About this file

This is a Business Associate Addendum (BAA) for HIPAA compliance between a vendor and the Commonwealth of Pennsylvania, establishing the legal framework for handling protected health information (PHI) in connection with the Department of Labor and Industry's State Workers' Insurance Fund (SWIF) Actuarial Services contract. The document outlines the mutual obligations of both parties to protect PHI in accordance with the Health Insurance Portability and Accountability Act (HIPAA), the Health Information Technology for Economic and Clinical Health (HITECH) Act, and applicable Pennsylvania state laws. The Business Associate must implement comprehensive administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of electronic PHI, limit use and disclosure of PHI to the minimum necessary for providing actuarial services, and provide annual training to employees and subcontractors on PHI protection protocols.

The Business Associate is required to report any improper use, disclosure, or security incidents involving PHI to Pennsylvania's Office of Information Technology within two days of discovery and must comply with all state and federal breach notification requirements at the vendor's sole expense. The agreement mandates that the Business Associate maintain access logs of all PHI disclosures, provide individuals with access to their PHI within five business days upon request, comply with PHI amendment requests, and return or destroy all PHI upon contract termination unless retention is required by law. Material breaches of this agreement, including non-compliance with HIPAA or the Security and Privacy Rules, constitute grounds for immediate contract termination. The Business Associate must indemnify the Covered Entity against all claims and actions resulting from breaches or violations of privacy and security requirements and reimburse the entity for any civil monetary penalties imposed due to the Business Associate's non-compliance.

i. immediately discontinue providing PHI to Business Associate; and

ii. require the Business Associate to submit and adhere to a plan of compliance, including monitoring by the Covered Entity and reporting by Business Associate, as the Covered Entity in its sole discretion determines to be necessary to maintain compliance with this agreement, applicable laws, and federal agency guidance.
