About this file

This is Addendum No. 2 to an Agency Request for Quotation (ARFQ DEP26-92) issued by the West Virginia Department of Environmental Protection for the AML Miller Mine Drainage Phase II project. The addendum was issued to publish vendor questions and answers from the pre-bid conference held on-site on July 9, 2026, and to distribute the Pre-Bid Conference Checklist that was omitted from Addendum No. 1. Key project dates include a vendor questions deadline of July 23, 2026, and a bid opening date of August 6, 2026. The project involves mine drainage collection system construction with multiple line items including site preparation, erosion control measures, composite filter sock installation (270 linear feet of 32-inch composite filter sock or alternative triple-stacked 24-inch composite filter sock), erosion control blankets for regraded slopes, and Class A riprap drainage blankets (2,756 tons). The engineer's estimate was revised to $1,519,181.32.

The addendum provides critical clarifications and modifications to project specifications and requirements. Notable approvals include permission for onsite burning east of the powerline right-of-way if applicable permits are obtained, confirmation that B&O tax at 2% applies only to work performed within Clarksburg city limits (parcels 9 and 11), and approval of specific alternative materials including triple-stacked 24-inch composite filter sock and limestone riprap with calcium carbonate equivalency for drainage blankets. Timber mats must meet the specified 16'x4'x1' dimensions to secure the mat skirt. Bonded fiber matrix for erosion control blankets requires documentation of equivalency to the proposed standard. Contractors are instructed to reference cross-sections and detail sheets for proper placement of collection system components and drainage blankets.

Addendum #2 Miller Mine Drainage Phase II

ARFQ DEP 0313 DEP2600000092

The following are questions that were identified after the Pre-Bid Conference (PBC) conducted on-site on July 9th, 2026, Project Clarifications, Project Notes, Project changes, Technical Specification Changes, and Project Plan Changes. QUESTIONS AND ANSWERS

Q1. In reference to site preparation, can we burn on this site?

A1. The contractor shall be permitted to burn onsite if they obtain all the applicable permits and complete burning operations east of the powerline Right of Way boundary.

Q2. Will Clarksburg B&O tax be required for portion of the project with the city and if so can you provide the tax rate?

A2. Yes, B&O tax will be required. The tax rate shall be 2% but will only applied to the portion of the work performed within the City of Clarksburg limits which are parcels 9 and 11.

Q3. In reference to temporary work pad would composite mats or 16’x4’x8” wood mats be acceptable alternatives to the 16’x4’x1’ wood mats per 4.2.22.4 of the specifications?

A3. No, composite mats or 16’x4’x8” wood mats will not be acceptable. The proposed thickness of the timber mats is needed to secure the timber mat skirt.

Q4. In reference to the 32” composite filter sock with a plan quantity of 270 LF, would super silt chain-link / fabric fence or stack smaller diameter sock be accepted option?

Considering the small quantity, it will be difficult to have someone mobilize to field fill 32” sock.

A4. The contractor shall be permitted to triple stack 24-inch composite filter sock in lieu of a single stack of 32-inch composite filter sock. Payment for the triple stack 24-inch will be in lieu of a single stack of 32-inch composite filter sock, and will only be applied for the 270 LF of construction item 5.3

Q5. Can we use hydraulically applied bonded fiber matrix (BFM) for portions of line item

17 Erosion Control Blanket for the regraded slopes? Rolled erosion control blankets would still be used vegetated lined channels.

A5. If the contractor can provide documentation that bonded fiber matrix (BFM) is equivalent or better to the proposed erosion control blanket for the regraded slopes then a substitution would be permitted.

Q6. Please confirm Line Item 30 Class A RipRap Drainage blanket with a quantity of

2,756.00 tons is non-calcareous it is call out as non-calcareous in the specifications

7.2.11.1 but not noted on the detail sheet 9 of the plans.

A6. Limestone (calcareous) with calcium carbonate equivalency will be accepted for this item. Class A riprap for the drainage blankets shall follow specification 7.2.3 gradation requirements.
