Addendum #4 Questions and Answers for Pre-Qualified Providers of Information Technology Goods and Services

This document is a comprehensive questions and answers addendum issued by Empire State Development (ESD) for a Request for Proposals establishing a pre-qualified vendor pool for IT goods and services. The procurement seeks to create a list of qualified firms to provide consulting services, software development, cloud infrastructure, cybersecurity, data analytics, application development, AI/emerging technologies, and related hardware and software procurement for ESD's information systems infrastructure. The contract term is three years with an option to extend for up to one additional year. Vendors may qualify for one or multiple service categories within the scope of work and will be evaluated and qualified on a per-category basis. Remote work is permitted; however, all work must be performed within North America with no offshore resources allowed. ESD will release competitive mini-bids among pre-qualified vendors for individual task orders as projects arise, and no guaranteed minimum contract value, purchase volume, or number of task orders is specified.

Respondents are not required to provide resumes or named personnel at the pre-qualification stage, though summary profiles may be submitted if available. Certifications for products and services are preferred but not mandatory for disqualification. Three references overall are required covering relevant project experience in both public and private sectors, including references from subcontractors if applicable. Vendors may propose hourly rates for multiple experience levels and labor categories based on applicable scope items, with rates subject to evaluation and approval at the time of each mini-bid release. Annual rate escalations are permitted, and pricing may be negotiated for individual work orders. No pricing benchmarks, discount ranges, or historical spend information is provided by ESD. The solicitation is a new pre-qualified vendor list not replacing any existing contract, and all respondents must submit proposals regardless of prior contract status. ISO 27001, 27005, and 27035 certifications are not mandatory; vendors must follow applicable security standards guidelines. GDPR compliance is required only for web-based projects.

No. Question Answer

Given the extensive breadth of Scope of Work items (a through r, plus items 1 and 2), is there a minimum number or minimum category of scope items a

Respondent must affirmatively address in order for its proposal to be deemed responsive and eligible for pre-qualification?

Alternatively, is a Respondent that addresses only two or three scope categories—with "no response" provided for all others—considered equally eligible for pre-qualification in those addressed categories?

Vendor can submit for only one area or for as many as the vendor is qualified for.

For software consulting, application development, and cloud infrastructure scope items (Scope Items 2, 3e, 3f, 3g), will ESD require contracted personnel to be physically present on-site at ESD offices in New York, or will fully remote and/or near-shore delivery models be acceptable for the execution of individual work orders? If on-site presence is required for certain categories, please clarify which specific scope items mandate it.

Are the specific staff members named and credentialed in the proposal binding commitments for the duration of the panel contract, or may equivalent personnel with comparable qualifications be substituted when individual work orders are issued? If substitution is permitted, is prior written approval from ESD required, and what documentation must be submitted to evidence equivalency?

Vendors can supply a summary of profiles if availabe but not require.
