hazard Emergency Response Act (AHERA) and EPA regulation 40 CFR, Subpart A, National Emission Standards for Hazardous Air Pollutants (NESHAPs) These regulations' key points, with respect to asbestos inspections and consequent actions, include the following:
1. Prior to demolition or renovation (and renovation is defined in such a way as to include maintenance), the building materials likely to be disturbed must be sampled in accordance with EPA guidance documents to determine whether the materials contain asbestos. EPA guidance documents require samples based on quantity and type of material present in order to determine that a material does not contain asbestos. Consequently, for some building materials, EPA may require up to seven samples to determine that asbestos is not present while OSHA requires only one to three.
© NetCompliance Environmental Services, LLC Page 7 of 17
2. Building materials are classified as Regulated Asbestos-Containing Materials (RACM), Category I non-friable asbestos-containing materials (Floor Tile Mastic, Mastics & Roofing Materials), and Category II non-friable asbestos-containing materials (Flange Gaskets, Counter Tops, Dry Wall Joint Compound, & Electrical Components).
3. The EPA prepared Model Accreditation Program (MAP) specifies minimum training requirements for the several asbestos consulting and abatement disciplines.
7.0 LABORATORY INFORMATION
International Asbestos Testing Laboratories (IATL) conducted the analysis of samples using Polarized Light Microscopy (PLM) analysis method EPA 600/R-93/116. IATL participates in the National Voluntary Laboratory Accreditation Program (NVLAP) and in the American Industrial Hygiene Association (AIHA) Laboratory Quality Assurance Programs.
8.0 SAMPLING METHODOLOGY
An Asbestos Inspection and collection of Suspect Asbestos Containing Building Materials (SACM) must follow established guidelines, sampling procedures and be performed by an accredited AHERA Building Inspector in order to be valid.
This survey was conducted in accordance with 40 CFR Part 763, 29 CFR 1926.1101 – Toxic and Hazardous Substances, NESHAP regulations (promulgated by federal OSHA, EPA regulation 40 CFR Part 61), and AHERA guidelines.
The subject property was inspected and a limited number of accessible SACMs were sampled. The number of samples collected of each SACM depended on the type and quantity of the material.
Homogenous SACM are grouped for asbestos analysis from the functional spaces within the subject property inspected. A homogenous or like material is determined by assessing a material type for general appearance, texture, pattern, color, construction date, application date, and size.
The collected samples are submitted with signed Chain of Custody documentation, packaged in labeled airtight containers and shipped overnight by Fed-Ex courier. Multi-layer samples (ex: floor tile & mastic) may be submitted together and separated into constituent layers by the laboratory.
Samples submitted with more than one identifiable layer or material are divided and analyzed separately in the lab.
9.0 RESULTS
Asbestos-Containing Material (ACM): ACM means any material containing more than 1% asbestos. Asbestos includes chrysotile, amosite, crocidolite, tremolite asbestos, anthophyllite asbestos, actinolite asbestos, and any of these minerals that have been chemically treated and/or altered.
© NetCompliance Environmental Services, LLC Page 8 of 17
Polarized Light Microscopy: PLM is an EPA-approved method for the analysis of bulk materials for asbestos and is the basis of this report. The PLM procedure provides an economical analysis technique for screening large numbers of samples. However, there are limitations to light microscopy testing due to the magnification (100-400X) employed and due to other interferences present in the building material matrix (ex: tar and petroleum binding components, sub-micron particulate adhering to the surface of asbestos mineral, etc.).
Point Counting: A material with <10% asbestos by PLM visual determination should be point counted and IATL point counts at <10% as common practice. The notation (PC) in front of the % Asbestos column indicates that a Stratified Point Count Method (400 count) was performed to quantitatively determine asbestos content.
Positive Results (>1%): A material with ≥10% asbestos has a high confidence level in the reported result and no additional action is necessary. A material with <10% asbestos can be accepted as positive by the owner or operator of a subject property and may (1) elect to assume the amount to be greater than 1% and treat the material as ACM or (2) require verification of the amount by point counting or other method. Some labs Point Count as standard procedure.
Negative Results (≤1%): A material with no asbestos detected does not have to be point counted.
However, small asbestos fibers may be missed by PLM due to the limitations of the optical microscope; therefore, negative PLM results cannot be guaranteed by the laboratory. Because of the limitations of PLM, many regulatory bodies have recommended further analysis of bulk building materials by TEM (ELAP 198.4). The gravimetric reduction process is usually employed on Non-Friable Organically Bound (NOB) building materials (ex: floor tiles, roofing materials, etc.)
is particularly well suited for TEM confirmation of negative PLM samples.
Non-Suspect Materials: The AHERA Accredited Building Inspector may identify non-suspect building materials based on experience, visual determination and tactile examination. Non-suspect materials are listed if and when they are identified and can include but are not limited to rubber adhesives, rubber contact cements, fiberglass insulation, cellulose insulation, fiberglass roofing felts, pressed wood ceiling tiles and sound boards.
Positive Stop Analysis: The following rule applies when samples are marked for positive stop analysis. If the analysis indicated no asbestos in the first sample, the second sample was analyzed, etc., until all samples of each homogeneous material were analyzed or until analysis indicated the sample contained asbestos. If any one of the samples collected from any homogeneous material was determined as asbestos containing, the inference is that all of that homogeneous material contains asbestos.

