Captain Jack Mill Superfund Site Operations and Maintenance RFP Summary

This is an Addendum 1 Questions and Answers document issued by the Colorado Department of Public Health and Environment (CDPHE) in response to vendor inquiries regarding RFP 2026000184 for Operations and Maintenance (O&M) services at the Captain Jack Mill Superfund Site. The RFP solicits comprehensive O&M services including environmental monitoring, water treatment plant operation, in-tunnel treatment system management, surface remedy maintenance, sludge removal and disposal, road maintenance, and data management. The contract period of performance begins June 1, 2026, and extends through May 31, 2027, with the option for additional multi-year periods not to exceed five years total. The current interim water treatment plant operates 24 hours per day, seven days per week, and requires response to system alarms on a prompt basis. Mandatory requirements include documented experience operating and maintaining at least one facility of similar size and complexity over the preceding five years, and completion of a minimum of two similar projects within the past five years. Key site features include the Big 5 adit approximately 650 feet in length, upper and lower settling ponds requiring sludge removal, in-tunnel treatment systems, an external passive treatment system still in pilot phase, remote dosing systems, and monitoring wells across multiple locations.

The annual budget for the scope of work is approximately $1,800,000, with a five-year total budget not expected to exceed $9,000,000. The current contractor, HDR, is performing portions of the O&M scope including environmental monitoring and database development under a separate remedial design contract for the external passive treatment system. CDPHE will provide selected state-owned equipment and infrastructure including components from the 2012 surface remedy, 2018 subsurface remedy, and EPA emergency response improvements completed between 2018 and 2020; however, the contractor must supply a backup generator and Automatic Transfer Switch, as the state does not own the existing interim water treatment plant, remote dosing systems, or associated equipment in the conex box. The contractor assumes responsibility for road maintenance and snow removal on California Gulch Road from Left Hand Canyon Drive to the site, and on the dirt road accessing the NiWot 2 remote dosing system. CDPHE expects the selected vendor to propose realistic costs based on the scope of work requirements, and cost sheets should be submitted covering the initial contract year from June 1, 2026, to May 31, 2027. Access to the site will be granted following full contract execution and a kick-off meeting, and the contractor will be included in existing landowner access agreements.

Vendor Question #1: As HDR is piloting and designing the final treatment system, are they currently performing aspects of the O&M scope outlined in this RFP at the Captain Jack site?

CDPHE Answer #1:

Yes HDR is currently performing some of the aspects of the O&M scope, including environmental monitoring, developing the master database, and drafting backlogged and current monthly reports.

Vendor Question #2: Are process/emergency alarm notifications provided remotely?

CDPHE Answer #2:

Process and emergency alarms notifications are not provided remotely to CDPHE. CDPHE expects the contractor to follow the emergency response protocol and notify the CDPHE project manager immediately in the event of an emergency.

Vendor Question #3: What is the specified timeframe the Operator needs to respond to system alarms?

CDPHE Answer #3:

While operators are not expected to be on site 24x7, CDPHE does expect that an operator will promptly respond to system alarms.

Vendor Question #59: RFP Part IV.B Project Timeline states contract period of performance (POP) is approximately 6/1/26 through 5/31/27. Attachment 2 Cost Sheet indicates POP of 5/1/2026 through April 30, 2027.

a. Can CDPHE clarify the correct initial year POP for this contract?

b. Shall the offeror only provide costs for the one-year POP and the stated scope line items in the Attachment 2 Cost Sheet?

CDPHE Answer #59:

a. 6/1/26 through 5/31/27

b. Yes

Vendor Question #60: Attachment 2 Cost Sheet line items compared to the SOW primary and sub-activities presents some discrepancies where there are additional scoped activities that may not likely occur within the initial year POP. For example, the passive treatment system installation is assumed unlikely to occur in the initial year.

a. Can CDPHE provide clarification of which primary and sub-activities shall be assumed to occur within the initial year POP?

CDPHE Answer #60:

Please see CDPHE answer to question #43.

Vendor Question #61: Part V.B.4 Mandatory Requirements states, “During those five years, the Offeror shall have operated and maintained at least one facility of similar size and complexity.” Please clarify the definition of “facility” for this mandatory requirement. The CJM in-tunnel treatment system, as a whole, is the only project of its kind in Colorado and perhaps the only project of its kind in the US for a CERCLA-related site.

a. Is this mandatory requirement in reference to a similar ex-situ WTP facility?

b. Similar scope and complexity of the general O&M elements?

c. Similar scope and complexity for an in-situ groundwater treatment system?

CDPHE Answer #61:

CDPHE understands that the Captain Jack Mill Superfund Site has some unique components. CDPHE will consider relevant experience as described in the vendor’s proposal, resumes, and other required attachments in the evaluation of the minimum qualifications requirement.

https://urldefense.com/v3/__https:/oitco.hylandcloud.com/CDPHERMPublicAccess/index.html__;!!PUG2raq7KiCZwBk!YPFL8FWrlqUrKPiqvrMRjSgcVFI9bPlT3USDy4ihrFSZwGY-Qthjvzt_6oLpf4qGrHdbOjZG18iXLzeu4i4YEdElsQ$

Vendor Question #62: RFP Part V.B.4 states as a mandatory requirement, “During those five years, the Offeror shall have operated and maintained at least one facility of similar size and complexity”. Part V.C.2 states for experience and qualifications, “Offeror shall have completed a minimum of two (2) projects of similar size and scope within the past 5 years.”

a. The mandatory requirement versus the experience and qualifications are citing different numbers of projects. Please clarify if this was intentional?

b. The experience and qualifications requirement part indicates ‘project completion’ as the main qualifier while the mandatory requirement part indicates ‘operated and maintained’ as the main qualifier. Will existing projects/contracts that are not technically ‘completed’ qualify? In other words, existing water treatment projects that are ongoing are assumed to be acceptable to meet the experience and qualifications requirement.

c. Are there exceptions to the 5-year minimum requirements for either part?

CDPHE Answer #62:

a. This is a typographical error. The RFP will be modified such that both requirements are consistent. The requirement is: “During those five years, the Offeror shall have operated and maintained at least one facility of similar size and complexity”.

b. Yes

c. No

Vendor Question #63: We have reviewed the In-Tunnel Treatability Study Work Plan Revision, dated May 2024 (Mine Water 2024) and have the following general questions:

a. Is this the most updated description of current site conditions? If not, please clarify what the most up to date work plan, report, or other document is that describes the current site operations.

b. General proposals were stated for installation of additional boreholes near the crosscut borehole #1, targeting the Niwot cross-cut west intersection of Left Hand Creek and Hwy 72. Was this additional work implemented? If so, is there a reference document or can further information be provided on this work?

c. Is the mine pool elevation still generally maintained between 120 and 130 ft?

CDPHE Answer #63:

a. Revision G, dated May 2024 is the most recent version of the In-Tunnel Treatability Study Work

Plan.

b. This information is not available.

c. Yes

Vendor Question #64: Is there an existing operations and maintenance plan for the in-tunnel treatment system?

CDPHE Answer #64:
