About this file

This Addendum 3 document modifies the Invitation for Bids (IFB) 6100066762 for Actuarial Services issued by the Commonwealth of Pennsylvania, Department of Labor and Industry on behalf of the State Workers' Insurance Fund (SWIF), with a due date of October 23, 2026, at 4:00 PM. The addendum supersedes previous responses to Questions 11 and 12 from Addendum 1 and Addendum 2, replacing the original IFB terms and conditions with updated contract terms and conditions that bidders must review in their entirety. The primary modification establishes revised liability requirements as specified in Section 1.56 of the contract.

Section 1.56 defines the Licensor's liability limitation as the greater of $500,000 or the total dollar amount of purchase orders issued for Licensed Products during the 12-month period preceding the damage claim event. Notably, this limitation does not apply to damages resulting from bodily injury, death, gross negligence, willful misconduct, unlawful misconduct, damage to real or tangible personal property for which the Licensor is legally liable, breach of confidentiality, or indemnification obligations. This liability clause represents a material modification to the contract terms and requires all bidders to acknowledge and accept these conditions as part of their proposal submissions.