10.0 DISCUSSION & RECOMMENDATIONS
The survey documents for 1994 were found at the subject property and some other documents but no abatement documents or O&M program was found at the site.
• Recommended Response Actions:
o Maintain a copy of this inspection report at the facility and make it available to the appropriate personnel.
o Establish an O&M program to address identified asbestos containing materials.
The re-survey conducted by Glenn Bryant of NCES determined the following:

This material was previously identified and there is a mixture of asbestos and non-asbestos pipe fittings.
This is now the oldest building in the complex and the original fittings are the asbestos containing hard fittings but is nearly impossible to tell the difference. Some damage was reported to Dan Merner at the time of the inspection and a crew was reported to have conducted work in the areas. Damage and no labeling was noted. Removal and replacement with like materials also appears to have been done.
• Recommended Response Action:
o Treat all hard fittings in this building as asbestos containing.
o Repair or abate identified damage.
o Post OSHA warning signs at any access points or label all accessible hard fittings.

The materials were unlabeled at the time of the inspection but labels were applied by NCES. These materials are in good condition and can be used for the specialty purposes they were intended for.
• Recommended Response Action:
o Use items or dispose of if not needed.

According to the EPA asbestos containing thermal system insulation and surfacing materials are regulated (RACM) regardless of condition. Any other asbestos-containing materials that are damaged or deteriorated to the point of becoming friable are also regulated. The EPA identifies additional materials that have historically been manufactured with asbestos fibers. These materials are classified as "suspect" asbestos-containing materials and require bulk sampling to confirm or deny the presence of asbestos prior to demolition or renovation.
Asbestos containing materials do not pose an exposure risk unless they are disturbed or deteriorated to the point of releasing fibers into the air. Only trained personnel knowledgeable of proper safety and handling procedures should perform any activities, which might disturb such materials. If a building contains suspect asbestos thermal system insulation, surfacing material (regardless of condition) or any suspect material in a deteriorated condition, then an operation and maintenance plan must be implemented.
Workers must be notified of the presence of ACBM in their spaces. All members of maintenance and custodial staff who may work in buildings that contain ACBM must receive awareness training of at least 2 hours, whether or not they are required to work with the ACBM. Any maintenance staff conducting activities that will disturb the ACBM shall receive 2-hour awareness training plus 14 hours of additional training (section 763.92). All areas identified as having ACBM or presumed ACBM must be re-inspected for changes in condition by an AHERA accredited inspector every 3 years. Friable ACM must be re-inspected every 6 months.
An operations, maintenance, and repair program shall be implemented whenever any friable ACBM is present. Any material identified as or assumed to be non-friable ACBM must be treated as friable when this material is about to become friable as a result of the scheduled activities.
The removal of any Regulated Asbestos Containing Material (RACM) must be done using state-of-the-art engineering controls and by a certified contractor in accordance with all applicable federal, state, and local regulations. EPA states that Category I materials may be left in place during demolition/renovation activities, providing the materials are not friable or subject to any mechanical forces which may render the materials friable. Should this be the case, all regulations apply including but not limited to, personal protection, negative pressure enclosure, personal monitoring, etc. If the Category I materials are expected to be rendered friable during demolition/renovation activities, then they must be removed by an asbestos abatement contractor prior to such activities.
All ACM must be removed prior to intentional burning.
If the Category I material is left in place during the demolition/renovation phase, preventative engineering controls must be taken to assure that the material does not become friable and release fibers into the air. EPA regulation 40 CFR, Subpart “A” (NESHAP), requires control devices and fugitive emissions monitoring during demolition/renovation activities which will disturb, or have the possibility of disturbing, the asbestos-containing materials. In addition, a person trained as required by paragraph (c)(8) and trained in the provisions of 40 CFR Part 61, Subpart M is required as well as a signed statement that the material is non friable, is bound in the petroleum based matrix and likely to remain intact during controlled demolition.
© NetCompliance Environmental Services, LLC Page 17 of 17
Due to the nature of any demolition/renovation activity, the potential exists of the asbestos-containing materials becoming friable and releasing asbestos fibers into the air. Careful consideration should be taken to evaluate the extent of demolition/renovation and preventive steps needed, such as engineering controls and/or removal, to minimize the possibility of airborne asbestos fiber release.
11.0 DISCLAIMER
The use of OSHA and/or AHERA sampling protocol, stringent Quality Assurance/Quality Control procedures, and professional opinions are the basis of this Report. Inaccessible asbestos containing materials may exist behind walls, under floors, underground, and generally, in any inaccessible area. These materials, should they exist, are not included the scope of this Report. If encountered, suspect asbestos-containing materials must be presumed to contain asbestos, and treated as such, until further sampling confirms or denies the presence of asbestos.
